초록

「未来志向的な韓日関係」という言葉が登場してから35年間を、政治的優位、歴史的優位、司法的優位に分けて検討したところ、司法的優位や歴史的優位よりも、両国の首脳が政治的リーダーシップを発揮した政治的優位が、過去の歴史に起因する問題により柔軟に対応できることが分かった。司法の判決は、法的手続きに従い、所定の期間内に執行されなければならない強制力を持っている。歴史的真実の解明過程は長く、同じ事案についてもそれぞれの立場が異なり、合致できない場合も多く、異なる主張をする研究者たちがその研究を重ねることで、共通性よりも違いが深まる傾向が見受けられた。したがって、司法的優位や歴史的優位は、両国の首脳の立場を極端に追い込む危険性があった。また、「請求権協定第3条」には、韓日間に問題が発生した場合には規定に従って外交交渉で解決するようにと記載されており、政治的優位による過去の問題解決に関する法的根拠も備わっている。この規定を適用し、大法院は韓国政府が積極的に「慰安婦」問題解決に乗り出すべきだという判決を下したこともある。司法的自制原理も政治的優位を支える法理の一つである。結論として、未来志向的な韓日関係のためには、両国の首脳のリーダーシップが発揮される余地がもう少しある政治的優位の関係構築が適切であると言える。

영어초록

After 35 years since the term "future-oriented Korea-Japan relations" was introduced, an examination divided into political, historical, and judicial perspectives revealed that political leadership, where the leaders of both countries demonstrated political initiative, was more flexible in responding to issues arising from past history than judicial or historical approaches. Judicial rulings have the force of law and must be executed within a specified period, following legal procedures. The process of uncovering historical truths is long, and there are often differing perspectives on the same case. Even when researchers take different stances, rather than finding commonalities, the differences tend to deepen. Therefore, judicial or historical approaches can pose the risk of restricting the diplomatic flexibility of the leaders of both countries.
Furthermore, Article 3 of the "Claims Agreement" stipulates that in the event of a problem arising between Korea and Japan, the issue should be resolved through diplomatic negotiations according to the provisions, providing a legal basis for resolving past issues through political leadership. In applying this provision, the Supreme Court has previously ruled that the South Korean government should take an active role in resolving the comfort women issue. The principle of judicial restraint is also one of the legal principles that support political leadership.
In conclusion, for a truly future-oriented Korea-Japan relationship, it is more appropriate to establish a relationship based on political leadership, where there is room for the heads of state of both countries to exercise their leadership.
