장애인 선거권의 실질적 보장과 공직선거법상 장애인의 기표절차에 대한 개선방안 연구 (A study on Ballot Paper Marking Procedure Improvement in Official Elections for an Effective Ensuring of Suffrage of Disabled People)

초록

본 논문의 목적은 장애인의 선거권을 실질적으로 보장하기 위하여, 공직선거법상 장애인의 기표절차에 대한 개선방안을 연구하는 것이다. 장애인이 공직선거법상 기표절차를 밟는 중에 장애로 인해 선거권이 사실적으로 제한되는 부분을 지적하고, 보통･평등･직접･비밀･자유의 선거원칙들과 평등원칙 등 장애인 선거권의 실질적 보장을 위한 헌법적 요청을 고려하여, 공직선거법상 기표절차에서 위와 같은 헌법적 요청에 부응하지 못하는 부분들에 대하여, 입법적･실무적 개선방안을 제시하였다. 본 논문의 핵심내용은 다음과 같다.
(1) 투표소투표(선거일 투표, 사전투표)에서 기표절차에 대한 개선방안은, ① 기표소, ② 투표용지 및 투표보조용구, ③ 투표보조인의 문제와 관련하여 검토한다.
① 기표소는 선거인이 투표내용의 비밀을 보장받으면서 자유롭고 안전하게 기표할 수 있는 조건과 크기를 갖추어야 한다(중앙선거관리위원회 운용지침 개정사항). ② 투표용지는 발달장애인도 쉽게 이해할 수 있도록 후보자의 사진과 정당의 심볼･마크도 함께 병기되어야 한다. 또한 중증장애인도 기표행위를 할 수 있는 투표보조기구를 각 선거구에 배치하여야 한다. ③ 스스로 정확한 기표행위를 할 수 없는 정신적 장애인을 위한 투표보조절차를 마련하여야 한다. 선거인이 가족을 투표보조인으로 지명하지 않는 경우에도, 선거인과 투표보조인간의 신뢰관계 등에 대한 확인절차를 밟는 것을 조건으로, 현재와 같이 2인이 아니라 1인만 기표소에 들어가서 기표행위를 지원할 수 있도록 하여야 한다(②. ③ 공직선거법 개정사항).
(2) 거소투표에서 기표절차에 대한 개선방안은 시설투표(① 기표소, ② 관리･감독절차, ③ 투표보조용구, ④ 투표보조인절차)와 비시설(거소)투표(⑤ 투표보조용구, ⑥ 투표보조인절차)로 나누어 검토한다.
① 시설투표의 경우도 투표소 투표와 마찬가지로 거소투표자의 수와 상관없이 시설투표를 실시하는 모든 시설에 기표소를 설치하여야 한다. ② 시설투표에서 투표의 관리감독을 선거위원회가 담당하여야 하고, 투표참관인을 의무적으로 배치하여야 한다. ③ 시설투표의 경우에도 투표소 투표와 마찬가지로 투표보조용구를 의무적으로 제공하여야 한다. ④ 기표소를 설치하지 않은 시설투표도 투표소 투표와 마찬가지로 선거인이 스스로 기표절차를 밟을 수 없는 경우, 선거인을 지원하는 투표보조인절차를 마련해야 한다. ⑤ 비시설투표의 경우에도 투표소 투표와 마찬가지로 투표보조용구를 의무적으로 제공해야 한다. ⑥ 선거인이 스스로 기표절차를 밟을 수 없는 경우, 선거인을 지원하는 투표보조인절차를 마련해야 한다(①∼⑥ 공직선거법 개정사항). 그밖에 비시설(거소)투표의 경우 시설투표와 같이 기표소설치의무를 두거나, 선거관리위원회에 의한 대면 관리감독을 의무화할 필요는 없다.

영어초록

This study examines the ballot paper marking improvement measures for disabled people in official elections to ensure their effective suffrage. In actuality, their ballot paper marking efforts are limited due to their disabilities. The constitution requires the realization of the five principles of election - Universal Suffrage, Equal Suffrage, Direct Suffrage, Secret Ballot, and Free Suffrage - and the principle of equality, but the ballot paper marking procedures for disabled people cannot necessarily comply with such requirements. This study presents legal and working improvement measures and its summary is presented below.
(1) The ballot paper marking procedure improvement measures in voting in polling stations (on election-day vote, early vote) examine problems in relation to ① voting booths, ② ballot paper and voting aids, and ③ voting assistants.
① A polling booth needs to be equipped with appropriate conditions and sizes so that the voter can cast a ballot secretly and mark the ballot paper freely and safely (① need to be reflected in an amendment to the SOC of the Central Election Management Committee). ② The ballot paper needs to feature the candidates' photos and the parties' symbols and marks all together so as to allow even disabled people to easily recognize them. In addition, voting aids need to be installed in each election district to allow even severely disabled people to mark the ballot paper. ③ Voting assistant procedures for mentally disabled people need to be introduced to enable them to properly cast ballots. Even when the voter does not appoint his family member as a voting assistant, only one assistant, instead of two assistants under the current procedures, should enter the polling booth together with the assistant to help mark the ballot paper on condition that the trust between the two people is confirmed(②∼③ need to be reflected in an amendment to the official election law).
(2) In relation to non-attendance voting, ballot marking procedure improvement measures are classified into facility voting (① polling booths, ② supervision procedures, and ③ voting aids, ④ voting assistant procedures) and non-facility (stay-at-home) voting (⑤ voting aids ⑥ voting assistant procedures).
① The facility voting, like voting at polling stations, requires the installation of polling booths in all facilities where voting occurs, regardless of the number of non-attendance voters. ② In the facility voting, the supervision for voting should be conducted by the Election Committee, and observers must be deployed. ③ Facility voting is required to provide voting aids like voting at polling stations. ④ The facility voting, like voting at polling stations, must prepare a voting assistant procedure to help with voting if the voter can not mark the ballot paper. ⑤ Non-facility-voting is also required to provide voting aids like voting at polling stations. ⑥ If the voter can not undergo the ballot paper marking procedure by himself, the voting assistant procedure should be prepared to help with voting. In addition, the non-facility (stay-at-home) voting does not necessarily require the installation of polling booths like in facility voting, and in-person supervision by the Election Committee (①∼⑥ need to be reflected in an amendment to the official election law).
