민주공화국의 입헌정치에 있어서 헌법교육/민주시민교육: 그 특정한 위상의 규명과 추진 방안의 제안 (The Constitutional/Democratic-Civic Education in the Constitutional Politics of the Democratic Republic: Its Specific Status and a Proposal of its Promotion Plans)

초록

이 글에서 필자는 글로벌하게 통용되는 핵심 개념들을 바탕으로 헌법교육과 민주시민교육에 대해 가장 적합한 정의를 행하면서, 마치 새로운 나라를 건설하는 듯한 기분으로 전국민이 참여했던 2016/17년 촛불시민혁명의 추동력이 ‘주권자 주권 행사-헌법기관-상호호응’이라는 헌법질서의 원칙과 구조의 패러다임에 따라 진행되었다는 데 착안하여, 대한민국 공화국 국체의 중추신경계로서 헌법에 대한 의식을 일상적으로 전국민적 차원에서 체득하고 있어야 한다는 이 시대 헌법교육의 특정한 과제를 도출하였다. 이 혁명의 결과, 1987년 반(反)독재 민주화 운동 이후에도 척결되지 못했던 반(反)민주, 반(反)민생의 적폐요인들을 청산하는 일뿐만 아니라, 그야말로 “나라다운 나라”를 만들어, 다시는 예전 상태로 퇴행하는 일이 없도록 해야 한다고 했을 때, 그 경우 국민들이 생각하는 “나라다운 나라”의 지표상(指標象)을 무엇으로 잡을지에 대한 국민적 합의를 마련하는 부담이 우리를 압박한다.
하지만 시위 개시서부터 철두철미하게 ‘합合헌적 권리행사’로 진행되어 일종의 ‘헌법내적 절차혁명’이라고 할 수 있는 촛불시민혁명의 과정을 면밀하게 살펴보면, ‘촛불이후 새로이 건설될 나라다운 나라’를 만들어낼 추동력과 그 지표상은 이미 촛불시민혁명의 과정 안에 배태되어 있다는 것이 필자의 분석이다. 즉 촛불시민혁명은 현행 <대한민국헌법>에 내장되어 있는 주권자 감수성을 극대화시킨 주권 행사를 통해 국가 차원의 민주주의 작동과 공화국적인 국가-시민-연대를 지향하는 헌법내적 잠재력을 활성화시킨 전형을 보여줌으로써, 촛불 이후 새로운 대한민국을 위한 지표상과 추동력의 설정에 소모될 국민적 합의를 위한 고단한 논의 과정을 대폭 절약하였다. 즉 대한민국 헌법질서에 따라 움직인 주권자의 주권 행사와 헌법기관의 공조를 통해, 촛불이후 새로운 대한민국을 위한 주권자 세력이 충전되었으며, 현행 그리고 앞으로의 개헌을 통해 민주주의 정체성과 공화국 국체성이 더욱 강화될 바로 그 ‘대한민국 헌법’, 즉 현행 제10호 헌법 및 향후 제11호 헌법이 대한민국 국민 모두가 동의할 보다 장기적이고도 지속적인 국가개혁 및 국가행위의 지표상이 될 것이다. 또한 대한민국 국민이라면 이렇게 부정할 수 없는 정당성과 국민적 동의(同意)를 확보한 <대한민국헌법>을 두고 정당과 시민사회 전반에 걸쳐 입헌정치 또는 헌법정치가 펼쳐지면서 헌법에서 제시된 국가목표를 성취하기 위한 선의의 경쟁이 벌어질 것이다.
바로 여기에서 기왕의 헌법교육이 가진 비상한 위상이 부각된다. 헌법교육은 단지 학교교육에서 사회교과 법교육의 한 단원에 그치는 것이 아니라 이제 민주주의 정체(政體)와 공화국 국체(國體)의 성격을 제고하기 위해 그 주권자의 ‘주권자 감수성’ 즉 “이 나라는 나의 나라”라는 확신 그리고 ‘시민능력’을, 실시간 유지․계발하는 비상한 임무를 부여받는다. 즉 헌법교육의 강화는 향후 모든 국가정치를 견인할 주권자 결집의 핵심축을 구축하는 민주공화국의 정초작업인 것이다. 정치․경제․사회․문화 및 안보, 그리고 특히 학교교육과 학교밖교육의 모든 교육영역에 걸친 대한민국 국가 시민의 모든 생활 영역과 활동 영역에서 헌법교육을 강화하여 헌법의식을 일상화함으로써 정치계와 시민사회 전반에 걸쳐 주권자 민주시민에 의한 헌법정치가 가동되어야 한다. 헌법교육은 민주공화국 주권자의 헌법가치와 민주능력을 전달하고 표출하는 대한민국 국가의 정치적 중추신경인 헌법의식의 상시적 배양처이다. 따라서 공화국 국체에 맞게 ‘나’는 민주적인 권력운영과정에 참여할 권리를 가지고 헌법가치를 구현할 수 있다고 체감하는 주권자 감수성이야말로 헌법교육으로써 도달할 수 있는 최고의 주체적 상태이다. 이런 확신에 따라 필자는 이 글에서 헌법교육의 강화와 내실화를 위해 민주시민교육의 공통기본교육으로서 헌법교육을 학교 안팎에서 실시할 다양한 추진방안을 제안하고 그와 더불어 헌법교육과 민주시민교육을 전방위적으로 지원할 「(가칭)헌법교육과 민주시민교육 진흥 및 ‘헌법과 민주주의 센터’ 설립 지원에 관한 법(안)」을 제시한다.

