경찰국의 법적 문제에 관한 소고 (A Study on the legal matter of the police department in Ministry of Public Administration and Security)

초록

행정안전부장관 소속으로 설치된 경찰국에 관하여 많은 논란과 갈등이 발생했는데, 논란의 주된 쟁점으로 드러난 경찰국의 합헌성과 합법성 여부를 국민주권의 원칙, 법치행정의 원칙 및 정부조직법정주의 측면에서 살펴보았다. 대한민국의 모든 행정권은 국민이 위임한 주권의 일부이기 때문에 그 정당성은 국민주권의 원리와 헌법에 기초하고 있으며, 현행 「헌법」이 행정권의 주체를 대통령으로 규정하기 때문에 모든 행정권은 대통령에게 귀속된다. 경찰권 역시 행정권의 일부로서 대통령 에게 귀속되기 때문에 그 정당성은 국민주권의 원리에서 탄생한 대통령의 행정권에 기초한다. 그리고 「헌법」에 따르면 대통령의 행정권은 국무회의의 심의를 거치 거나 또는 심의 없이 대통령의 명에 따라 국무총리와 국무위원인 행정각부의 장이 집행해야 한다. 경찰권 역시 대통령 행정권의 일부이기 때문에 대통령과 국무총리· 행정안전부장관이 통상의 경우에는 경찰청장과 그 소속 공무원의 권한 행사에 대하여 지휘 · 감독할 수 있고, 특별한 경우에는 경찰청장과 그 소속 공무원에게 권한을 행사하도록 명령하거나 법령이 허용하는 범위 내에서 권한을 직접 행사할 수 있다. 따라서 이러한 대통령 · 국무총리와 행정안전부장관의 권한을 보조하기 위해 행정기관을 설치하는 조치는 합헌이고, 행정안전부장관 소속 경찰국은 합헌적 보조기 관이다.
한편, 경찰국이 경찰의 독립을 침해한다고 주장하면서 경찰청 설치를 경찰의 독립의 근거로 제시하는 견해가 있는데, 경찰의 독립이란 헌법상 존재하지 않는 개념 으로 정치 구호에 해당하며, 경찰청은 행정의 독자성을 고려해 설치된 외청으로 현행 18개 외청 중 하나에 불과할 뿐 나머지 17개 외청과 다른 헌법원리로 구성된 독립 외청이 아니다. 경찰의 정치적 중립성 강화라는 측면에서 논란이 있지만, 경찰 국이 경찰청장과 대통령실 사이에 이루어진 경찰대 중심 밀실 경찰인사를 경찰청 장과 행정안전부장관의 협의 및 대통령의 최종 결제를 통해서 경찰대 · 간부후보생· 공채 순경 출신 등 모든 경찰공무원에게 보직과 승진 기회를 균등하게 배분하는 투명한 경찰인사로 전환하는 가교 구실을 할 수 있으므로 경찰의 정치적 중립성을 강화하는 제도로 평가된다.
법치행정의 원칙이 적용되는 경찰권의 범위는 기본적으로 「경찰관직무집행법」 등에서 규정된 개별수권 조항에 따른 대국민 경찰 집행 작용이고, 국민의 생명ㆍ신체 및 재산의 보호를 목적으로 경찰권이 행사되어야 한다는 소극적 한계가 존재한다. 이러한 경찰권의 집행에 수반되는 경찰조직의 구성권, 경찰예산의 편성권, 경찰 공무원의 인사권, 경찰정책의 수립권 및 경찰집행의 지휘 · 감독권 등은 여전히 「헌법」에서 규정된 바와 같이 행정권의 수반인 대통령과 국무총리 · 행정안전부장관에게 귀속된다.
정부조직법정주의에 따라 제정된 「정부조직법」은 행정권을 행정각부에 배분하고 있지만, 규율의 밀도 측면에서 대통령이 법률의 개정 없이 행정각부의 수와 종류및 그 직무 범위의 대강을 변경할 수 없다는 의미에 불과하므로 행정기관 설치의 합법성 여부는 「정부조직법」만을 기준으로 판단할 수 없다. 경찰국 설치의 합법성 여부는 「정부조직법」뿐만 아니라 「헌법」 · 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」 · 「경찰관직무집행법」 · 「경찰공무원법」 및 행정법 일반 이론 등을 종합 적으로 고려해서 판단해야 하고, 「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」 등이 치안사무와 관련해 행정안전부장관에게 부여한 권한을 행정안전부장관이 합법적 · 합리적으로 행사할 수 있도록 보조하는 행정기관을 행정안전부장관의 공식 직제로 설치한 조치는 적법하다.

