사우스캐롤라이나 사면법의 시행 배경 (The Background of General Clemency Act, 1784 in South Carolina)

초록

본 연구의 목적은 사우스캐롤라이나 충성파들이 영국이나 영국 식민지로 이주하지 않고 사우스캐롤라이나로 남기로 결정하게 된 요인에 대해서 살펴보는 것이다. 사우스캐롤라이나 충성파들이 사우스캐롤라이나를 떠나지 않게 된 중요한 요인 중에 1782년 제정된 몰수법과 추방법(The Bill of for disposing of Certain Estates and Banishing Certain Person)의 내용을 면밀히 살펴볼 필요가 있다. 또한 충성파에 대한 보복적인 폭력을 제한하고 사회질서, 번영 그리고 평화를 위해 화해를 주장하며 사면법(General Clemency Act)을 제정한 배경과 그 결과를 논의하는 것이다.
사우스캐롤라이나 로우컨트리 상류층은 1730년대부터 사우스캐롤라이나 사회를 장악해왔다. 이들 로우컨트리 상류층들은 사우스캐롤라이나 식민지 의회(The Assembly)를 장악하며 입법활동을 통해 사우스캐롤라이나 식민지를 운영해왔다.
혁명 시기에 같은 애국파의 편에 서서 혁명을 도왔던 일부 수공업 장인과 기술공 그리고 백컨트리의 사람들에게도 혁명 이후 의회의 자리를 일부 내어주기는 했지만 사우스캐롤라이나 의회의 대다수의 의원은 로우컨트리 상류층 출신이었다. 이들은 식민지 시절에 사우스캐롤라이나 식민지 의회를 장악한 것과 동일한 방식으로 사우스캐롤라이나 의회를 장악했으며 입법활동을 통해 사우스캐롤라이나 경제를 공고히 하고 노예의 반란과 같은 위험요소들을 제거하기 위해 노력하였다.
로우컨트리 애국파들은 자신과 경제적이고 사회적인 이해관계를 공유하고 있는 로우컨트리 출신 충성파들의 재산을 보호하기 위해 노력했다. 혁명 이후 몰수법, 추방법 그리고 사면법 시행과 같은 일련의 과정을 진행하면서 로우컨트리 상류층 애국파들은 친척이자 같은 이해관계를 공유하고 있는 로우컨트리 출신 충성파의 재산을 보호하기 위해 정치적 노선을 넘나들며 지속적으로 협력했다. 사면법 시행과정에서 사우스캐롤라이나 의회가 청원과 재판의 과정을 빠르게 진행했던 이유도 로우컨트리 출신의 충성파가 사우스캐롤라이나 시민이 될 수 있음을 확인시켜 주는 과정임과 동시에 그들의 재산을 지켜주기 위함이었다. 로우컨트리 출신 애국파에게 충성파의 재산몰수는 충성파 개인의 재산 몰수가 아닌 가문의 재산 몰수였고 로우컨트리 상류층의 지배력을 약화하는 것이라고 파악했던 것이다. 그 결과 전쟁 이후 로우컨트리 출신 애국파들은 자신이 속한 로우컨트리 상류층의 사우스캐롤라이나에 대한 지배력을 공고히 하기 위해 다른 주보다도 느슨한 몰수법과 추방법을 적용했고 너그러운 관용정책을 펼치게 되었던 것이다.

영어초록

For the loyalist research was focused on in New York and Southern Carolina, where the war of independence was fiercely unfolded. Many of the loyalist in New York moved to Britain or other British colonies, while most of the South Carolina loyalists remained in South Carolina.
The purpose of this study is to examine the factors that led South Carolina loyalists to decide to remain in South Carolina instead of moving to Britain or Britain’s colonies. It is necessary to take a closer look at some of the important factors that kept South Carolina loyalists from leaving South Carolina. This essay also discuss the background and consequences of the General Clemency Act, limiting retaliatory violence against the loyalists and arguing for reconciliation for social order, prosperity and peace.
South Carolina Low Country elite has dominated South Carolina since the 1730s. White people who settled in South Carolina had to fight diseases, Indians, and slaves. Faced with these problems, wealthy South Carolinas began to consolidate their communities to manage slaves and property and maintain social stability. In particular, as a way to overcome political, social, military, religious and demographic instability, South Carolina lowcountry elite began to develop strategies to unite and bond between families. Through joint parenting, sophisticated guardianship, farm management, and family marriage, a strong kinship network was formed, and economic activities also acted within the framework of community norms.
And also These Lowcountry elite dominated the Assembly, and controlled the South Carolina colony through legislative activities. Although some the artisans, the mechanics and the backcountry people, who stood on the same patriotic side during the revolution, also gave up a few of seats of Congress after the revolution, the majority of the members of the South Carolina Congress were from the lowcountry elites. They took control of the South Carolina Congress the same way they took control of the South Carolina colonial council during the colonial period, and through legislation, they tried to consolidate South Carolina’s economy and eliminate risks such as slave rebellion.
The lowcountry patriots tried to protect the property of lowcountry loyalists who shared economic and social interests with them. In a series of processes since the revolution, such as the Confiscation Act, the Deportation Act, and the Tolerance Act, the Patriots of lowcountry elite have continued to cooperate across political lines to protect the property of loyalists from lowcountry, who are relatives and share the same interests.
The reason why the South Carolina Congress quickly proceeded with petitions and trials in the process of implementing the Tolerance Act was to confirm that loyalists from lowcountry could be South Carolina citizens and to protect their property.
For patriots from lowcountry, the confiscation of the property of loyalty was not a confiscation of the property of a loyal individual but a confiscation of the family’s property and weakened the control of the upper class of lowcountry. As a result, after the war, patriots from lowcountry applied looser confiscation and deportation laws than other states to consolidate their control of the lowcountry elites over South Carolina.
