초록

일제는 1911년 사찰령을 발표하여 한국 불교를 관리·장악하였다. 지금까지 사찰령 이전 일제의 불교 정책이나 을사늑약 이후 대한제국의 불교 정책에 대해서도 알려진 것이 많지 않았다. 통감부 설치 이후 한국 내 권력을 장악한 일제는 1908년 내부 지방국에 사사과(社寺課)를 신설해 사찰과 제사·종교 관련 업무를 담당하게 하였다. 친일적 인사가 주도하는 사사과는 사찰 안팎에서 벌어지는 분쟁을 처리하거나 사찰 재산에 대한 업무를 주로 담당했다.
1908년 말에는 사찰 재산 관리를 법령화하는 단계로 전환된다. <사찰재산관리규정>을 통해 사찰에 속한 재산을 등록하고 관리하려 한 것이다. 그러나 관리대상, 관리주체 등의 선정 문제로 인해 법령 제정은 1910년 8월 이전에 마무리되지 못하였고, 1911년 6월이 되어서야 <사찰령>이라는 명칭으로 발표되었다. 즉 사찰령은 일제가 강점 이전부터 한국 사찰에 대한 관리와 통제를 위해 준비한 법령임을 확인할 수 있다.
일제가 사찰 관리 부서를 설치하고 사찰 관리 법령을 제정하고자 한 이유는 사찰 재산이 항일운동 자금으로 활용되는 것을 차단하기 위해서였다. 당시 지역 유지나 관리들이 사찰 토지를 학교 설립과 운영에 사용하는 일이 많았으며, 산악에서 활동하는 의병들이 사찰을 근거지로 이용하는 경우도 많았다. 즉 통감부부터 시작된 일제의 사찰 관리는 항일운동의 차단과 밀접한 관련을 가진다. 또한 사찰재산관리규정이 사찰령으로 확정되는 과정을 통해 일제가 사찰 재산에 대한 통제를 넘어 인사권을 포함한 완전한 장악으로 전환된 것을 확인할 수 있다.

영어초록

The Japanese colonial government announced Sachalryeong in 1911 and managed and dominated the Korean Buddhism. Until now, it was not often known about Japan's Buddhist policy before Sachalryeong and the Buddhist policy of the Korean empire after the 1905 Convention(Eulsa agreement). After the installation of the Residency-General, Japan seized power in Korea and established a new organization(shrines and temple section, Sasagwa) in the internal local bureau in 1908. And through this, they were in charge of the work related to the temple. The shrines and temples section was led by the management of pro-Japanese tendencies. Main duties of the shrines and temples section were dealing with disputes inside and outside the temple and dealing with temple property.
At the end of 1908, the Japanese Empire began enacting laws on the management of temple property. This is an attempt to register and manage property belonging to a temple using the ‘Regulations for Management of Temple Property’. However, the enactment of the law was not completed before August 1910 due to the selection of management targets and management entities. It was announced in June 1911 after the annexation of Korea and Japan under the name ‘Sachalryeong’. In other words, Sachalryeong can confirm that it is a decree prepared by Japan for the management and control of Korean temples before the annexation of Japan and South Korea.
The Japanese government tried to establish a temple management department and enact the temple management law to block the use of temple property as funds for the anti-Japanese movement. At that time, local influentials and officials often used the temple land to establish and operate modern schools. In addition, the righteous army active in the mountains often used the temple as a base. In other words, the management of Japanese temples, which began during the Residency-General era, is closely related to the blocking of the anti-Japanese movement. It can also be confirmed that the Japanese Empire has been transformed into full control, including personnel rights, beyond the control of temple property through the process by which the temple property management rules were finalized in Sachalryeong.
