초록

한국(대한제국) 장로교회는 1907년 「헌법」에 기초하여 전국 조직체인 노회 (Presbyter)를 창립했고, 이 노회가 1912년 총회창립으로 발전했다. 이 동안에 1910년 대한제국이 몰락했고 한반도에는 일제의 식민 지배가 시작되었다. 국가 주권을 빼앗긴 나라에서 그 땅의 국민인 장로교회 교인들은 자유와 평등 그리고 대의민주주의제도의 헌법을 가졌다. 교단의 헌법은 일제의 권가권력에 예속되지 아니하는 자치와 자립을 보장받는 근거였다. 이것이 1919년에 장로교회 교인들이 민족 독립을 위한 31운동에 참여하고 또 상해 대한민국임시정부 수립에 참여한 배경이라고 본다.
상해 대한민국임시정부가 조직되는 과정에서 제정된 최초 헌법인 「임시헌장」 제1조와 제 2조에는 장로교회의 헌법에 상응하는 공화제와 대의민주주의가 명시 되었다. 그 임시헌장과 장로교회 헌법 사이에는 공통성이 있는데, 그것은 민주공 화제이다.
민주공화제의 뿌리가 되는 ‘민’(民)에 대한 의식을 살펴보면, 조선시대 구한말 시기까지 우리나라에는 정치의 주체로서 국민(國民)이란 개념이 부재했고 피지배 층인 백성(百姓)의 개념이 일반적이었다. 그 백성이 민권(民權)을 요구하기 시작한 때는 1898년 독립협회가 주관한 대중 집회인 ‘만민공동회’였다. 민(民)이 정치적 주체로 등장하는 계기로 작용한 사건은 1905년에 체결된 ‘을사조약’이었다.

영어초록

In celebration of the 100th anniversary of the establishment of the Shanghai Provisional Government of the Republic of Korea in April 2019, I pay great attention to the fact that Protestant (Christian) leaders participated in the establishment of the Provisional Charter of the Republic of Korea (1919), the first constitutional provision of the Provisional Government. Many of them were Presbyterian ministers or elders. They were already accustomed to the Presbyterian Church’s Constitution made in 1907, which seems to have contributed in part to the drafting of the Provisional Charter of the Republic of Korea.
The original idea of this paper was conceived when I was thinking of the interdisciplinary dialogue and exchanges as a research method. I have tried to identify two historical currents since the end of the nineteenth century in Joseon Dynasty from a synchronic perspective. I investigate general history and church history side by side, and the Provisional Charter of the Provisional Government along with the Constitution of the Presbyterian Church. In the process I examine how and in what background the concept of ‘Min’ (people) was created and how it developed into the concept of the democratic republican.
On the basis of its Constitution, the Presbyterian Church of Korea founded a presbytery, a national organization, and then this presbytery developed into the first General Assembly in 1912. Between the times, the Korean Empire collapsed in 1910 and the Japanese colonial rule began on the Korean peninsula. Though Koreans lost their national sovereignty, the Presbyterian Christians had the Constitution marked by freedom, equality and democracy. The Constitution provided the Church with the basis for autonomy and independence from the Japanese colonial authorities. In my judgment, moreover, it laid the foundation for the Presbyterian Church’s participation in the 3.1 Movement for national independence and the establishment of the Provisional Government of the Republic of Korea in Shanghai in 1919.
Articles 1 and 2 of the Provisional Charter by the Provisional Government of the Republic of Korea, set forth the republican and representative democracy that corresponds to the Constitution of the Presbyterian Church. It is confirmed, therefore, that there is a commonality between the Provisional Charter of the Provisional Government and the Constitution of the Presbyterian Church, and that its core is the democratic republic.
