대한제국시대 출판법의 제정과 출판검열의 법-문자적 기원 (The enactment of publishing law and law-literal origin of publication censorship in the Korean Empire(大韓帝國) era)

초록

본 논문은 대한제국에서 1909년에 제정된 법률인 출판법의 제정을 둘러싸고 있는 다양한 지향적인 힘들을 밝히고자 하는 목적을 갖는다. 이를 밝히기 위해서는 우선 대한제국시대 구축된 법체계의 특수성을 거론해둘 필요가 있을 것이다. 대한제국의 이전 시대였던 조선은 대단히 강력한 왕권 국가였고 대한제국 역시 이러한 성격에서 그리 멀지 않았다. 따라서 대한제국 시대에 제정된 법률들은 실질적으로 왕의 권위를 법-문자의 권위로 이전한 것이 아니라 왕의 권위에 대한 연장에 지나지 않았던 것이다.
하지만 고종이 실각하고 실질적으로 대한제국의 통치권한이 일제로 넘어간 이후에는, 본격적으로 왕의 통치적 권위가 소멸하면서 이는 법률이라는 문자의 권위로 이전되었다. 대한제국시기에 제정된 출판법은 바로 이러한 역사적 배경에서 제정된 법률이다. 그것은 1907년에 제정된 보안법, 신문지법과 마찬가지로 조선이래의 왕도정치에서 왕의 권위로 가능했던 통제적 국면을 법-문자의 권위로 이전하고자 하는 시도였다. 당연하게도 이러한 시도는 당시 인민들의 생체적 감각에 있어서는 자연스럽게 받아들여질 수 없는 것이었다. 이른바 법-문자의 성립을 통한 권위의 이전은 또 다른 형태의 폭력을 배제하고서는 가능하지 않았다.
본 논문에서는 이와 같은 사례로 출판법이 제정되기 이전에 출판법의 적용 대상이 된 『금수회의록』의 저자 안국선의 경우를 분석한다. 안국선은 1908년 출판법이 제정되기 이전에 경찰에 피착되었고, 그가 쓴『금수회의록』은 압수되었다. 이 사건은 통감부에 의한 통제 구도가 본격화되던 시기에서 출판법의 제정을 예비하기 위한 경찰 권력의 의도적인 행위였다고 볼 여지가 큰 것이다. 이 사건 이후로 출판법의 제정은 급속도로 이루어져 대한제국말기의 통제 구도를 본격화하는 데 기여하였다. 본 논문은 당시 출판법의 내용적 측면에서 특수성을 분석하고 그러한 특수성이 어떠한 실질적인 결과를 가져왔는가 하는 바를 살펴보고자 하였다.

영어초록

This paper has the purpose to try to clarify the variety of powers around the enactment of the publishing law, which was enacted in 1909 in the Korean Empire. To say this, first, it is necessary to address the peculiarities of the process system was built in Korea Empire. Joseon era, as the era before the Korean Empire, had been powerful kingship nation, the Korean Empire was also very was not far from this. Therefore, the law that has been enacted in Korean Empire era was only the extension of the authority of the emperor, not the transition from the authority of the king to the law-literal authority.
After Gojong had been ousted and the sovereignty of Korean Empire had gone to Japan substantially, the authority of the reign of King which disappears in earnest was transferred to the authority of the word law. Publishing Law, which was enacted in the Korean Empire, was just a law that has been enacted from such historical background. It was the attempt to transfer controlling aspects was possible in the authority of the king in the royal road politics of Korea since Joseon, to the law-literal authority as well as well the Security Law(保安法) and the Newspaper Law(新聞紙法), which was enacted in 1907. Certainly, these attempts was not able to accept naturally in bio-political sense of the people at the time. It was not possible to exclude violence in the another form in the so-called ‘transfer the authority’ through the establishment of the law-character.
In this paper, we analyze the case of Ahn Guk-Seon, the author of “A story on animal debates(禽獸會議錄)” who was he subject to the publishing law before the publishing law. Ahn Guk-Seon got arrested by the police before the 1908 publishing law is enacted and books, “A story on animal debates(禽獸會議錄)” which he wrote, were seized. This incident seemed to be a deliberate act of police power for Tong-Gam prefecture(統監府) of Japanese Imperialism to prepare the establishment of publishing law at the time and build the control composition. After this Incident, the enactment of the publishing law progressed rapidly and contributed to full-scale control composition in the end of the Korean Empire era. In this paper, we has investigated such a substantive results particularities brought, analyzing the peculiarities of the content of publishing law at the time.
