분재기를 통해 본 16세기 상속재산의 전승 양상 (A transmission aspect of inherited property in the 16th century through the Records of Property Inheritance)

초록

본 연구는 16세기 재산상속제의 실상을 고찰하기 위하여 분재기를 토대로 양반가의 상속재산이 전승되는 양상을 살펴보았다.
16세기 전후에 작성된 분재기 중에는 상속 대상이 되는 노비와 토지의 전래처를 기록한 사례가 존재한다. 이것은 해당 재산이 어떤 경로를 통해 형성, 전승되었는지를 파악할 수 있는 중요한 단서가 된다. 그리고 전래처의 기록이 없더라도 재주財主와 상속자의 상관관계를 추적해보면 어떤 경로를 거쳐 재산이 형성, 전승되었는지를 파악할 수 있다. 다시 말해 분재기 속에 나타난 상속 대상의 전래처, 재주와 상속자의 관계를 토대로 상속받은 재산이 얼마만큼 어느 기간 동안 유효하게 전승되었는지를 살펴볼 수 있다.
광산김씨 후조당종택의 사례에서는 노비의 전래처 기록을 토대로 김효로金孝盧와 양성이씨의 재산이 김연金緣에게 상속되고, 다시 김연과 창녕조씨의 재산이 김부필金富弼에게 상속되는 양상을 고찰하였다. 이 과정에서 김연이 부모로부터 상속한 노비 중 약 26%가 아들 김부필에게 전승되었으며 모변보다 부변 노비의 비율이 높게 나타나는 양상을 보였다.
이와 비슷한 시기에 작성된 재령이씨 영해파종중의 사례에서는 재주와 상속자의 상관관계를 추적하여 이은보가 李璦와 진보백씨의 재산을 상속받는 과정과 이은보의 처 전의이씨가 부모의 재산을 상속받는 과정을 고찰하였다. 그리고 이은보와 전의이씨의 재산이 이함李涵에게 상속되는 과정을 고찰하였다. 이에 따라 이은보 부처가 부모로부터 받은 노비 중에서 약 20%가 아들 이함에게 전승되었으며 이 역시 모변보다 부변 노비의 비율이 높게 나타났다.
위의 두 사례에서는 16세기 부모가 자녀에게 전승한 재산 중에서 대략 20%가 다음 대까지 이어지고 있었다. 그러나 이것은 상속이 이루어지는 시점, 상속 대상의 유한성, 치산 방식의 차이 등에 따라 다른 결과가 나타날 가능성이 높기 때문에 하나의 비교군으로서 의미를 가진다. 또한 분재기 외의 자료들을 활용하여 상속재산의 전승 형태를 보다 면밀하게 고찰하기 위한 선행작업으로서의 의의가 있다.

영어초록

This study examined an aspect that inherited property of Yangban based on the Records of Property Inheritance in order to study the fact of the system for inheritance of property in the 16th century.
The Records of Property Inheritance becomes a clue to be able to grasp the origin that inherited property was formed because they have the examples which recorded places for transmission of heirs. And even though there are no any records of places for transmission in the Records of Property Inheritance, property can be divided into the main family and the husband’s in-laws through the relationship with the applicable holding institutions. And this also becomes a clue to be able to grasp one aspect that inherited property is handed down.
For the Records of Property Inheritance of Gwangsan Kim Clan Hujodangjongtaek written before and after the 16th century, the transmission aspect that inherited property was connected from Kim, Hyoro to Kim, Yeon and from Kim, Yeon to Kim, Bupil as the places for transmission of heirs were recorded in it. In other words, about 26% of the slaves that Kim, Yeon inherited from his parents were transmitted to the son. And the rate of paternal slaves has found to be higher than the rate of maternal slaves.
For the Records of Property Inheritance of Jaeryeong Lee Clan YeonghaepaJongjung written around the same time, the places for transmission of heirs were not recorded in it. But there are the Records of Property Inheritance of the husband’s in-laws and the transmission aspect of inherited property has found to be connected from Lee, Ae to Lee, Eunbo and from Lee, Eunbo to Lee, Ham. In other words, about 20% of the slaves that the Lee, Eunbo couple received from the parents was handed down to their children. And the rate of paternal slaves has also found to be higher than the rate of maternal slaves.
These conclusions are meaningful as a comparative group because they have the possibility of being changed depending on time of inheritance, heirs’ limitations, and families’ ways to manage household affairs and as the upfront work to study inherited property more closely by utilizing various materials with the Records of Property Inheritance.
