17~18세기 재산상속의 방식과 출계자의 위치 (A Study on the Property Inheritance System and the Position of Adopted Son during the 17~18th Centuries)

초록

본고에서는 17~18세기에 작성된 분재기를 토대로 생가에서 출계한 아들에게 재산을 상속한 사례를 살펴보았다. 그리고 이를 출계한 아들과 딸의 상속 비율이 같은 유형과 출계한 아들의 상속 비율이 딸보다 높은유형으로 구분하였다.
첫째, 출계한 아들과 딸의 상속 비율이 같은 유형은 친족 내에서 출계한 아들과 출가한 딸의 지위가 같다는 인식에서 출발하였다. 즉, 출계한 아들과 출가한 딸은 친부모의 제사를 봉행할 수 없다는 공통점이 있었기 때문에 상속분을 똑같이 책정하였다.
둘째, 출계한 아들의 상속 비율이 딸보다 높은 유형은 딸보다 아들의 존재를 더욱 중요시하는 인식에서 시작되었다. 즉, 신분의 우위 출계의 여부와 관계없이 아들이라는 성별을 중시하였기 때문에 딸보다 많은 상속분을 책정하였다.
이처럼 출계한 아들에게 재산을 배분한 유형들은 출계하기 전에 이미 부모-자식 간의 관계가 돈독히 형성되었을 뿐 아니라, 친족 내에서 아직 출계한 아들의 위치가 명확히 규정되지 않았던 과도기적 상황이 반영된 것으로 해석된다.

영어초록

This study has analyzed Records of Property Inheritance that were prepared during the 17~18th centuries to investigate the case where the adopted son who would succeed to the family lineage inherited property. In this context, this researcher has largely classified it into two types. One type is the case in which the adopted son from the same clan and biological daughter inherited same portion of property. Another type is the case in which the adopted son inherited a larger portion of property than biological daughter did.
In the first case of the former type, it started from the awareness that there is no difference in position from the adopted son of the same clan and biological daughter. Here, the adopted son and the biological wedded daughter have one thing in common that both were not allowed to hold a rite for biological parents. Accordingly, the portion of property that they would take over was equally earmarked.
In the second case of the latter type, it started from the awareness that the presence of son is more important than the one of daughter. Here, this case put heavier weight on the gender of boy, irrespective of rank and blood type. Accordingly, the portion of property that son would take over was earmarked much more.
Yet, the case where property was bequeathed to adopted son means that the adopted son had already cultivated the acquaintance of the adopted parents, before he was adopted and that the duties of the adopted son were not clearly defined.
