공정거래법상 전속고발제도에 관한 연구 (A Study on the Complaint System under Monopoly Regulation and Fair Trade Act)

초록

전속고발제도는 공정거래법 위반행위에 대해 공정거래위원회가 전문기관으로서 상세한 시장분석 등을 통하여 위반행위의 경중을 판단하고 그 판단에 따라 형벌의 적용 여부를 결정하도록 하기 위하여 도입된 제도이다. 그러나 1981년부터 2009년까지 공정거래위원회가 검찰에 고발조치한 사건은 전체 사건의 1.45%에 불과하고, 공정거래법의 운용이 거의 대부분 행정절차로 처리됨에 따라 사업자나 일반인에게 있어서 공정거래법 위반행위에 대한 죄의식이 매우 희박한 것이 현실이다.
전속고발제도 및 공정거래위원회의 소극적인 고발권 행사로 인하여 공정거래법 위반행위에 대한 효과적인 제재와 예방에 한계가 있고, 전속고발제도에 대한 헌법재판소의 합헌결정 이후에도 위헌성 논란이 계속되고 전속고발제도를 폐지하여야 한다는 주장이 제기되고 있는 바, 전속고발제도는 폐지하는 것이 타당하다고 본다.
전속고발제도의 폐지는 피해자에 의한 고발을 가능하게 함으로써 공정거래법의 효과적인 집행과 그 실효성의 강화 차원에서도 바람직한 방향이라고 본다. 다만 피해자에 의한 고발권 행사의 남용 및 공정거래법 위반사건의 증가 등 전속고발제도의 폐지에 따라 발생할 수 있는 문제점을 해결하기 위하여 형사처벌 대상 행위의 축소ㆍ조정, 검찰의 전문성 강화, 공정거래위원회와의 협조시스템 구축 등의 조치가 함께 이루어져야 할 것이다.

영어초록

The exclusive complaint system by only Fair Trade Commission under Monopoly Regulation and Fair Trade Act was introduced for Fair Trade Commission to judge the seriousness of violations of Monopoly Regulation and Fair Trade Act through detailed market analysis and to decide whether to apply penalties for the violations. But from 1981 to 2009, Events prosecuted to the prosecution by Fair Trade Commission are only 1.45% of total cases, and operation of Monopoly Regulation and Fair Trade Act is treated almost as administrative procedures. Accordingly, a sense of guilt of businessman or the general public for violations of Monopoly Regulation and Fair Trade Act is very small.
Because of the exclusive complaint system by only Fair Trade Commission and the passive exercise of the right to accuse by Fair Trade Commission, it is difficult to take sanctions against violations of Monopoly Regulation and Fair Trade Act and to prevent them effectively. And even after Constitutional Court decided that the exclusive complaint system by only The Fair Trade Commission is constitutional, Constitutional debates on the exclusive charge system have been continued and claims that the exclusive complaint system should be abolished have been raised. Therefore, It is reasonable to abolish the exclusive complaint system.
If the exclusive complaint system is abolished, It is possible that the victim accuses the solicitation businessman directly, and it is possible that Monopoly Regulation and Fair Trade Act is enforced effectively. However, in order to solve the problems caused by the abolition of the complaint system including the abuse of the right to accuse by victims and the increase of violations of Monopoly Regulation and Fair Trade Act, measures should be taken together, such as reduction and coordination of criminal acts, enhance of the prosecutors' professionalism and construction of cooperation system with Fair Trade Commission.
