조선시대 혼인법의 친족간 금혼범위에 관한 연구 -조선왕조실록을 중심으로 (A Study on the Range of Prohibition on Intermarriage in the marriage law of Joseon Dynasty －Focused on the Annals of the Joseon Dynasty－)

초록

이 논문은 조선시대 혼인법에 있어서 부계ㆍ모계혈족 및 인척을 포함한 친족간 금혼범위에 관한 연구다.
종래 조선시대 혼인법의 연구는 주로 경국대전, 속대전과 대명률 등에 산재된 혼인에 관한 규범을 해석학적으로 분석한 것에 그쳤기 때문에 혼인법의 실제적 내용을 파악하기에는 어려움이 있었다.
이 연구에서는 조선왕조실록의 기사를 중심으로 친족간 금혼범위를 고찰하고자 하였다.
조선왕조실록은 조선의 정치, 경제, 문화, 과학, 가족제도, 풍속 등에 관한 사항과 이에 관한 국왕의 교지, 전지, 수판사항 등이 그 내용을 이루고 있다. 또한 재판기록으로서의 성격도 가지고 있기 때문에 이러한 기록들을 통하여 친족간 금혼범위에 관한 실제적이고 구체적인 내용을 파악할 수 있는 것이다. 이러한 이유로 법전이 있음에도 불구하고 실록의 중요성이 인정되는 것이다.
왕조실록에 나타난 기사들을 중심으로 고찰한 조선시대 친족간 금혼범위는 다음과 같다.
조선시대 혼인법의 친족간 금혼범위에는 대표적으로 동성혼이 포함된다. 이것은 동성불취라는 중국의 종법에 그 근거를 두고 있으며 대명률에는 이를 금지하는 원칙 규정이 있다. 동성혼금지라는 것은 동성동본자인 남계혈족간의 혼인은 촌수의 원근을 불문하고 혼인할 수 없다는 것을 의미한다.
그러나 조선에서는, 고려시대까지 행해졌던 동성동본자간의 혼인금지는 물론 종래 혼인관습이었던 동성이본자간의 혼인까지도 금지하였고 경국대전은 종친에 대하여, 속대전은 모든 계층의 혼인금지를 위하여 이를 명문화하였다. 또한 이를 대명률에 우선하여 적용하므로써 대명률보다 부계혈족간 금혼범위를 더 넓게 인정하고 있다.
기타 이성(異姓)친족으로서 근친간 금혼범위에 관하여 대명률은 모계혈족 및 부계방계친인 혈족녀의 이종자매와 직계비속을 포함하고 있으며 그 범위도 각각 8촌, 7촌, 5촌까지로 규정하였다. 그러나 실록기사에 의하면 이성친족의 범위에는 모계혈족 및 부계방계친인 혈족녀의 직계비속만 포함되며, 이들간의 금혼범위도 국왕의 교지에 의하여 6촌 이내로 한정하였다. 기타 근친간 금혼범위는 대명률의 규정에 의하여 적용되기 보다는 국왕의 명령 등에 의하여 조선의 실정에 맞도록 규제되므로써 대명률의 적용을 배제하였다.
그 밖에 인척간 금혼범위에 관하여 대명률은 혈족의 배우자, 배우자의 혈족, 혈족의 배우자의 혈족까지 광범위하게 규정하였다. 그러나 실록기사에 의하면 인척간 혼인사례는 아직까지는 보이지 않는다.

영어초록

This study investigates the range of prohibition on intermarriage, including the marriage between the paternal/maternal kin or blood relatives, in the marriage law of Joseon Dynasty.
As the previous studies on the marriage law of Joseon Dynasty have mainly focused on analyzing analytically the norms on marriage that scattered in “Grand Ming Code”(Da Ming Lu), “Gyeonggukdaejeon(Joseon Dynasty Law Code)”,“Sokdaejeon(Amended Law Code)” etc., it is difficult to comprehend the substance of marriage law.
This study intends to investigate the range of prohibition on intermarriage by focusing on the articles of the Annals of the Joseon Dynasty.
The Annals of the Joseon Dynasty comprises of articles on politics, economics,culture, science, family system of Joseon Dynasty, and king’s orders(Gyoji and Jeonji) or comments on those articles. And as it also has a characteristic as trial records, we can grasp the substances and details of the range of prohibition on intermarriage by referring to these records. For this reason, the Annals’ importance is, in spite of the existence of the law codes, highly acknowledged.
The range of prohibition on intermarriage, examined by surveying the articles of the Annals, is as follows:The prohibitions included, most of all, that on the marriage between the people with same surname. It was based on the Chinese clan code, and the Grand Ming Code had regulations to ban that kind of marriage. It meant that the relatives on the paternal side, with the same surname and the same family origin, were forbidden to marry, regardless of the degree of kinship.
But in Joseon Dynasty, not only the marriage between the people with the same surname and the same family origin, but also between the people with the same surname and the different family origin, which had been permitted until Goryeo Dynasty, was prohibited. Gyeonggukdaejeon stipulated for the purpose of banning this kind of marriage in royal families, and Sokdaejeon extended the range to all the class.
As for the range of prohibition on intermarriage between the other relatives with the different surname, the Grand Ming Code included the relatives on maternal side, and the lineal descendants of the women on paternal/maternal side in the range to the 8th degree of kinship. But in Joseon Dynasty, the boundary of blood relatives was defined as to the relatives on maternal side, and the lineal descendants of women on collateral paternal side in the range to 6th degree. This regulation was put into force by the king’s orders, Jeonji.
Besides, the Grand Ming Code defined the range of prohibition on intermarriage widely as to spouse of the relatives, relatives of spouse, and the relatives of spouse of kinsmen, but we cannot find the case of marriage between these relatives in the articles of the Annals of the Joseon Dynasty.
It can be concluded that, the range of prohibition on the intermarriage between the other relatives was decided rather on the basis of the national law code and the king’s orders etc., appropriate for the Joseon society than on the basis of regulations of the Grand Ming Code.
