공공디자인법과 경관법의 역할 관계에 관한 연구 (A Study on Role Relationship between Public Design Act and Landscape Act)

초록

2016년 8월 4일 공공디자인법이 본격적인 시행에 들어갔다. 공공디자인법은 공공영역에서의 디자인 행위를 통해 국민 삶의 질 향상과 문화향유권을 증대하려는 국가적 정책이다. 그간 국내의 공공영역과 관련한디자인은 경관의 관리 측면을 강조한 경관법의 세부사항처럼 제한되거나 생산자와 소비자의 욕구 충족을 중심으로 하는 산업디자인과 차별성을 놓고 논쟁을 치루는 등 복잡한 관계 속에서 그 역할이 명백하게 규정되지 않았다. 그러나 지방자치단체에서는 이미 2007년부터 시행된 경관법에 의한 조례보다도 법제화되지 않은공공디자인 관련 조례의 숫자가 많을 정도로 그 필요성은 확대되어 왔고 결국 공공디자인법이 제정되었다.
본 연구는 공공디자인법 제정시 논의되었던 산업디자인과 경관에 대한 논의를 살펴보고, 핵심적 비교사항인 공공디자인법과 경관법의 차이점을 분석하여 바람직한 역할 관계 모색과 국가 및 지방자치단체, 공공기관 등에서의 효율적 활용 방향을 제시하려는데 목적이 있다.
연구는 그 동안 진행되었던 공공디자인법과 경관법의 정의와 목적의 분석을 통한 지향점, 법의 구조체계, 사업내용 비교 조사 등을 통해 각각의 특성을 분석, 도출하였다. 그리고 이를 통해 공공디자인법과 경관법의 바람직한 역할 관계를 세 가지 방향으로 제시하였다. 그 방향은 첫째, 공공디자인법은 정체성의 추구, 경관법은 종합적 이미지의 관리에 중점을 두는 것이바람직하고, 둘째, 특정 지역에 대한 사업에서 기획 및마스터플랜은 공공디자인법, 이를 위한 지침은 경관법에 기초하는 것이 바람직하며, 셋째, 위원회는 공동위원회 운영 등 운영의 효율성을 기하는 것이 좋지만 도시브랜드나 문화적 정체성 논의는 공공디자인위원회를별도로 운영하는 것이 바람직하다고 정리되었다.
본 연구의 결과를 정리해 보면 공공디자인법과 경관법은 상호 발전을 위해 역할구분을 명확히 해 상호보완적 관계로 작동해야 하며, 이렇게 할 때 두 법률의 제정취지와 효과가 극대화될 수 있다.

영어초록

On August 4, 2016, the Public Design Act went into full swing. The Public Design Act is a national policy aimed at enhancing the quality of life and enhancing the enjoyment of culture through design activities in the public domain. In the meantime, the design related to the public area in Korea has been limited to details of the landscape law emphasizing the management of the landscape. In addition, it has also argued for differentiation in industrial design based on fulfillment of needs of producers and consumers. Its role was not clearly defined in such a complicated relationship.
However, in local governments, the necessity has been expanded so that the number of public design related ordinances which have not been legislated more than the regulations by the landscape act already implemented from 2007, and finally the public design act was enacted.
This study has a purpose of finding the desirable role relationship between public design act and the landscape act, and directing utilization of those acts to national and local government entity and any government offices by examining the discussions about industrial design and landscape that was discussed in the public design act enactment and analyzing the difference between public design act and the landscape act which is core comparative issue.
The research analyzed the characteristics of the public design through the analysis of the definition and purpose of the public design act and the landscape act, the structure of the law, the comparative analysis of business contents, and so on. Through this study, the desirable role relationship between public design act and landscape act is presented in three directions. The directions are as follow: First, it is desirable to focus on the identity of the public design act, the landscape act on the management of scenic images, and second, on the projects for specific areas, the planning and master plan should be based on public design, Third, it is desirable that the committee should maintain the efficiency of operation such as joint committee operation.
However, discussion of city brand or cultural identity is summarized as desirability of operating a public design committee separately.
The results of this study are summarized as follows. The public design act and the landscape act should clarify the roles for mutual development and work in complementary relation. In doing so, the enactment effect and the effect of both laws can be maximized.
