을미사변 이후 명성황후시해 배상과 일본인 사망자 보상을 둘러싼 한국과 일본의 대립과 그 결과 (Indemnification for the assassination of Empress Myeongseong and compensation for Japanese deaths after the Eulmi Incident(1895))

초록

명성황후시해사건 이후 을미의병이 봉기했는데 그 과정에서 한국에 거주한 일본인이 사망하고 부상을 당했다. 당시 일본인 사망자는 총 62명으로 사망자가 43명 및 부상자가 19명이었는데, 그 중 민간인 피해자는 총 43명으로 사망자가 29명 및 부상자가 14명이었다.
아관파천 이후 일본정부는 일본인 사망자 사건을 한일 양국의 현안으로 부각시켰는데 일본인 사망자 보상의 해결 과정에서 평화적 반복, 무력적 항의, 전쟁의 수행 등의 단계별 외교적 대응 방식과 특징을 보여주었다. 하지만 한국정부는 을미사변 및 을미의병과 연결된 일본인 사망자 사건의 보상에 반발했고 한국정부는 일본인 사망자 사건을 명성황후시해사건까지 연결시켰다. 그러자 일본정부는 일시적으로 일본인 사망자 사건에 소극적인 입장을 보였고 ‘손해배상’ 문제를 제기하는 수준에 머물렀다. 하지만 일본정부는 본국에서 유족의 탄원, 의회의 질의 등에 직면하면서 일본인 사망자 사건의 처리를 지연시킬 수가 없었다. 그 결과 일본정부는 신체와 재산 ‘손해배상’을 구별하여 치밀하게 조사하여 단계적으로 한국을 압박했다. 일본은 한국정부가 ‘손해배상’ 자금이 부족하자 담보를 통해서 자금을 제공하는 방안을 제안할 정도로 치밀했다.
한편 한국정부는 명성황후시해사건 배상 및 일본군대의 조선인 민간인 학살 조사로 대응했다. 주한 일본공사 가토에 따르면 한국정부는 일본인 사망자 ‘배상’을 명성황후시해사건의 배상과 연결시켜 대응했는데 을미사변 이후 일본수비대가 조선인을 학살한 자료까지 조사했다. 하야시에 따르면 한국정부는 일본인 사망자 ‘배상’을 을미사변과 연결하여 대응했다. 특히 주한 서구인 중 일부는 “일본이 일본인 피해에 관한 속죄를 요구하면 한국도 왕비시해사건의 손해배상을 요청하는 것이 타당하다”고 판단했다. 한국정부는 을미사변과 일본인 사망자 사건을 연결시키려고 노력했는데 이것은 한국정부가 ‘명성황후시해사건’과 을미사변 이후 조선인 피해자에 대한 배상을 일본정부에게 요구했다는 사실을 의미한다.

After the assassination of Empress Myeongseong, the volunteer military revolted, and in the process, Japanese residents in Korea were killed and injured. At that time, a total of 62 Japanese people were killed, 43 of which were killed and 19 injured, among which 43 were civilian victims, with 29 killed and 14 injured.
After Agwanpacheon, the Japanese government highlighted the Japanese death case as an pending issue between Korea and Japan, and in the process of resolving compensation for the Japanese death, it showed diplomatic response methods and characteristics at each stage, such as peaceful repetition, armed protest, and war. However, the government of the Korean Empire objected to compensation for the Japanese deaths related to the Eulmi Incident and the volunteer military, and the Korean Empire government linked the Japanese deaths to the murder of Empress Myeongseong. Then, the Japanese government temporarily took a passive stance on the Japanese death case and stayed at the level of raising the issue of ‘compensation for damages’. However, the Japanese government could not delay the handling of the Japanese death case while facing petitions from the bereaved family and inquiries from the parliament. As a result, the Japanese government differentiated between body and property ‘compensation for damages’ and meticulously investigated it, and pressured the Korean Empire step by step. Japan was meticulous enough to propose a plan to provide funds through collateral when the government of the Korean Empire ran out of funds for ‘compensation for damages’.
The Korean government responded by paying compensation for the assassination of Empress Myeongseong and investigating the massacre of Korean civilians by the Japanese army. The Korean government tried to link the Eulmi Incident with the Japanese deaths, which means that the Korean government demanded compensation for the Korean victims from the Japanese government after the 'Empress Myeongseong Assassination Incident' and the Eulmi Incident.
As a result King Gojong did not receive compensation for the murder of Empress Myeongseong, but instead carried out compensation for the Japanese who died. During the Russo-Japanese War, Korea was unable to maintain its national pride due to the presence of Japanese troops and succumbed to the pressure of the Japanese ambassador to Korea.
