초록

주권 개념은 1870‒1880년대부터 『만국공법』, 『공법회통』 등 여러 경로를 통해 서양에서 청･일을 경유하며 조선으로 전래되었다. 이러한 서양 근대 주권 개념이 조선에 전래, 정착되는 과정에서 조선인의 주권 인식은 시기와 계층에 따라 다른 양상이 나타나고 있었다.
일제시기 한반도의 주된 지식인 계층은 재일유학생 출신들이었다. 초기 재일유학생들의 주권 인식이 한반도의 주권 개념 정착에 미친 영향을 간과할 수 없다. 또한 주권 연구에 있어서 재일유학생들의 학회 활동 및 잡지에 관련된 연구는 부족한 형편이므로 본고에서는 『태극학보』, 『대한학회월보』, 『대한유학생회학보』, 『대한흥학보』 등 4종의 잡지를 연구의 대상으로 삼아 1905‒1910년간 재일유학생의 주권 인식을 연구하였는데 다음과 같은 결론을 내리게 되었다.
첫째, 학회지에 게재된 주권 관련 논술 중에 주권이 국가의 구성요소라고 소개한 논술이 많다. 둘째, 주권이 국제법적으로 해석된 논술도 적지 않다. 셋째, 주권과 주권자, 통치권 등 용어를 혼용한 현상이 존재한다. 넷째, 주권의 대내적 해석은 근대 국민주권 개념과 거리가 있어 보인다. 『태극학보』에 의하면 조선에서 주권은 국가 내에서 최고의 권력이며 외부의 간섭을 받지 않는다. 또한 주권의 소재는 군주에게 있고 주권의 행사는 군주에 의해야 함으로 조선의 국체는 군주국이며 정체는 전제국이다.

영어초록

The concept of sovereignty was introduced to the Korean Peninsula from the West via the Qing Dynasty and Japan starting from 1870‒80s, through such channels as W.A.P. Martin’s translations of Wheaton’s “Elements of International Law” (Manguk kongpop) and Bluntschli’s “International Law” (Kongpop hoetong). While the Western concept of sovereignty was being introduced and established on the Korean Peninsula, the Korean people’s understanding of it varied depending on class and time period.
During the reign of the Japanese imperialism on the Korean Peninsula, the main intellectual class came from the number of Korean students who had studied in Japan. Therefore, the first Japanese‒educated Korean students’ understanding of sovereignty has had an influence on the spread of the concept of sovereignty on the Korean Peninsula, which should not be overlooked. When it comes to such studies of sovereignty, there is not enough research available with regard to the academic activities or journals of the Korean students who had studied in Japan. That is why this paper examines the understanding of sovereignty of the Korean students who had studied in Japan from 1905 to 1910, taking the Taegukhakbo, DaehanHakhoi Wolbo, Daehanyuhaksaenghoe Hakbo, and Daehanhunghakbo journals as the objects of research.
The following conclusions are drawn from the analysis. First, among the journal articles that related to the subject of sovereignty, there are many discussions that introduce sovereignty as the constituent element of a state. Second, there are many articles that interpret sovereignty from the perspective of international law. Third, a phenomenon where the terms of “sovereignty”, “sovereign”, and “imperium” are confused may be seen. Fourth, the internal interpretation of sovereignty differs from the modern concept of sovereignty. According to the Taegukhakbo, sovereignty on the Korean Peninsula represents the highest power in the country, which is not subject to external interference; sovereignty lies in the hands of the monarch, and the exercise of sovereignty depends on the monarch; hence, as a system of government it is an absolute monarchy.
