초록

본 논문은 논산 파평윤씨 가문의 사례를 통하여 가범(家範)을 만들어 조상 제사를 세전(世傳)하게 된 배경과 그 의미를 분석한 글이다. 윤씨가(尹氏家)의 가범은 16세기말 유학자 우계(牛溪) 성혼(成渾)의 유서로부터시작되었다. 그가 남긴 유서를 그의 사위인 윤황(尹煌)이 받아들여 파평윤씨 집안의 가훈으로 발전시켰다.
그리고 윤황의 후손들에게 그 가르침이 종가세전문(宗家世傳文)이라는 명칭으로 받아들여지고 세전되면서윤씨 가문의 존속을 위한 중요한 운영원리가 되었다.
이 가범은 균분상속의 기조를 이어가면서 종가 중심의 봉사(奉祀)로 이행하도록 하는 내용을 골자로 하고있다. 17세기 이후 균분상속이 와해되고 차등상속이 진전되면서 차등상속의 수혜자에게 봉사의 책임이 가중되는 것이 일반적인 흐름이었다. 하지만 윤씨가의 가범은 종가 중심의 봉사로 이행하되 균분상속은 유지하라고 천명하고 그 구체적 방안을 제시한 점이 도드라진다. 윤씨 가문 구성원들은 18세기 중엽에 후손들이모여 이 가범을 재확인하고 준수해 나갈 것을 약속하였다. 이를 통해 가산(家産)에 대한 동등한 소유의식, 종가가 중심이 되고 지자(支子)가 보조하는 제사 존속 방식이 후손에 의해 지속적으로 실현되었음을 알 수있다.
윤씨 가문의 가범에 나타나는 특징은 첫째, 조선 사회의 전통적 균분상속과 주자성리학적 예제(禮制)의 반영인 종가 중심의 봉사가 융합되었다는 점, 둘째, 혈족 위주의 가족질서로부터 동성 친족 중심의 친족제로변화하는 시기인 17세기에 처부(妻父) 및 외조부의 유훈(遺訓)이 가범으로 발전했다는 점이다. 즉 가범의 성립에서 전승에 이르기까지 정통 예제와 현실적 상황이 지속적으로 융합한 모습을 볼 수 있다.

영어초록

This study analyzed the establishment process and content of a family procedure for transmitting ancestral rites in the case of the Papyeong Yun family of Nonsan. The family tradition began with the will left by Woogye Seong Hon, a Confucian scholar in the late 16th century. His son-in-law Yun Hwang accepted his will and developed it into the family motto of his Papyeong Yun family.
Following him, his descendants succeeded in his teachings and made the family tradition the most important management principle of the Yun family.
The gist of this family custome is a transition to a memorial service led by the head family with the basis of equalized inheritance kept intact. As differential inheritance settled down after the collapse of equalized inheritance in the 17th century, it became common practice to add the responsibility of memorial service to the beneficiary of differential inheritance. The family custome of the Yun family is prominent in that it ensures the maintenance of equalized inheritance after a transition to a memorial service led by the head family. In the Yun family, the descendants gathered together in the middle 18th century, reconfirmed this family custome, and clarified their will to keep it. This ensured that the descendants of the family continued to have equal ownership of the family fortune and maintained the memorial service approach in which the head family played the central role with other sons assisting them.
There are some characteristics to the family rule of the Yun family. First, it shows the fusion of traditional equalized inheritance in Joseon society and the head family-centric memorial service institution to reflect the courtesy system based on Zhu Xi’s Neo-Confucianism. Secondly, teachings from the wife’s family and the mother’s side, which witnessed a change from the family order rooted in blood relatives to the relative system based on the relatives of the same family, developed into the family custom in the 17th century. That is, this shows the process of the Yun family continuously promoting the fusion of the traditional courtesy system and their realistic situations from the establishment to the transmission of their family custom.
