수도회 평의회 입법: 법제사(法制史)적 연구를 통한 입법 기준 마련 (The Legislation of the Councils of Religious Institutes:A Suggestion of Legislative Standards from a Legal and Historical Research)

초록

본고는 크게 두 부분으로 이루어졌다. 하나는 수도회 평의회의 기존 입법의 결실을 살펴보는 것이고, 또 다른 하나는 이 토대 위에 평의회에 대한 더 깊은 이해를 도모하고 적절한 활용 방법을 고민함으로써 새롭고 구체적인 입법을 위해 평의회가 기본적으로 갖춰야 하는 중요한 요소들에 대해 어느 정도의 기준을 제시하는 것이다. 그리고 이런 기준점을 토대로 현재 수도회들이 평의회에 관해 고유법에 어떻게 규정하고 있는지 그 실태를 파악하여 평가하는 것이며, 이를 통해 수도회들의 평의회 운영과 회헌 수정에 도움을 주고자 하였다. 연구의 큰 틀은 다음과 같이 세분화된다.
수도회 전통에서 평의회 제도의 흔적을 살펴보면서 현대적 평의회 이해의 기반 위에서 그것을 분석하였고, 입법의 의미를 밝힘으로써 평의회에 대한 이해를 깊게 하였다. 이어서 평의회를 규정하는 현행법 안에서 법원의 입법 내용과 취지를 아래와 같이 연구하였다.
먼저 1909년 수도회성의 훈령과 1917년 법전의 교회 입법자 입법 취지에 따라서 고유하고 다양한 수도회들이 기본적으로 갖추어야 하는 공통적인 요소로서 제시된 평의회의 특징을 밝혔다. 이것은 이어지는 현행법의 입법 과정 토론에서 논의된 의견에 담긴 논리 전개상 차이를 조명하는 작업에서 더 섬세해졌다. 그리고 제2차 바티칸 공의회와 공의회 이후 문헌에는 평의회와 공동체에 대한 교회론적 전망을 반영하였기 때문에 그것을 살펴보는 과정에서 입법을 위한 확장된 안목을 갖게 되었다.
이러한 연구의 결실들은 연구의 두 번째 부분이 되는 Ⅳ장과 Ⅴ장에서 활용되었다. 곧, 평의회의 ‘구성’, ‘선출 및 자격’, ‘역할’, ‘소집’ 그리고 ‘운영’이라는 전통적 입법에서 이끌어낸 주된 주제들을 교회법 학자들의 다양한 관점들과 접목시켜, 새롭게 평의회에 대한 규정을 제정할 때에, 기준점이 되는 자료들을 제공하였다. 아울러 이 기준들을 토대로 기존 수도회들의 고유법의 실태를 파악하여 평가하고 긍정적인 면과 더불어 보완할 점도 확인하였다. 결론적으로 본고에서는 평의회에 대한 기존 입법을 연구하였고 이를 바탕으로 새로운 입법을 위한 기준을 제공하였다.

영어초록

This paper consists of two parts. The first part is to examine the fruits of existing legislation on the Council of the religious institutes. The second part is to present some criteria for the important elements of the Council. So the council should have a deeper understanding about its proper utilization, and develop new and concrete legislation for its foundation. In addition, based on the criteria, it has to grasp and evaluate the actual condition of how the religious institutes are applying the regulations of the Council to their inherent laws. And through this paper, I intended to help the religious institutes to operate their Council and revise their Constitutions. The framework of this study is subdivided as follows.
Firstly, I analyzed it on the basis of the understanding of the modern Council to elucidate the meaning of legislation, and to deepen understanding of the Council, while examining the traces of the Council system in the religious tradition.
Subsequently, I studied the contents and purpose of the legislation of the source of current law, which defines the Council as follows; According to the suggestion by the legislator in the ‘Congregation for institutes of Consecrated Life and Societies of Apostolic life’(S.C. de Religiosis) in 1909 and ‘Code of Canon Law’ (the CIC ’17) in 1917, I have revealed the characteristics of a Council which is presented as a common element, which unique and that all religious institutes should be equipped with. This has become more delicate in the work of illuminating the differences in logic development contained in the opinions discussed in debates on the current legislation process. And since the document of the Second Vatican Council and its post-Council reflected the ecclesiastical perspectives on the Council and community, I could make an opportunity to have an expanded perspective on the legislation in the process of studying.
The fruits of this study were utilized in the Chapters Ⅳ and Ⅴ, which are the second part of this paper. This paper combines the main themes drawn from the traditional legislation of the Council such as ‘composition’, ‘election’ and qualifications’, ‘role’, ‘convocation’, and ‘operation’ with the various views of the scholars of Canon law. And when establishing new rules for the Council, it provided data that could be used as the standard. And based on these criteria, I identified and evaluated the actual condition of the inherent laws of religious institutes and checked the positive aspects of them as well as what needs to be supplemented.
In conclusion, I studied the existing legislation on the Council and provided the standard for the new legislation.
