朝鮮後期 空名小帖에 대한 연구 (The Study on Gongmyeongsocheop(空名小帖) Late in the Choseon Dynasty)

초록

『承政院日記』나 『捕盜廳謄錄』의 공명첩 위조 기사에 종종 나타나는 ‘小帖’은 공명첩과 함께 발급된 문서일 것이라고 추정되어 왔으나 그 형식이나 발급행정, 기능 등에 대해서는 구체적으로 밝혀진 바가 없었다. 본고에서는 현재까지 발견된 공명소첩의 발급시기와 발급자, 형식, 발급절차 등을 정리·분석함으로써 공명소첩이 어떤 기능을 하는 문서였는지를 규명하고자 한다.
현존 문서와 사료의 기록을 통해 볼 때 공명소첩은 늦어도 18세기 전반부터 20세기 초반까지 발급된 것으로 보인다. 공명소첩의 발급기관은 禮曹, 兵曹, 都監, 賑恤廳, 守禦廳, 摠戎廳, 觀察使, 守令 등 중앙관청 및 군영에서 지방관청에 이르기까지 다양하게 나타난다. 이 중 중앙관청 및 군영 그리고 지방관청 중 유수부의 경우에는 1건의 공명첩에 1건의 공명소첩이 남아있는 반면, 유수부를 제외한 지방관청의 경우에는 대부분 1건의 공명첩에 관찰사와 수령이 발급한 공명소첩 2건씩이 남아있다.
대부분의 공명소첩은 『典律通補』에 규정된 帖式에 의거해 기재되었으나 일부는 帖式과 다르게 작성된 것도 있다. 그러나 帖式이 아닌 문서들도 그 내용을 살펴보면 공명첩과 함께 발급된 것이 분명하고, 始面이나 본문에 小帖이라고 명기된 문서도 있어 이 문서들도 帖式으로 발급된 것과 같은 용도로 쓰인 공명소첩임을 알 수 있다.
중앙관청과 군영, 유수부에서는 吏曹와 兵曹에서 작성한 공명첩이 移送되면 수취자를 비워둔 채 공명소첩을 작성하고 수취자가 정해진 후 그 성명을 기재하여 발급한 것으로 보인다. 지방관청의 경우에는 2단계의 발급절차를 거쳐야 했다. 공명첩이 監營으로 移送되면 관찰사는 수취자를 비워둔 채 공명소첩을 작성하고 각 군현별로 매수를 배정하여 공명첩과 함께 수령에게 전달한다. 수령은 願買人을 찾아 공명첩과 관찰사 공명소첩에 願買人의 성명을 기재하고, 수령의 공명소첩을 작성하여 수취자에게 최종적으로 전달하게 된다.
본문의 내용 중에 나타나는 ‘憑後’나 ‘憑考’와 같은 용어들은 공명소첩이 증빙문서였음을 말해준다. 공명소첩은 공명첩의 판매를 담당한 각 기관에서 함께 발급되는 공명첩이 국가에서 발급한 정식 문서임을 확인해 주고, 공명첩이 가진 문서로서의 한계를 보완해 주는 기능을 하는 것으로 추정된다. 작성과 함께 발급이 되고 문서로서의 효력을 갖게 되는 일반 문서들과 달리 공명첩은 작성 당시에는 임명문서로서의 기능을 가지지 못한다. 공명첩은 판매를 담당한 기관에서 帖價를 받고 공명소첩과 함께 수취자에게 발급된 후에야 비로소 임명문서로서의 기능을 발휘할 수 있게 된다. 따라서 공명소첩은 함께 발급된 공명첩이 정식으로 발급이 완료된 문서임을 증빙하여 임명문서로서 기능할 수 있도록 도와주는 역할을 하였던 것으로 생각된다.

영어초록

Though socheop(小帖), appearing on the articles about fabricating of gongmyeongcheop(空名帖: blank office warrants) in The Daily Records of Sectaries(『承政院日記』) or The Transcribed Records in Capital Police Bureau(『捕盜廳謄錄』), has been assumed to have been issued along with gongmyeongcheop, its functions as well as forms and agencies in charge of issuing it have been rarely verified specifically. In this study, we try to turn out what functions gongmyeongsocheop(空名小帖) had, by analyzing issuing periods, issuing agencies, forms, and issuing procedures, of gongmyeongsocheop which has been found so far.
According to existing documents and historical records, it seems that gongmyeongsocheop had been issued from early in the 18th century through earlier in the 20th century. We can confirm that agencies which had issued gongmyeongsocheop included the central offices, the military headquarters, and the local governments. While the central offices, the military headquarters and the Yusubu(留守府: administrative office of special mayor) issued one piece of gongmyeongsocheop for every piece of gongmyeongcheop, a gwanchalsa(觀察使: provincial inspector) and suryeong(守令: county magistrate) in the local governments respectively issued one gongmyeongsocheop for every piece of gongmyeongcheop.
In the case of issuing gongmyeongsocheop in large quantities at a time, they issued woodblock-printed socheop(小帖) to reduce the efforts of transcription.
Most of gongmyeongsocheops were made out based on forms of cheop(帖: down conveying document) prescribed in Jeonyultongbo(『典律通報』), but some were made out differently.
However, if you examine the contents in the documents which didn't abide by the forms of cheop, you can find that those documents also were ones with the same purpose that the documents with forms of cheop had, for there were documents issued along with gongmyeongcheop or declared to be socheop on the first page or article.
Receiving gongmyeongcheops made by lijo(吏曹) and byeongjo(兵曹), the central offices, the military headquarters, and yusubu(留守府) seems to have made out gongmyeongsocheops with the receiver's section empty and issued them after receiving the money from the one who wanted to purchase them and then entering his name in the empty receiver's section of gongmyeongsocheop.
The local governments had to take two issuing steps. If the gwanchalsa in the gamyeong(監營: provincial governor's office) had received gongmyeongcheop, he make out gongmyeongsocheop with the receiver's section empty and then conveyed it to suryeong with gongmyeongcheop, assigning the number of sheets to each county. Suryeong entered the name of purchaser on both gongmyeongcheop and gongmyeongsocheop issued by gwanchalsa and finally transferred them to the purchaser after making gongmyeongsocheop issued by himself.
The terms appearing in the articles, such as 'binghu'(憑後: to prove afterwards) or 'binggo'(憑考: to prove by examining), suggest that gongmyeongsocheop was the documentary evidence. They needed the documentary evidences like gongmyeongsocheop because of limitation of gongmyeongcheop as a document. Unlike the common documents which could be issued and have the documental validity right after being made, gongmyeongcheop couldn't have the functions as the appointment documents because it was first made not with receivers arranged. Not until agencies selling gongmyeongcheop transferred it to the receivers after getting the price of cheop, did gongmyeongcheop get to have functions as appointment document. That is, you can't conclude whether gongmyeongcheop was just the document with the form of gongmyeongcheop in itself or the document which completed issuing through the formal procedures. It was gongmyeongsocheop that complemented this limitation gongmyeongcheop had. Gongmyeongsocheop played an important role in helping gongmyeongcheop fulfill its function as document for appointment by proving that gongmyeongcheop was the document which completed formally issuing.
