방송외주제도 20년의 평가와 개선방안 - 외주제작 거래를 중심으로 - (A Study on Outcomes and Alternatives of Independent Production Policy in Korean Broadcasting Institution - focused on the outsourcing production transactions-)

초록

국내 외주제도가 도입되지 20년이 지났지만 아직까지 정책성과에 대한 의견이 분분하다. 특히, 외주거래 관행에 대한 문제점과 갈등이 지적되고 있다. 이러한 이유는 외주제도가 그 궁극적인 정책목표를 달성하지 못했거나, 외주제도의 정책이 현실의 문제를 적절히 개선하지 못했기 때문이다. 따라서 본 연구는 이러한 문제의식에 따라 국내 외주제도와 외주거래에 대한 현실을 전면적으로 재검토하여 올바른 개선방안을 제시하고자 한다. 그동안 외주제도는 양적 성장에 비해 정책목표를 달성할 정도의 내실은 확보하지 못한 것으로 나타났다. 외주거래는 저작권의 권리배분, 적정한 외주제작의 대가, 그리고 이익의 배분에 있어서 방송사와 외주제작사 간의 갈등이 심각했다. 이러한 문제를 해결하는 방안으로 구체적인 외주제작 인정기준의 마련, 적정한 대가를 판단하기 위한 표준제작비의 조건 그리고 이에 근거하여 실효적인 계약이 이루어지도록 하는 가이드라인의 법제화를 제시했다. 뿐만 아니라 규제와 함께 독립제작시장을 활성화하기 위한 진흥정책으로 출판형 방송생태계의 조성, 한국형 신디케이션 모델의 구축, 그리고 콘텐츠 유통을 촉진하고 공정거래를 보장하는 법률의 제정을 추가로 제안했다.

영어초록

Although it takes 20 years since 1999 when ‘Independent Production Quota Regulation’ was established under the Broadcasting Act, there were different views on the practical effects of this rule on the growth of the independent production market and the diversity in program. In particular, it is pointed out that new problems and conflicts have been broken out in the business relationship between terrestrial broadcasters and independent productions. The reason is because this policy has not achieved its goal or solved problems in the outsourcing production transactions. So, first this study aims to investigate the outcomes on ‘Independent Production Policy’ and the outsourcing business relationship in the independent production market, and then it suggests and discusses alternatives and the implementation of better version. The results show that the policy does a lot for quantitative growth in independent production market. However the competitiveness on the independent production market remains unchanged. It is necessary to improve the inequality and the unfairness in outsourcing transaction. There are serious discords in the outsourcing transaction of broadcasters with independent productions-the allocation of copyright, criteria for estimating price, the allocation of return etc. Based on investigation, this study suggests to introduce the authorization criteria for outsourcing production, a list of indicative tariffs relating to the standard production costs and fees for primary rights, and the guideline on outsourcing production in provided in the law. In addition, it gives emphasis to the need of supporting policies to activate independent production market as well as to develop the Publisher Broadcasting System, to introduce the syndication model suitable for Korean broadcasting ecology and to secure fair transactions and distribution on program through introducing a new law.
