로마법상 侵辱 불법행위에 관한 소고－고전기법상 자유인을 직접 대상으로 하는 侵辱 사례를 중심으로－ (Actio Iniuriarum in Classical Roman Law－Focusing on the Civil Action Cases Freeman Concerned－)

초록

로마법상 ‘침욕(侵辱, iniuria)’에 대한 규율은 12표법상의 신체침해에 대한 규정(XII. Tab.8.2-4)에서 출발한다. 지체불구화나 골절에 이르지 않는 비교적 경미한 신체침해를 의미하는 ‘침욕’은 초기에는 물리적 신체침해에만 국한되었으나 이후 법정관 고시법을 통해 신체에 대한 물리적 침해 외에도 고성비방을 비롯하여, 강제추행, 스토킹, 재산권행사 방해, 나아가 신용훼손 및 일반적 행동의 자유 침해 사안에 이르기까지 매우 다양한 사안유형들을 포괄하며 발전하게 된다.
고전기 방식서소송에서는 침욕에 해당하면 그 효과로 침욕평가소권(actio iniuriarum aestimatoria)이 부여된다. 우선 법정절차에서 피해자가 법정관 면전에서 자신이 당한 침욕을 특정하고 그에 대한 평가액을 제시한 후 법정관으로부터 침욕소권을 부여받는다. 다음 단계인 심판인절차에서 심판인이 피고가 침욕을 행하였는지를 판단하고 선과 형평에 따른 재량으로 평가한 상당액만큼 유책판결한다. 자유인에 대한 침욕의 경우 배상은 ‘비재산적 손해’에 대한 배상이었는데, 이는 로마법상 ‘자유인의 신체 자체는 가액평가의 대상이 되지 않는다’(liberum corpus nullam recipit aestimationem)라는 법리가 적용되었기 때문이다.
고전기가 지나고 후대로 가면서 침욕은 민사절차를 통한 금전배상보다는 비상심리절차를 통한 형사제재로 규율되고, 후대 형사법의 일반적 경향을 공유하며 형벌의 수위도 가혹하게 된다.

영어초록

The Korean Civil Code Art. 751(1) provides the compensation for immaterial damage in case of the physical injuries, infringement of a person’s liberty or reputation et cetera. This paper deals with iniuria, one of the delicts in Roman law, in contemplation of furthering the historical understanding of the Korean Civil Code Art. 751(1).
The historical origin of actio iniuriarum in Roman law is traced to the Twelve Tables (XII.Tab.8.2-4) and iniuria implied then a lesser physical injury or assault to the body of a man. The legal effect was paying a fixed sum of money. Around the turn of the third to the second century B. C., there were significant changes. The praetors introduced under the law of formulary civil procedure and with the social changes in view actio iniuriarum that covered various forms of injury including assaults, slander, stalking and so on. Even preventing a person from using his own property, treating a person as a debtor and infringement of freedom of general conduct had been sanctioned as iniuria. Dolus malus was required for all types of iniuria, but there is a dispute over whether the animus iniuriandi, the intention to insult was required or not.
In the proceeding in iure, the victim had to specify the injury he suffered and present his own evaluation amount before the praetor, who was, however, in his taxatio not bound to it, and then in the proceeding apud iudicem the iudex judged whether the offence was committed and fixed the amount of compensation at his discretion ex bono et aequo within the limit of the praetorian taxatio, unless the injury was serious (atrox) for which the praetor normally fixed the amount. It should be noted that the compensation was for immaterial damage not for material damage, because the rule liberum corpus nullam recipit aestimationem, i.e. a body of a free man is not subject to valuation, was applied under Roman law. The actio iniuriarum was an actio poenalis incurring infamia as well as an actio vindictam spirans that was inheritable on both sides of the parties unless an action has been instituted.
