체육교습업 입법과정과 의도되지 않은 결과: 리틀야구를 중심으로 (Unintended Consequence in Execution of Sports Lesson Business: Focused on the Little League baseball)

초록

This study aims to examine the legislative and execution processes of Sports Lesson Business and identify unintended consequences that Little League baseball teams involved in Sports Lesson Business have faced. To explore the legislative process of Sports Lesson Business, this study conducted in-depth interviews with 11 representatives or coaches from Little League baseball teams involved in Sports Lesson Business tand one government agency official involved in policy-making, and a literature review of academic papers and reports. The data were analyzed using constant comparative analysis. The research rigor and ethical considerations were continuously validated throughout the data collection and analysis process. Based on this research methodology, the following research findings were obtained. First, the legislative process of Sports Lesson Business unfolded as follows: Similar bills were sequentially introduced by three different Representatives. The process of scrutiny by standing committees and the Legislative and Judiciary Committee skipped the subcommittee review, and there needed to be more scrutiny and a lack of questioning and debate. In summary, examining the legislative process of Sports Lesson Business revealed issues such as a showpiece bill presentation, inadequate review process, and insufficient scrutiny. Secondly, the unintended consequences manifested primarily as commercial activities and varying interpretations by officials. Firstly, unintended consequences related to commercial activities were observed concerning the use of public sports facilities. Due to the lack of specific regulations regarding Sports Lesson Business, officials at the local government level interpret the rights and obligations differently, leading to inconvenience.
