초록

범죄피해자의 인권보호에 대한 대책은 형사절차에서 피해자가 국가기관, 범죄자, 언론 등으로부터 피해를 입는 것을 방지하고, 범죄피해의 직접적인 당사자로서 혹시나 발생할 다른 범죄자의 공격 등을 회피하고 범죄피해자가 직접 자신의 입장을 말할 수 있는 법적 지위를 마련하여 지금까지 침해된 피해를 형사절차를 통하여 신속히 회복시키는 것이다. 이 연구에서는 형사절차에서 피해자의 다시 발생할지 모르는 재해 방지와 범죄피해자의 인권 보호제도의 고찰과 개선방안을 연구할 것이다.
범죄피해자의 의식구조에 대한 연구나 현재 일반인의 인식들이 중요하여 본 논문은 세계 주요 국가의 법적 측면의 인권 보호제도를 비교하는 것에 중점을 두고 연구할 것이다. 하지만 이와 같은 범죄피해자보호의 인권보호를 개선하기 위해서는 국가와 시민단체와 국민들도 함께 동참 할 때 그 완성도를 높일 수 있을 것이다.
본 연구는 범죄피해자의 개념과 내용을 위하여 범죄피해자의 인권보호에 관한 논문을 많이 참조하였다. 범죄피해자의 인권에 관한 분야는 피해자의 인격과 피해에 대한 보호 및 피해자의 법적인 지위를 고찰하는 것을 그 중심내용으로 한다. 범죄피해자의 인권보호에 관하여 발전방향을 찾아보기 위해서는 세계 각국의 인권 제도를 비교분석하는 것도 하나의 방법이므로 비교법적 방법을 선택하였으며, 우리나라의 제도도 탐구하기 위해 법해석학적 분석을 하였다.

영어초록

The aim of this thesis is to study protections of civil’s right of criminal victims. That is, it is to study concrete system and procedure to secure and realize civil’s right of criminal victims approaching the practical problem. The function of basic protections for criminal victims hasn't worked yet. Crime Victims Protection Act obliges yet government to support and protect crime victims. There are various kinds of support programs, such as counseling, medical treatment, employment. To provide the substantial support for victims, organizations must keep in contact with each other and carry out the policy. This study conducted a research on the support policies for crime victims of governments and his limit. Helping activities for crime victims of Korea were started by the police and still led by them. But the helping activities of the police are supposed to the intervention right after when the occurrence of the crime, and the long term support for victims is yet deficient.
Way of protection of human right would be realized as soon as possible by the active victim’s protection of government and the policy. However in protecting the victim’s right, the equality with the accused must be appointed and it serves the aim of the equal right and human’s dignity.
The first goal of a criminal process is to ensure the perpetrator is given with a punishment that suits his/her crime and the fast and make recovery of the victims from the damages done by the crime. Therefore it needs to give the victims an appropriate status and right as a party in the criminal process to allow them very participate in the process, which will also help them provide the details of the damages and the stand point of them as victims during a criminal process. Also, it is absolutely necessary to allow them to participate in the trial process, which is the final phase of a criminal process. The victims in Korea can participate in the criminal trials by the introduction of a system that will allow them to participate, the reinforcement of the right to make statements for the victims, which is one of the basic rights in out constitution, and provision of the documented right to get help from a legal counsel.
