북한 아동복지 관련법 분석 (Analysis of the laws on Child Welfare in North Korea)

초록

1989년 체결된 국제아동권리협약은 아동의 권리문제에 대해 체계적이고 종합적인 권리규범을 제정함으로써 18세 미만의 모든 아동을 보호의 대상으로
함과 동시에 적극적인 권리의 주체로 인정하는 아동권리에 대한 국제문서로서 법
적 구속력을 갖는 국제규범이다.
북한에는 아동복지라는 별도의 용어는 없지만, 유아상담소 법령, 탁아소에 관한
규정, 조선민주주의 인민공화국 어린이보육교양법, 교육법, 장애자보호법 등의 아
동복지 관련법을 통해서 북한 아동을 위한 아동복지체제가 마련되어 있다. 이를
구체적 영역으로 나눠 보면, 첫째 생존권 영역으로는 아동의 생명권·발달권, 건
강과 의료의 관리, 둘째, 보호권 영역으로는 발달에 해로운 노동으로부터의 보호
받을 권리와 난민 아동의 보호와 원조, 셋째, 발달권 영역에는 아동양육에 대한
국가와 사회의 공동 책임원칙, 결손 가정 아동에 대한 국가의 보호와 원조, 교육
에 대한 권리 등 있다. 하지만 참가권 영역은 하나도 없었다. 이는 국제아동권리
협약에 근거하여 현재의 북한의 아동복지 관련법에서 아동 권리의 차원에서 어떤
영역이 미흡한지를 확인할 수 있는 자료를 제공한다고 본다. 북한 아동복지 관련
법 대부분의 조항은 거의 모두 아동의 보호와 지원 차원의 내용들이었으며, ‘아동
권리’ 차원에서의 아동에 대한 주체적인 인식은 반영되어 있지 않았다.
따라서 북한이 사회주의 체제이기는 하지만, 북한 아동의 권리를 보장하기 위해
서는 국제아동권리협약의 내용을 참조 틀로 하여 아동복지 관련법의 법적 체계화
와 보완이 필요하다고 하겠다.

영어초록

Entered into in 1989, Convention on the Right of the Child is the international
agreement on the rights of the child that includes all the children under 18 yearsold under protection as well as recognizes them as active human beings for rights
and thereby, the international standard to have legally binding force by defining
systematic and comprehensive principles on the issues of children’s rights.
Although there is no separate term of child welfare in North Korea, child welfare
systems for North Korean children are established through the laws on child welfare
including legal statutes of child guidance center, regulations relating to child care
centers, laws on child care and education of The Democratic People’s Republic Korea
and laws on education and laws on the protection of disabilities.
Those laws can be classified by specific area. Firstly, in the area of right to survival
are included right to life and development of children and management of health
and medical treatment. Secondly, in the area of protection right are included the
right to be protected from labors harmful to the development and protection and
support for refugee children. Third, principle on joint responsibilities between the
country and the society for child care, national protection and support for children
in dysfunctional families and education right are included in the area of the right
to development. However, none is specified in the area of right to participation. These
provide evidence to identify which area has shortcomings in the laws on child welfare
of today’s North Korea in terms of the rights of the child on the basis of Convention
on the Rights of the Child. Most articles in the laws relating to child welfare in
North Korea include the details on protection and support for nearly all children,
but fail to recognize children as independent from the perspective of ‘the rights of
the child’.
Accordingly, even though North Korea is governed by socialist system, the laws
on child care should be systematically made up for weak points based on the details
of Convention on the Rights of the Child in order to ensure the rights of the child in North Korea.