There were many controversies and conflicts regarding the police department established under the Minister of Public Administration and Security, and the constitutionality and legitimacy of the police department, which emerged as the main issue of the controversy, was examined in terms of the principle of popular sovereignty, principles of the administration of the rule of law, and Administrative organization legalism. Since all administrative rights of the Republic of Korea are part of the sovereignty delegated by the people, its legitimacy is based on the principle of popular sovereignty and constitution, and all executive rights belong to the president because the current constitution defines the subject of executive power as the president.
Since the police authority is included as part of the executive authority and belongs to the president according to the constitution, its legitimacy is based on the executive authority of the president born from the principle of popular sovereignty. And according to the Constitution, the executive powers of the President shall be executed by the Prime Minister and the heads of administrative departments who are members of the State Council under the order of the President with or without deliberation by the State Council. Since police authority is also part of the executive authority of the President, the President, the Prime Minister and the Minister of Public Administration and Security can direct and supervise the exercise of authority by the Commissioner General and public officials under his control in ordinary cases, and in an emergency, delegate authority to the police chief and public officials under his jurisdiction. Therefore, since the establishment of an administrative agency to assist the authority of the President, Prime Minister, and the Minister of Public Administration and Security is constitutional, the police department under the Minister of Public Administration and Security is a constitutional.
On the other hand, there is a view that the establishment of the National Police Agency is presented as a basis for the independence of the police, arguing that the police department violates the independence of the police.
Police independence is a concept that does not exist under the Constitution and is a political slogan. The National Police Agency is an external office established in consideration of the uniqueness of the administration and is only one of the current 18 external offices, not an independent external office composed of the remaining 17 offices and other constitutional principles.
Although there is controversy in terms of strengthening the political neutrality of the police, The police department in Ministry of Public Administration and Security, through consultations between the National Police Agency Commissioner and the Minister of Public Administration and Security, and the final settlement of the President of the police personnel in the police department centered on the police force between the National Police Agency Commissioner and the President's Office It is evaluated as a system that strengthens the political neutrality of the police because it can serve as a bridge to convert into transparent police personnel.
The scope of police power to which the principle of the rule of law is applied is basically a police enforcement action for the public prescribed in the Police Officer's Duty Execution Act, and there is a passive limitation that police power should be exercised for the purpose of protecting the lives, bodies and property of the people. The right to form a police organization, the right to organize a police budget, the right to personnel of police officials, the right to establish police policies, and the right to command and supervise police execution still belong to the president, the prime minister, and the Minister of Public Administration and Security, as stipulated in the Constitution.
The Government Organization Act, enacted in accordance with the Government Organization Legalism, allocates administrative power to the Executive Branch, In terms of the density of discipline, it simply means that the President cannot change the number and types of administrative departments and the scope of their duties without amending the law.
Therefore, the legitimacy of the establishment of administrative agencies cannot be judged based only on 「Government Organization Act」. Therefore, whether or not the establishment of a police department is legal should be judged by comprehensively considering not only the 「Government Organiza-tion Act」, but also the 「Constitution」, 「Police Agency Act」, 「Police Officers Duties Act」, 「Police Officials Act」, and general theories of administrative law, It is legal to establish an administrative agency that assists the Minister of Public Administration and Security to legally and rationally exercise the authority granted to the Minister of Public Administration and Security in relation to public order affairs by the 「Provincial Police Agency Act」.
