조선 전기 비공식적 제도의 변화와 류성룡의 리더십 (Transitions of The Informal Institutions in The Early Joseon Dynasty and Leadership of Ryu Seong-ryong)

초록

조선 전기 비공식적 제도가 변화하는 과정을 제도주의 관점에서 분석하였다. 조선은 개국 이래 국가 주도하에 체계적으로 유교화를 추진하여 공식적인법 제도뿐만 아니라 비공식적 제도에서도 16세기경에는 과거와 다른 유교 국가로 변모했다. 유교화한 조선의 비공식적 제도와 사회문화는 긍정적인 측면도있지만 폐쇄적이고 착취적인 성격이 강화되었는데 이는 양반 지배계층이 자신들의 기득권, 특권을 유지 강화하기 위하여 오랜 세월에 걸쳐 집단적으로 집요하게 노력한 결과였다.
임진왜란의 국가 존망의 위기에서 서애 류성룡은 혁신적인 정책을 시행하였는데, 폐쇄적이고 착취적인 성향이 강화되던 조선의 제도와 사회문화에서 지금까지의 기조와는 다른 개방적인 성격의 정책이었다. 그것은 류성룡 본인의 투철한 국가관, 나라와 백성을 구원하겠다는 열망이 그의 개방적인 성향과 열린 리더십이 결부되어 포용적 성격의 정책으로 구현된 것이었다.
그런데 전란이 끝나고 류성룡이 조정에서 물러나자마자 기득권층의 반발로이러한 정책 기조가 대거 바뀌게 되어 오히려 폐쇄적인 성향이 더 강화되고 말았는데 조선으로서는 정말로 아쉬운 상황이었다.
한국이 지속적인 발전을 도모하려면 아직도 남아있는 폐쇄적이고 착취적인제도를 개선하는 것이 중요하다. 류성룡의 국가관, 의식과 역량을 교훈 삼아 현대의 지도층 엘리트가 개방적이고 포용적인 가치관, 규범을 정립해 사회를 개혁해 나가는 것이 중요하다고 할 수 있다.
최근 크게 발전하고 있는 제도주의 이론은 조선 전기 비공식적 제도의 성격을 분석하고 류성룡의 리더십을 재해석하는 데도 유용한 분석 틀이라는 것을 시사한다.

영어초록

This paper analyzes the transition process of the informal institutions in the early Joseon dynasty, from the perspective of Institutionalism. Since its establishment, Joseon dynasty pushed the whole society toward the confucian transformation under the government initiative not only in the formal instituions (legal system) but also in the informal institutions (social norms, culture). By the 16th century, Joseon had become a confucian country far different from the past.
Although the informal institutions and social culture of Joseon after the confucian transformation had some positive aspects, mostly it turned into a very closed and extractive nature, due to the persistent and collective efforts over the long time period of the ruling class Yangban to protect and strengthen their vested interests and privileges.
During the national crisis incurred by the Imjin War, Ryu Seong-ryong adopted very reformative policies of open and integrated nature, quite different from those of the early Joseon when closed and extrative tendencies were intensified.
This was possible due to his patriotism and his eagerness to save the nation and the people, combined with his open-minded leadership.
However, when Ryu stepped down from the government after the war was over, most of such inclusive policies were abolished, and closed and extractive tendency of the society was intensified again, due to strong repulsion of the ruling class. It is regrettable that Joseon could not keep Ryu’s open and integrative policies.
Ryu’s patriotism and integrative leadership provides an important lesson to modern Korea, where some of the closed and extractive aspects still remain. Ruling elite group of Korea, to ensure continued development of the country, should try to improve the informal institutions of our country toward more open and inclusive ones.
The Institutionalism that is getting more attention in the academia implies that it can be a useful tool for analyzing main characteristics of the informal institutions of early Joseon and also re-interpreting Ryu’s leadership.
