혈통을 알 권리에 대한 유럽인권법원 판결의 동향 (Trends in European Court of Human Rights ruling on the Right to know one’s origin)

초록

장시간의 논의 끝에 출생통보제와 보호출산제도가 법제화되었다. 보호출산법은 의료기관에서 위기임부의 비식별화된 가명과 관리번호로 출생통보를 하도록 하는 한편 아동권리보장원에 출생증서를 보관하여 출생한 아동의 청구가 있을 때는 공개하도록 하고 있다. 그러나 이 제도는 위기임부의 완전한 익명을 보장하지 않고 있어 보호출산제의 실효성에 의문이 있고, 친생모의 동의 없이는 완전한 공개가 이루어지지 않는다는 점에서 아동의 알 권리가 충분히 보장되지 않는다. 보호출산아동의 가족관계등록부에 친생부모의 정보가 기록되지 않고 사후의 정보공개청구 또한 제한적이기에 자녀의 알 권리가 침해될 여지가 있는데, 이것은 보호출산제와 같은 취지의 제도를 도입한 모든 국가에서 완전히 해결되지 않은 과제이기도 하다. 출생정보는 개인의 정체성 형성에 중대한 영향을 미치는 것으로, 입법자는 자녀가 출생정보에 접근할 수 있는 권리를 보장하여야 할 것이며, 이때 익명을 유지할 친생모의 권리와 자녀의 “혈통을 알 권리” 간의 형평이 반드시 고려되어야 한다.
익명출산을 제도적으로 인정한 유럽 여러 국가에서는 친생모가 신원의 익명을 유지한 채 출산한 자녀의 알 권리와 관련된 논의가 일찍부터 진행되었다. 유럽인권법원에서는 익명출산으로 태어났거나 입양된 자가 친생모 또는 친생부를 알고자 하였으나 좌절된 사건에서 유럽인권협약 제8조의 위반여부를 판단하여 왔다. 이 논문에서는 최근 제정된 보호출산제에서 출생증서의 작성 및 공개에 관한 내용을 살펴보고 “혈통을 알 권리”에 관한 유럽법원의 최근 주요 판결을 검토하여 보호출산제 도입 후의 문제에 대비할 방안을 모색하고자 하였다.

영어초록

After a long discussion, the birth registration system and the Anonymous Childbirth System have been legislated, but discussions on the pros and cons of existing issues are still expected to remain parallel for the time being. Above all, the problem is that the child's right to know is violated because the information of the biological parents is not recorded in the family relationship register of the child, and the request for information disclosure is limited. This is also a task that has not been completely resolved in all countries that have introduced similar legal systems. However, there are doubts about the effectiveness of the Anonymous Childbirth System as it does not guarantee full anonymity of crisis pregnant women, and it is unclear whether children's right to know will be guaranteed in that the full disclosure of birth certificates is not made without the consent of their biological mothers and biological fathers. Prior to the enforcement of the law, the presidential decree should specifically determine how to confirm the consent of the president of the Children's Rights and the reasons for disclosing the birth certificate regardless of the consent of the biological mother and biological father. Legislators should guarantee children's right to access birth information to a certain extent, and at this time, equity between the right of the biological mother to remain anonymous and the right to know the pedigree of the child must be considered.
In European countries that have systematically recognized anonymous births, discussions have been held early on regarding the infringement of the "Right to know one’s origin" of those born with the biological mother remaining anonymous. The European Court of Human Rights has judged whether a person born or adopted by anonymous childbirth violated Article 8 of the European Convention on Human Rights in a frustrated case that attempted to know the biological mother or biological father. In this paper, we looked at the preparation and disclosure of birth certificates in the recently enacted protective birth system and reviewed the European Court's recent major rulings on the "Right to know one’s origin" to find ways to prepare for problems after the introduction of the protective birth system.
