초록

김수환 추기경은 우리 사회를 아름답게 변화시킨 참된 지도자였다. 그는 일반적인 종교인의 지위를 뛰어넘어 거룩한 사목자로서 정의와 사랑을 실천한 탁월한 법사상가의 면모를 보여주었다. 그는 일평생 가난한 이들에 대한 연민, 그들을 위한 우선적인 사랑의 실천이 법의 근본 목적임을 인식하였고 그 사상을 온 몸과 마음으로 실천하였다.
그의 법사상은 크게 세 가지로 요약된다. 첫째, 인간의 존엄성을 존중하는 인권수호사상이다. 법의 역할은 인간을 위해 봉사하는 것이다. 특별히 약자에게 봉사하는 법의 정신은 그리스도의 법철학과 그대로 일치한다. 소위 인간 존엄성의 근거는 하느님 없이는 증명될 수가 없다. 곧, 인권을 보호하기 위한 근거는 인간이 하느님의 모상(Imago Dei)이기 때문이다. 인간의 존엄성이 불가침이라는 선언은 가톨릭교회 교리의 핵심사항이다. 김 추기경은 이것을 특별히 강조하였다.
둘째, 공동선을 목적으로 하는 이성의 질서회복이다. 법질서 확립을 위해 개인의 사익은 공동체를 위해 양보할 필요가 있고 연대성과 보조성의 원리를 기초로 적절한 균형을 이루는 공동선을 목표로 해야 하는 당위는 김 추기경 법사상의 중심이론이다. 특히 그는 악법폐지에 적극적이었으며 입법자인 국회의원과 법집행자인 법조인의 복음화에 큰 관심을 기울였다. 그는 모든 이를 위한 공동선 추구가 법의 근본정신의 구현임을 주장하였다.
셋째, 법의 완성인 인간애의 실천이다. 그리스도의 법이 가톨릭교회의 법의 정신이고 이 법의 정신을 우리 사회에 더없이 적극적으로 드러나게 하였다. 미움과 갈등과 분열의 사회를 치유할 수 있는 처방은 그리스도가 입법한 사랑의 법을 실현하는 것이다. 하느님이 인간을 사랑하듯이 우리들도 서로 사랑해야 함을 윤리와 도덕으로 한정하지 않고 법으로 강제규정지은 위대한 입법자 예수 그리스도의 입법정신을 공동체 안에서 실천해야만 한다.
김 추기경은 사랑이 바탕이 된 준법정신을 실정법에 그치지 않고 사회기초질서의 영역까지 확대시켰다. 인간존엄성에 근거한 인권을 존중하고 공동선을 추구하며 사랑과 자비와 용서를 실천하자는 김 추기경의 법사상은 우리 시대에 참된 희망을 제시하는 법치의 이상이라 평가된다. 구체적으로 그가 추구한 법사상은 ‘지금 여기에서(hic et nunc)’ 실천해야 할 사랑의 질서 확립을 위한 규범이다.

영어초록

Cardinal Stephen Kim, SouHwan was a true leader who contributed substantially to transforming our society to a right direction. His acts revealed that he was a great thinker of law. He practiced justice and love as a holy pastor, beyond his status as a religious official. Throughout his life, he recognized that compassion for the poor and the primary practice of loving them are the fundamental purposes of law. He practiced this belief with his heart and soul. The legal constructs he developed were composed of three principles that are described below.
The first principle supports the idea of protecting human rights and has particular emphasis on human dignity. He understood that the law’s purpose was to serve human mankind. In particular, he believed that the spirit of the law is to serve the dis-empowered because this is consistent with the teachings and philosophy of Jesus Christ. what is called human dignity holds no real meaning without meaningful relationships between humanity and God. In other words, the basis for protecting human rights is sacrosanct because human being is created in God's Image(Imago Dei). The declaration of the inviolability of human dignity is the key doctrine of the Catholic Church. Cardinal Stephen Kim, Souhwan particularly emphasized this point.
The second principle supports the restoration of the order of reason for the purpose of a higher common good. Specifically, to establish law and order, individuals must yield their personal interests in deference to the larger community’s interests. The central theory of Cardinal Stephen Kim, Souhwan’s legal thought is aimed at the common good and maintaining appropriate balance, using the principles of solidarity and assistance. Cardinal Kim was active in the abolition of unjust laws and directed his attention to the evangelization of legislators, law enforcers, judicial officers, and members of the National Assembly. He argued that the pursuit of a common good requires the implementation of the basic spirit of the law.
The third principle involves philanthropy as the ultimate completion of law. Cardinal Stephen Kim, Souhwan was the most influential person in revealing Jesus Christ’s and the Catholic Church’s spirit of the law to Korean Society. This devotion could heal a society that was full of hatred, conflict and division. When members of society practices the legal obligation to love each other just as God loves us, the impact will extend beyond the common laws of ethics and morality.
Cardinal Stephen Kim, Souhwan encouraged the broad acceptance of alaw-abiding spirit in Korean society by fostering a love for the basic order of society that extended beyond the realms of positive law. His legal beliefs held that we should respect human rights based on human dignity, pursue the common good and practice love, mercy and forgiveness.
He proposed that the ideal of the rule of law is the true hope for our times. Specifically, the legal thought that he pursued is fundamental for the establishment of an order of love that we must practice ‘here and now(hic et nunc).’
