종교인의 정치참여와 정교분리의 원칙 (Separation of politics and religion from a viewpoint of political participation of religious people)

초록

종교적 근본주의가 낳는 파국적 결과를 반복해서 경험하면서 오늘날 종교적 관용 및 종교의 자유는 오늘날에도 헌법상 가장 중요한 기본권의 하나로 인정되고 있다. 또한 특정 종교의 힘이 세속 질서를 결정하는 것을 막기 위해 정교분리원칙이 현대헌법에서도 널리 인정되고 있다. 그러나 이러한 정교일치와는 구별되어야 할 것이 종교인의 정치참여 문제이다.
‘정교분리’라는 원칙은 다양하게, 심지어 서로 다르게 해석되고 있다. 분명 헌법상 원칙으로서 중요한 의미를 담고 있지만, 그 구체적인 적용과 관련하여서는 아직도 고민해야 할 점들이 적지 않다. 더욱이 우리나라에서는 일제강점기와 독재정권을 겪으면서 정치와 종교의 관계가 왜곡된 부분들도 적지 않다.
이 글에서는 정교분리의 원칙의 의미와 구체적 적용범위를 보다 명확하게 밝히고자 한다. 정교분리의 원칙으로 인해 종교의 정치적 영향력이 배제되어야 할 부분과 종교인들 또한 국민의 한 사람으로서 정치참여가 허용되어야 할 부분을 섬세하게 구분하기 위해서는 ‘종교의 특성과 정교분리원칙’에 대해 정리했다.
그리고 그 바탕 위에서 ‘정치인의 종교의 자유와 종교인의 정치적 기본권’이 인정되어야 한다는 점과 그 이유를 확인하고, ‘압력단체로서 종교단체의 역할과 그 한계’, ‘종교적 색채를 갖는 정당 결성과 정교분리원칙’을 검토함으로써 정교분리원칙에도 불구하고 종교인들의 정치참여가 인정될 수 있다는 점 및 그 정당한 범위에 대해 고찰하였다.
독일의 작가 레씽(Gotthold Ephraim Lessing)이 쓴 『현자 나단(Nathan der Weise)』이라는 작품에서 시사되고 있는 것처럼 참된 종교는 세속에서의 갈등과 분쟁을 통해서가 아니라 인간의 삶을 올바르게 이끌고 많은 신도들의 영혼을 구제하는데 힘씀으로써 스스로를 입증해야 할 것이다. 그런 가운데 종교 간의 상호 존중을 통한 종교의 자유와 평화가 확보될 수 있을 것이다.
종교인들이 세속을 떠나야 한다거나, 세속 질서에 무관심해야 한다는 것은 아니다. 농부이면서, 노동자이면서 종교인일 수 있는 것처럼, 정치인이면서 종교인일 수도 있다. 또한 종교인들도 세속 질서 속에서 국민의 한 사람으로서 정치적 기본권의 주체이므로 종교인의 정치참여가 부인될 이유도 없다. 다만, 정치와 종교를 동일시해서는 안 된다는 것이다.
그런 의미에서 정교분리원칙은 종교의 자유를 확보하기 위한 헌법상의 중요한 요청일 뿐만 아니라 종교인의 정치참여의 가능성과 한계를 보여주는 기준이기도 하다.

영어초록

Today, the freedom of religion is recognized as one of the most important fundamental rights of the Constitution, by repeatedly experiencing the catastrophic consequences of religious fundamentalism. In addition, the Separation of politics and religion has been widely recognized in the modern Constitution in order to prevent the power of a particular religion from determining secular order. However, it should be distinguished from the political participation of religious people.
The principle of ‘separation of politics and religion’ is interpreted variously, even differently. Although it contains an important meaning as a constitutional principle, there are still a few points to be worried about the concrete application. Moreover, in Korea, the relationship between politics and religion has been distorted as a result of the Japanese colonial era and the dictatorship regime.
The purpose of this article is to clarify the meaning of the principle of ‘separation of politics and religion’ and the specific scope of application. The area in which the political influence of religion is to be excluded and fundamental rights of religious people should also delicately distinguish where political participation should be permitted as a citizen. This is discussed in ‘The Characteristics of Religion and the Separation of politics and religion.’ On the basis of this, we have confirmed the fact that 'freedom of religion of politicians and political fundamental rights of religious people' should be recognized. 'the role and limitation of religious organizations as pressure organizations', 'principle of separation of politics and religion', and the scope of its legitimacy is examined.
True religion, as suggested by the work of Nathan der Weise, written by Gotthold Ephraim Lessing in Germany, not through conflicts and struggles in the world, but to lead human life right, You will have to prove yourself by trying to save yourself. Religious freedom and peace through mutual respect among religions will be ensured.
It does not mean that religious people should leave the world or indifferent to secular order. It may be a politician and a religious person, as well as a farmer, a worker and a religious person. In addition, there is no reason why religious people are denied political participation of religious people because they are the subjects of political fundamental rights as one of the people in secular order. However, it should not identify politics and religion.
In this sense, the principle of ‘separation of politics and religion’ is not only an important constitutional request to secure freedom of religion but also a measure of the possibility and limitations of political participation by religious people.
