북한 투자보장협정에 있어서의지속가능발전 요소 도입방안 (A Study on Sustainable Investment Factors in the Bilateral Investment Agreement of the North Korea)

초록

북한이 2006.8.9 첫 핵실험을 시도한 직후 유엔안보리가 동 핵실험에 대한 제재조치로 결의안 1718호를 채택한 이래, 국제사회는 강력한 대북 제재를 채택하고 이행하여 왔다. 유엔의 제재는 대북 합작 및 합자회사 등 대북 투자를 제한한 결과, 북한의 경제 및 산업 전반에 포괄적인 영향을 미쳐 왔고 이러한 경제제재로 인하여 북한의 실물경제는 고사할 위기에 처해있다. 이를 타개하기 위한 노력의 일환으로 2019.2.28. 하노이 북미정상회담이 추진되었으나 결렬되었다. 비록 많은 기대를 모았던 북미정상회담이 결렬되었지만 대북 경제제재로 인한 경제의 쇠락을 멈추기 위해 북한은 노력할 것이고, 북한의 경제성장에 대한 강한 열망으로 인하여 곧 비핵화를 향한 발걸음이 시작될 것으로 예상된다. 만일 북핵이슈가 타결될 경우 북한은 경제 재건을 위한 외자유치조성을 위해 투자보장협정 체결을 본격화 할 것으로 사료된다.
최근 들어 투자보장협정에도 변화가 일어나고 있다. 특히 신규 체결되는 투자보장협정에는 3가지 특징이 발견된다. 첫째, 지속가능발전의 요소가 도입되고 있다. 둘째, 투자유치국의 규제권한 보호가 부각되고 있다. 셋째, 투자유치국이 투자분쟁에 노출되는 것을 최소화하기 위한 규정들이 도입되고 있다. 이러한 측면에서 신규 투자보장협정에는 소위 ‘지속가능투자’의 요소들이 대거 포함되고 있는 형편이다. 한편, 북한은 이제까지 총 24개국과 투자보장협정을 체결하고 있고, 이 중 중국, 체코, 덴마크, 이집트, 이란, 마케도니아, 말레이시아, 루마니아, 러시아, 세르비아, 싱가포르, 슬로바키아, 스위스, 태국 등 총 14개국과의 투자보장협정이 발효되어 있다. 그러나 북한의 기존 투자보장협정에는 지속가능발전과 관련된 어떠한 요소도 전혀 포함되어 있지 아니한 실정이다.
최근 투자보장협정은 그 어느 때보다도 수많은 도전을 받고 있다. 인도나 중남미 국가들의 경우 투자자-국가 분쟁해결절차의 문제점을 지적하는 것에서 모자라 기존 투자보장협정을 폐기하는 수순에 들어가기도 하였다. 그러한 점에서 북한이 향후 체결하고자 하는 투자보장협정은 과거 외교적 보호권 탈피수단이라는 단순 명제에서 벗어나 투자유치국인 북한과 투자자에게 궁극적으로 지속가능한 발전을 가져오는 수단으로 탈바꿈해야 한다. 따라서 북한이 체결하는 투자보장협정에 지속가능한 투자 요소를 도입하는 다양한 방안을 강구해 볼 필요가 있다. 즉, 환경보호를 위한 투자유치국의 규제권한을 보장하고, 환경관련 정부의 조치는 투자자-국가 분쟁해결에서 배재하는 등의 규정을 도입해 볼 수 있다. 또한, ‘기업의 사회적 책임’ 규정의 도입은 국제법상 강행규범은 아니지만 기업들로 하여금 보다 지속가능한 투자를 하도록 유도하는 soft law의 특성을 지니고 있으므로 이와 같은 규정들을 향후 북한의 투자보장협정에 포함시키는 것은 투자자나 투자유치국 모두에게 도움이 될 수 있다. 곧 비핵화가 되어 우리 정부가 FTA 체결 등 많은 경험을 바탕으로 북한의 모델 BIT 작성을 도울 날이 오기를 기대해 본다.

영어초록

Since the UN Security Council adopted Resolution 1718 as a sanction against North Korea shortly after North Korea attempted its first nuclear test on August 8, 2006, the international community has continuously adopted and implemented strong economic sanctions against North Korea. The UN sanctions prohibited any foreign investment into North Korea as a form of joint venture and have had a widespread impact on North Korea's economy and industry, As a result, North Korea’s economy is at stake. As part of efforts to overcome economic sanctions, summit between North Korea and the held in Hanoi ended in failure. Although expectations on the foregoing summit has broken down, North Korea is still willing to stop the economic downturn due to economic sanctions. Furthermore, strong desire for economic growth by North Korea will eventually lead them a step toward denuclearization. If the nuclear issue is resolved, it is expected that North Korea will definitely try to negotiate bilateral investment treaties with other countries in order to attract foreign investment for economic reconstruction.
In recent years, there has been a significant change in bilateral investment treaties. In particular, three new features on the current investment treaties can be identified First of all, elements of sustainable development are being introduced. Secondly, protection on the regulatory authority of the host country is highlighted. Thirdly, new provisions are being introduced to minimize the exposure of host countries to the investor-state disputes. In this regard, the new bilateral investment treaties are likely to include so-called 'sustainable investment' elements. Meanwhile, North Korea has signed bilateral investment treaties with 24 countries and among them, 14 investment treaties with China, Czech Republic, Denmark, Egypt, Iran, Macedonia, Malaysia, Romania, Russia, Serbia, Singapore, Slovakia have entered into force. However, North Korea's bilateral investment treaties does not include any elements related to sustainable development at all.
The recent bilateral investment treaties has faced more challenges than ever. In case of India and Central and South American countries, it was not enough to point out the problem of the investor-state dispute settlement procedure. They currently abolished the existing bilateral investment treaties. In this regard, the bilateral investment treaties North Korea intends to conclude in the future should ultimately bring sustainable development to North Korea and its foreign investors respectively. Therefore, it is necessary to explore various ways of introducing sustainable investment factors into the bilateral investment treaties of North Korea. In other words, it is possible to introduce provisions such as ensuring the regulatory authority of the host country to protect the environment and disposing of environment-related government measures from investor-state dispute resolution. In addition, the adoption of the 'Corporate Social Responsibility' provisions is not a mandatory standard under the international law, but it has the characteristic of soft law that encourages companies to make more sustainable investment. This can be helpful to both investors and host countries. I hope that the day will come when the Korean government will be able to contribute to North Korea's model BIT, based on Korea’s previous experiences on FTA & BIT negotiations.
