초록

この論文は、1975年11月から12月に発生した「在日僑胞留学生」に対する「国家保安法·反共法違反事件」(「11·22事件」)の歴史的事実を明らかにし、この事件に適用された国家保安法の問題点を、「事実と法律適用」のあいだの関係の中で考察してみようと思った。1971年の徐勝·徐俊植事件以降、1970～1980年代に「在日僑胞留学生間諜事件」が十余回発表されたが、これら事件は、事実、学術的次元の研究というよりは、未だ再審が進行中である韓国現代史の「清算されねばならぬ歴史」の部分である。「包括的過去清算」のための国家機構として出発した「真実和解のための過去事整理委員会」が、2010年12月、多くの名残と限界を帯びたまま終了したが、韓国戦争時期の民間人虐殺と1945年解放以降の国家暴力による重大な人権侵害事件に対する、真実糾明の道を開いた。またこの間、韓国現代史から排除された「禁断の領域」であり「ディアスポラの領域」である「在日僑胞留学生間諜事件」についての学術的次元の研究も、試みられたのである。この研究は、このような点で意義を持つといえる。韓国現代史で数多くの「スパイ事件」を量産した背景には、国家保安法があることは周知の事実だ。国家保安法は、国家の安保のための法という名分下に、「国家」でなく「政権」の安保に利用され、政治的反対派を除去することに一助とした。祖国への愛と希望を持って留学の道を選んだ「在日僑胞留学生」たちは、ある日いきなり公安当局に引っ張られ、過酷な拷問により「スパイ」に仕立てられ、監獄で20～30代の青春を送らねばならなかった。彼らの若き日の時間を、いかにして償うことができるであろう。この論文は、「11․22事件」をはじめとした「在日僑胞事件」として悔しく犠牲となった多くの人々の真実を明らかにするのに、一助となろうと書かれた。彼らの善良な瞳を思い浮かべ、この論文を彼らにささげる。

영어초록

This study investigates on the violation case of ‘the National Security Act and the Anti-Communist Law’ occurred in November-December 1975 against ‘students of Koreans who born in Japan’(‘the 11·22 Case’) and consider on the relationship between ‘the fact and applying the law’. After the case of SeoSung and SeoJunSik in 1971, in 1970 to 1980’s a dozen times ‘espionage cases of Korean students who born in Japan’ were published, in fact this cases are still in retrial rather than object of study in academic level and parts of our contemporary history which must be sweep away.
Truth and Reconciliation Commission, Republic of Korea was launched in 2005 for ‘Comprehensive historical settlements’ as the national organization. And this organization terminated in December 2010 with much regret and limits. But it paved the way for the Truth of genocide before and during the Korean War and incidents of gross human rights violations by nation violence since liberation of 1945. Meanwhile, the research which excluded from the Contemporary history, ‘forbidden zone’ and ‘area of diaspora’ in Korea, ‘espionage cases of Korean students who lived in Japan’ are attempted on the academic level. In this regard, this study can be said with significance.
It is common knowledge that the National Security Act is the legal background of many ‘espionage case’ in Korean contemporary history. But, the National Security Act is used in the removal of the political opposition, for ‘the government’ security rather than ‘the national’ under the name of national security. ‘Korean students who lived in Japan’ selected way of studying with love and hope for the country, all of a sudden they arrested by the public security authorities and fabricated as ‘spy’ by severe torture, had to send youth in their twenties to thirties in prison. What time of day for their young, will compensate. This paper has been written by contribute to the uncovering of the truth ‘the 11·22 case’(‘the 22th Nov. case’) ‘including the many people of ‘Koreans in Japan cases’ as “wrongfully victimized. This paper is dedicated to them, remembering them.
