삶의 마지막 시기 돌봄 의사결정과 노인인권 (A Study of End-of-Life Care Decision-Making and Elderly’s Right)

초록

의과학기술의 발전으로 수명이 연장되었지만, 기대수명에 비해 건강수명이 뒷받침되지 못해 많은 노인들은 생애말기 노쇠 및 다양한 질환의 악화를 경험하면서 독립적인 일상생활을 유지하지 못한다. 이로인해 노인은 상당기간 동안 누군가에게 돌봄을 의탁해야 하는 의존기 삶을 살게 된다. 하지만, 사회구조의 변화, 가족 관계의 변화 등으로 인해 노인은 자신의 삶의 마지막 시기 돌봄을 가족에게 전적으로 의지할 수 없다. 따라서, 많은 노인들은 새로운 돌봄 환경 속에서 신체적, 정신적 악화를 경험하면서 요양원, 요양병원, 그리고 중환자실과 같은 의료기관과 장기요양시설에서 말년을 보내게 된다. 그러나, 돌봄시설에서의 효율적이고 획일화된 돌봄방식은 노인의 존엄성을 해치며, 노인인권 침해 사례들을 야기한다. 이러한 상황에서, 노인의 삶의 마지막 시기 돌봄을 둘러싼 의사결정의 이슈는 노인인권과 관련된 매우 중요하고도 실존적인 주제이다. 노인의 삶의 마지막 시기 돌봄과 돌봄에 관한 의사결정문제는 단지, 질병에 관한 의료적 의사결정 뿐 아니라 주거권, 이동권, 행복추구권, 프라이버시 등 다양한 기본권의 이슈들을 포함한다. 본 논문은 노인인권의 측면에서 노인이 인간으로서 최소한의 존엄을 유지하며 삶의 마지막 시기를 보내기 위해서는 어떠한 돌봄과 돌봄 의사결정이 필요하며, 노인의 자율성에 근거한 돌봄 의사결정과정의 형태는 어떠해야 하는지에 대해 탐색하였다. 본 연구 결과, 노인은 삶의 마지막 시기 신체적, 정서적, 관계적 그리고 경제적 상실을 경험함을 발견했다. 또한 노인의 삶의 마지막 시기 특성에 따라 절대의존기, 말기, 임종기의 단계를 거치면서 다양한 돌봄에 관한 의사결정을 해야 하는 상황에 놓이게 됨을 확인하였다. 또한 노인의 삶의 마지막 시기 돌봄의사결정 의미를 탐색하기 위해, 국내외 취약한 사람에 관한 의사결정지원법과 삶의 마지막 시기 의사결정법에 관한 살펴보면서, 노인의 취약한 의사결정능력을 어떻게 이해해야 하며, 노쇠 및 질병의 악화 등으로 인한 다양한 의사결정능력 상실에 대한 지원을 어떻게 확보할 수 있을지에 관해 확인하였다. 연구 결과 세계 주요 국가들은 노인과 같이 의사결정능력이 취약한 사람들을 위하여 다양한 의사결정지원정책들을 마련하고 있었는데, 의사결정 패러다임은 의사결정대리가 아닌 의사결정지원 형태로 이루어지고 있었다. 따라서 인권의 측면에서 향후 우리나라 노인의 삶의 마지막 시기 돌봄 의사결정의 정책적 방향도 현재의 대리의사결정 중심의 논의에서 의사결정지원에 관한 논의로 바뀌어야 한다. 이를 위해 노인 돌봄 의사결정 지원의 형태인 사전돌봄계획과정의 법제도화를 통해 의존기 노인의 단계별 특성과 돌봄 욕구가 반영된 최선의 의사결정이 이루어 질 수 있도록 해야한다. 이러한 연구 결과는 삶의 마지막 시기 노인의 돌봄 의사결정 관련 법제도 개발과 노인인권을 위한 주요 자료로 활용될 것으로 기대한다.

영어초록

Although the lifespan has been extended due to the advancement of Biomedical science and technology, many elderly people cannot maintain their daily life independently as they experience senility and deterioration of disease because they are not healthy compared to expected lifespan. However, under the new caring environment in modern society, such as sudden changes in social structure and family relations, the elderly cannot fully rely on their family to take care of last period of their life. Many elderly people who experience physical and mental deterioration use facilities such as nursing homes, nursing hospitals, and intensive care units in the hospital, where they spend the last years of their lives. However, efficient and uniform care methods undermine the dignity of the elderly and lead to cases of infringement on the rights of the elderly. In this context, the issue of decision-making surrounding the care of the elderly in their end of life period is a very important and existential theme for the protection of the elderly’s human rights. Decision-making issues related to end-of-life care caring include not only medical decisions but also various basic human rights issues such as housing, mobility, pursuing happiness, and privacy. With this awareness of the problem, this study investigates what kind of caring and caring decision are needed for the elderly to maintain their minimum human dignity and also investigates what kind of caring decision-making process is needed, which is based on the elderly’s autonomy. As a result of the study, it was found that the elderly experienced physical, emotional, relational and economic loss in the last period of their lives. In addition, it was confirmed that the last period of life of the elderly is in a situation in which various caring decisions must be made through the stages of absolute dependence, terminal, and end of life. Considering this situation, in order for the elderly to strengthen their decision-making capacity as the subject of various decision-making related to their end-of-life care, how should they understand their decision-making ability, and various decision-making skills due to aging and worsening of disease. Also the domestic and foreign’s decision-making supporting law was reviewed on how to secure vulnerable people who loss their ability of decision-making. As a result of this study, major countries around the world have prepared various policies to support decision-making for people with weak decision-making ability, such as the elderly. The decision-making paradigm is in the form of supporting decision-making rather than the proxy of decision-making. Therefore, in terms of human rights, the policy of decision-making about the end-of-life care for the elderly in Korea needs to reflect the characteristics of the elderly at end-of-life periods and their needs for care by making legal system of the advance care planning process as a form of decision-making support. The results of this study can provide some ideas for the development of the legal system related to the end-of-life care decision-making for the elderly and elderly’s human right.
