국제항공법상 대세적 의무에 대한 고찰 -국제항공법상 다자간 조약 및 실무의 태도를 중심으로- (Obligations erga omnes in International Aviation Law)

초록

기존 전통 국제법에서의 국제법상 의무는 양자적 또는 상호적 의무에 머물렀다. 그러나 현대 국제법에서는 대세적 의무가 출현하였고 이는 현대 국제법상 의무는 대세적 또는 통합적 의무로 발전하고 있다. 특히 국제항공 분야에 있어서는 안전 의무의 중요성 아무리 강조해도 지나치지 않을 정도로 보편적인 항공 안전 의무 규범이 확립되어 있는 경우에만 국제항공운송 자체가 성립할 수 있다. 시카고 협약 체결시에는 대세적 의무에 대한 개념이 출현하기 전이며 이에 대한 개념 정립이 없었다. 그리고 항공기 내에서 범죄 및 기타 행위에 관한 동경협약, 항공시 불법납치 억제를 위한 헤이그협약, 민간항공의 안전에 대한 억제를 위한 몬트리올 협약 및 국제민간항공에 관련된 불법행위 억제에 관한 협약 및 항공기 불법납치 억제를 위한 헤이그 협약 보충의정서에서 대세적 의무의 양태를 찾을 수 있다. 아울러 ICAO 총회에서도 이미 대세적 의무의 양태는 발견된다. 따라서 국제항공법상 항공안전의무의 측면에서 대세적 의무 개념은 적어도 간접적으로라도 확고한게 반영되어 있음을 알 수 있다.

영어초록

Under traditional international law, all obligations were considered bilateral, reciprocal or synallagmatic. However, under modern international law, the concept of obligations erga omnes has emerged. The obligations erga omnes has been at the door of modern international law for many years. A disregard for obligations erga omnes would result in a serious tear in the web of international obligations, and the current state of modern international law requires that violations of this concept be followed through to their logical and legal conclusions. Modern international law is expanding beyond its traditional scope of bilateralism, and community interest is developing. One key area of keen community interest is that of the international aviation field, and as such, the establishment of universal aviation safety rules and standards are essential. Such universal aviation safety rules and standards accepted by all States is necessary in order to ensure safe air travel around the world. The Chicago Convention on International Civil Aviation (“Chicago Convention”) was drafted in 1944, and the concept of obligations erga omnes is not formally mentioned. However, examples and aspects of erga omnes are apparent throughout. Furthermore, many multilateral treaties under international aviation law, such as the Tokyo Convention on Offences and Certain Other Acts Committed on Board Aircraft, Hague Convention for the Suppression of Unlawful Seizure of Aircraft, Montreal Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, and Convention on the Suppression of Unlawful Acts Relating to International Civil Aviation serve as examples that international aviation law has already begun adopting obligations erga omnes. Even the ICAO has shown its support for obligations erga omnes with its declaratory resolution and interpretative resolution, both of which have universal effect in the field of international aviation law. As such it could be argued that obligations erga omnes has already been firmly established in international aviation law.
