초록

이 글은 민주주의와 소수자의 관계를 탐구하고 있다. 특히 국민국가의 틀 내에서 작동되는 민주주의의 한계를 소수자로서의 국외 이주자를 통해 지적하고 있다. 논자는 이 한계를 검토함으로써 통국가적인 단위에서의 민주주의의 문제를 재구성하고 있다.
먼저 이 글은 한국의 근대국가와 민주주의의 전개 과정을 고찰하고 있다. 이는 서구의 근대화 과정과는 다른 특징을 내포하고 있는 것으로서, 개발독재식 산업화의 성공과 이에 이은 민주화의 정착을 논의한다. 그 후 시민사회의 정착과 확장의 과정을 다룬다. 산업화와 민주화를 동시에 달성한 것으로 평가되는 한국의 민주주의는 시민사회의 확장과 함께 형식적 민주화 이후의 실질적 민주화를 모색하고 있음을 밝힌다.
다음으로는 실질적 민주화 과정에서 대두되고 있는 소수자로서의 국외이주자 문제를 다룬다. 이는 국민국가의 시민권 개념으로는 해결하기 어려운 영역이다. 논자는 재일코리안의 문제를 국민국가의 경계를 넘어선 민주주의의 구성의 핵심으로 파악한다. 논자는 재일코리안의 ‘민족’ 개념을 보편적 ‘시민’ 개념으로 재해석하고, 이들의 정체성 문제 해결을 위해 ‘중첩시민권’ 개념을 제안한다. 이는 근대적 인권과 시민권이 지향했던 이념을 중심으로 재구성한 것이다. 또한 이것은 통국가적인 영역에서의 민주주의 구성의 기반을 확보하는 것을 뜻한다. 논자는 이를 통해 국민국가 이후의 단계에서 요구되는 확장된 민주주의의 모델을 모색하고 있다.

영어초록

This essay explores the relationship between democracy and the minority. It especially calls to attention the shortcomings of democracy in representing overseas immigrants as a minority when operated within the frame of a nation-state. As a result of the investigation of this limit, the author reconstructs the problem of democracy in the unit of transnational state.
Firstly, this essay investigates the modern nation of South Korea and the development process of its democracy, which contains different features than the modernization process of Western Europe. The author first discusses the successful development of dictatorial industrialization and the democracy which followed in South Korea. This democracy has now developed into a process of settlement and expansion of civic society. The democracy of South Korea, which is evaluated as having simultaneously attained both industrialization and democratization, has accomplished formal democratization and is now in the process of practical democratization, which may be accomplished by the expansion of the civic society.
Secondly, this essay examines the issue of immigrants as a social minority that becomes more prominent in the course of a nation’s practical democratization. This issue is too delicate to be dealt with as a matter of citizenship in a single nation-state. By closely examining the situation of the Korean Japanese (Koreans in Japan) as a key example of democracy that transcends the boundaries of any single “nation-state”, the author reconstructs the concept of ‘citizenship’ into a universal ‘civil’ concept and suggests an “overlapping citizenship” (transnational civil rights) in order to solve the issue of their identity. This reconstruction is made possible by a reinterpretation of the ideals at which modern human and civil rights are aimed. This also implies that an “overlapping citizenship” can be used as a base for establishing democracy in the transnational dimension. The author suggests a solution to construct an expanded model of democracy that is necessary in the stage of development beyond the nation-state era.
