초록

현행 장애인복지법은 차별금지를 중요한 원칙으로 선언하면서도, 일부 재외동포 및 외국인에 대해서만 장애인등록을 허용하고 있고, 등록한 이들에 대해서도 예산 등을 고려하여 장애인복지사업의 지원을 제한할 수 있다고 규정하고 있다. 이로 인해 장기체류 외국인 중에서도 장애인등록을 할 수 없는 외국인이 다수 존재하고, 장애인등록을 하였다고 하더라도 필요한 장애인복지사업의 대상에서 배제되고 있는 실정이다. 특히 제한되는 장애인복지사업에대한 별도의 위임 규정이 없어, 각 사업별로 장애외국인에 대한 적용 여부를임의로 정하고 있는 것으로 보인다. 이로 인해 사회보장이념 및 국제인권규범에 입각하여 마땅히 보장되어야 할 장애외국인의 권리가 침해되고 있으며, 불합리한 차별이 발생하고 있다. 또한 국적법 및 관련 지침상 귀화 요건으로 장애인에 대한 고려가 미비하여 경제활동이 어려운 장애인에게도 생계유지능력을 동일하게 요구하는 등 사실상 국적 취득에 있어 장애인을 차별하는 결과를야기하고 있다.
본 글에서는 먼저 국내 체류하는 장애외국인의 사회보장법상 지위를 살펴보고, 외국인 관련 장애인복지법의 입법 연혁과 장애인등록 대상 및 장애인복지사업의 외국인 적용 여부를 비판적으로 검토한다. 나아가 유엔 장애인권리위원회의 권고 등을 통해 장애외국인 관련 제도를 개선하기 위한 법적 과제가무엇인지 살펴보고, 그에 따라 장애인복지정책이 나아가야 할 방향을 제시하고자 한다. 보충하는 논의로 장애가 있는 외국인이 대한민국 국적으로 귀화를함에 있어 겪는 어려움을 살펴 현행 제도가 가지고 있는 한계를 검토해보고자한다.

영어초록

The Act on Welfare of Persons with Disabilities declares the prohibition of discrimination as an important principle, but only allows certain overseas Koreans and foreigners to register as persons with disabilities. Moreover, even for those who are registered, it stipulates that support for disability welfare-related services may be restricted in consideration of budgets, etc. As a result, a significant number of long-term stay migrants are unable to register as a person with disability, and even those who have registered are excluded from the necessary support provided by disability welfare programs. Due to the lack of specific delegation regulation for the limited disability welfare services, the eligibility for foreigners with disabilities is arbitrarily decided according to the discretion of the relevant department for each services.
Consequently, the rights of foreigners with disabilities, which should be guaranteed accordance with social security principles and international human rights standards, are being violated, resulting in unreasonable discrimination. In addition, the Nationality Act and related guidelines inadequately require the ability to maintain a livelihood equally for the disabled with economic difficulties, thereby leading to a discrimination against the disabled in acquiring nationality.
This paper first outlines the legal status of foreigners with disabilities residing in Korea under social security laws.
Subsequently, it examines the legislative history of the Act on Welfare of Persons with Disabilities related to foreigners, the eligibility criteria for disabled registration, and the limitations for foreigners in welfare services for the disabled. Furthermore, it reviews the recommendations for the UN Committee on the Rights of Persons with Disabilities and explores the legal tasks for improving the system related to foreigners with disabilities and suggests the direction to be taken. As a supplementary discussion, it examines the difficulties that foreigners with disabilities face in naturalizing as Korean citizens and explore the limitations of the current system.
