4차산업혁명 시대 법⋅인권과 법⋅인권교육 연구 동향 (Trends of Studies on Law, Human Rights and their Education in the Fourth Industrial Revolution)

초록

인류는 4차산업혁명을 통해 디지털세계, 물리적 세계, 생물학적 영역 사이의 경계를 허물고 인공지능과 같은 기술들의 융합을 통해 초연결, 초지능, 초융합의 사회로 진입하고 있다. 본 논문은 이러한 시대를 맞아 국내에서 첫째, 법과 인권에 관한 연구가 어떻게 새롭게 전개되고 있는지, 둘째, 그것들의 교육에 대한 연구가 어떻게 이루어지고 있는지, 두 가지 점에 관해서 그 동향을 개괄적으로 검토해본 것이다. 이를 위하여 본고는 연구방법론상 한국학술정보연구원의 연구정보서비스(RISS)를 활용하여 4차산업혁명과 관련지어 법ㆍ인권을 다룬 문헌들을 검색, 검토하는 방법으로 그 동향을 분석하였다. 그 결과 첫째, 직접 4차산업 관련 법ㆍ인권의 문제를 정면에서 다룬 문헌들은 77건에 그쳤다. 이 77건 중 구체적으로 논의가 활발한 법 분야는 헌법ㆍ행정법 등의 공법적 관점을 비롯하여 민ㆍ형사법이나 노동법, 국제법, 교육법 등이다. 4차산업혁명과 관련하여 가장 많은 비중을 차지한 내용은 헌법과 인권분야의 연구들이었으며, 24건을 차지하였다. 여기에서 새롭게 제기된 구체적인 인권 문제는 정보주권, 정보인권, 특히 개인정보 자기결정권과 그 보호에 관한 주제들이 중심이 되고 있다. 그 외 행정법 등 6개 분야에서 연구한 것이 보이지만, 그 분야의 성과물이 두서너 편에 그치고 있다. 공법 분야나 민사법, 형사법의 경우 그동안 자연인이나 법인의 행위능력 등을 판단함에 있어서 그 자체의 문제만을 다루어 족하였지만, 이제 인공지능이 개입하는 경우 그 행위능력을 구체적으로 어떻게 평가하고 취급할 것인가 하는 점이 심각한 쟁점이 되고 있다. 둘째, 4차산업혁명 관련 법 분야별 연구문헌 동향을 파악할 때 주목하게 된 점이 인공지능의 법적 문제와 관련된 것들이었다. 77건 중 23건에 이른다. 구체적으로 이 주제와 관련해서는 문헌들이 인공지능의 인격주체성 또는 전자인격론과 그것을 둘러싼 법적 문제, 인공지능 기반 자동화 행정행위, 인공지능의 형사법 문제, 인공지능과 소비자 권익 침해의 관련성 문제 등을 다루고 있다. 셋째, 한편 ‘4차산업혁명과 법교육’ 및 ‘4차산업혁명과 인권교육’으로 해서 같은 방법으로 검색해본 결과 ‘4차산업혁명과 법교육’을 다룬 문헌은 전혀 보이지 않았으며, ‘4차산업혁명과 인권교육’을 주제로 다룬 문헌은 한 건이 보였다. 4차산업혁명과 관련하여 법교육이나 인권교육을 어떻게 할 것인가하는 것은 이제부터 시작이라고 할 것이다. 본고는 이상과 같은 논의에도 불구하고 검색 시점을 2019년 11월 30일 현재로 제한한 점, ‘4차산업혁명’이라는 개념과 관련하여서만 검색한 점, 법ㆍ인권 논의 동향과 그것에 따른 법교육ㆍ인권교육 논의 동향에 관해서 ‘개괄적 파악’을 해보는 데에 한정한 점 등의 한계를 지니고 있다. 이 한계를 뛰어넘는 보다 본격적인 연구가 향후 관련 학자들에 의해 지속되기를 기대한다.

영어초록

Through the Fourth Industrial Revolution, mankind has broken down the boundaries between the digital world, the physical world and the biological realm. We are entering a society of hyperconnectivity, super intelligence, and hyperconvergence through the fusion of technologies such as artificial intelligence. This paper reviewed two points at a high level. First, how is the study of law and human rights being newly developed in Korea in the wake of the Fourth Industrial Revolution? Second, to what extent is the study of their education going on? Using the Research Information Sharing Service (RISS) of the Korea Research Information Institute, this school took a method of searching and reviewing the literature on laws and human rights related to the Fourth Industrial Revolution. The results are as follows First, about the law and human rights research related to the Fourth Industrial Revolution we confirmed 635 cases of Korean academic journals, 135 cases of doctoral dissertations, 435 cases of books, and 45 cases of research reports. However, only 77 documents directly addressed the issue of legal and human rights related to the fourth industry. Among these 77 cases, the areas of law where discussion is active include the Constitution and the Administrative Law, civil and criminal law, labor law, international law, and education law. The most important things related to the Fourth Industrial Revolution were studies in the constitutional and human rights sectors. It accounted for 24 out of 77 cases. Specific human rights issues newly raised here are topics on information sovereignty, information human rights, especially the right to self-determination of personal information and its protection. Six other areas, including the administrative law, are seen. However, there are only a couple of achievements in each field. The public law, civil law, and criminal law have only dealt with the problems of the natural person or the corporation itself in determining the ability of the natural person or corporation to act. Now the question is how to specifically assess and handle the performance of artificial intelligence if it intervenes. Second, it was the legal problem of artificial intelligence that came to pay attention to research literature trends in each field of law related to the Fourth Industrial Revolution. Specific issues include artificial intelligence’s personality identity or electronic identity theory, artificial intelligence-based automated administrative actions, criminal law problems in artificial intelligence, and the relationship between artificial intelligence and consumer rights violations. Meanwhile, ‘the fourth industrial revolution and legal education’ and ‘the fourth industrial revolution and human rights education’ can look up in the same way. As a result, literature of the ‘the fourth industrial revolution and law-related education’ did not look at all. A case of Literature showed on the subject of ‘the fourth industrial revolution and human rights education’. Second, there are only three documents related to the Fourth Industrial Revolution that deal with the cultivation of citizenship. Among them is a study that emphasizes ‘citizenship for a new society’ that will bring about the Fourth Industrial Revolution as a problem of fostering new citizenship. Some studies have called the concrete form of citizenship “digital citizenship” and particularly emphasized “responsibility” as its attribute. This paper was originally intended for the keynote presentation of academic conferences. The draft was partly revised and supplemented and reconstructed to meet the requirements of this journal. Therefore, this paper has some limitations. It is hoped that more full-fledged research beyond this limit will be continued by relevant scholars in the future.
