조선 전기 유교식 불효의 출현 - 성종 대 이심원 불효 사건을 중심으로－ (The Emergence of Confucianism in the Early Joseon Period － Focused on the Case of Lee Simwon)

초록

조선은 건국 직후부터 유교식 효와 효행을 통해 유교적 사회 질서를 구축하고자 하였다. 이 과정에서 효는 절대적 가치가 되어 조선 사회에 영향력을 행사하였다. 이를 잘 보여주는 것이 불효이다. 효를 강조할수록 효의 대척점에 있는 불효 또한 부각되어 사회적 이슈가 되었던 것이다. 이러한 맥락에서 성종 대에 발생한 이심원 불효 사건은 효가 절대화되며 불효가 부각되는 과정을 잘 보여준다. 무오사화 당시 죽은 이심원은 중종 이후 충신으로 인정받았지만, 살아 있는 동안에는 불효자의 꼬리표를 달고 살았다. 성종 대에 고모부 임사홍의 탄핵에 깊게 관여하였다가 조부 이합과의 관계가 틀어지면서 불효죄로 고발당하였기 때문이다. 그렇지만 그의 불효죄에 대해서는 석연찮은 부분이 있었기 때문에 조정에서는 여러 차례 격론이 발생하였다.
이 글은 이러한 격론의 내용을 통해 불효에 대해 접근하였다. 이 과정에서 효와 불효의 변화를 파악하고자 효/비효(非孝)/불효의 설명틀을 사용하였다. 이를 통해 살펴본 결과 이심원의 불효 사건이 발생한 15세기 후반 불효죄는 세 가지 특징이 있었다. 첫째는 불효의 범위 확대이다. 이는 효와 불효의 중간 영역에 속하면서 효도 불효도 아니던 비효가 불효로 전환한 것이다. 이심원이 조부에게 대든 행위가 대표적인 예라 할 수 있다. 둘째는 불효의 주관적 성격 강화이다. 효행 대상자의 주관에 따라 불효죄는 성립도 해소도 될 수 있었다. 셋째는 불효의 구속력 강화이다. 효의 가치 절대화는 효를 부정하는 불효에 대한 엄격한 처벌로 이어졌다. 그리고 이는 유교 사회에서 통용되는 효의 가치를 절대화하면서 출현하였다는 점에서 유교식 불효라 할 수 있다.

영어초록

After the founding of the country, Joseon tried to establish a Confucian social order through Confucian filial piety. In this process, filial piety became an absolute value and exerted influence on Joseon society. It is not good to show this well. The more filial piety was emphasized, the more unfilial piety was emphasized, and it became a social issue. In this context, the case of Lee Simwon's unfilial piety that occurred during the reign of King Seongjong shows the process of absoluteizing filial piety and highlighting unfilial piety. Lee Simwon, who died at the time of Muosahwa, was recognized as a loyalist after King Jungjong, but while he was alive, he lived under the label of a bad son. This is because he was deeply involved in the impeachment of his uncle Lim Sa-hong during the reign of King Seongjong, and was accused of being ineffective due to the deterioration of his relationship with his grandfather Lee Hap. However, since there was a dubious part about his crime of infidelity, several heated debates occurred in the court.
This article approached unfilial piety through the contents of this heated debate. In this process, an explanation frame of filial piety/nonfilial piety/unfilal piety was used to grasp the change in filial piety and unfilial piety. As a result of examining this, there were three characteristics of the crime of insolence in the late 15th century, when the case of Lee Simwon's insolence occurred. The first is the widening of the range of unfilial piety. This is the transition of nonfilial piety, which belonged to the middle area between filial piety and unfilial piety, and was not filial piety, to unfilial piety. The act of Lee Simwon against his grandfather is a representative example. The second is the strengthening of the subjective nature of unfilial piety. Depending on the subjectivity of the person subject to filial piety, the crime of filial piety could be established and resolved. The third is strengthening the binding force of unfilial pirety. The absoluteization of the value of filial piety has led to strict punishment for unfilial piety, which denies filial piety. In addition, this can be said to be a Confucian-style filial piety in that it emerged while absoluteizing the value of filial piety used in Confucian society.