영어초록

In this article I make the most appropriate definition of constitutional education and democratic-civic education based on the their core concepts globally accepted and draw out a specific task of constitutional education in this age that the whole people of DaeHanMinKook (Republic of Corea) should embody ordinarily the consciousness of the Corean Constitution as a central nervous system of the state, taking into notice that the driving force of 2016/17 Candlelight Civic Revolution was operating according to the paradigm of the constitutional principle and order of the mutual response between the exercise of the sovereignty of the sovereign and the constitutional reaction of the constitutional organs. As a result of this revolution we the Corean people must confront with the political burden to create a national consensus on the indicator image of “a nation as a nation proper”, if we should not only clean up the deep-rooted evils, but also never regress backward to the past old age, newly building such a nation as a nation proper.
But I draw a definite conclusion from the situation analysis that the driving force and the indicator image of the post-candle nation to be newly built as a nation proper has been already embedded in the process of the Candlelight Civic Revolution as an inner-constitutional, procedural revolution proceeding in the mode of thoroughly constitutional exercise of the sovereign right just from its beginning. Namely, the Candlelight Civic Revolution saved enormously the exhausting work of discussing about indicator image and creating a national consensus on the new Corea, as it has showed up the typical and ideal mode of activating the inner- constitutional potentiality directing toward the operation of nation-level democracy and the republican solidarity between state and citizens through maximizing the sensitivity of the sovereign equipped in the current Constitution. That is, the force of the sovereign for the post-candlelight new Corea has been already charged through the mutual cooperation of the sovereignty exercise and the constitutional organs according to the Corean constitutional order, so that the 10th at now and the 11th Corean Constitution coming soon as its would-be reform plan that will strengthen the democratic identity and the republican polity should and must give the longer lasting long-term indicator image for the state-reform and national action to which the whole Corean people will agree. Furthermore, a good-will competition will take place in the constitutional politics crossing over all political parties and the civil society to achieve the national object written in the Corean Constitution securing the undeniable legitimacy and general agreement among the Corean people.
Just at this point, the distinguished status of the constitutional education already done must be magnified. Not being limited in only one chapter of the social studies, the constitutional education should be given the distinguished task to sustain and develop the sovereignty-sensitivity, namely, the conviction “This nation is My nation.”, and civic competency of the sovereign in the real-time to heighten the effectiveness of the democratic politics and make clear the republican polity. That is to say, the strengthening of the constitutional education is the founding work for the democratic republic to build the core-axis concentrating the sovereign driving all national politics forward in the future. A constitutional politics by the sovereign democratic citizens has to be operated fully crossing over the political society and the civil society in the whole, as strengthening the constitutional education and making ordinary the constitutional consciousness in all spheres of life and activity all over politics, economy, society, culture as well as national security, especially in the all school-in and school-out educational fields. The constitutional education is a constant cultivating field of constitutional consciousness as the political central nervous system of the Republic of Corea communicating and expressing the constitutional values and the democratic competency of the sovereign of the democratic republic. Thus, the sovereignty-sensitivity incorporating the conviction that I have rights to take part in the democratic process of power- management and competencies to realize the constitutional values is the highest level of the subjective state. From such conviction on, I propose diverse promotion- plans for the constitutional education as a basic and common educational subject of the democratic-civic education and suggest “A Law for Promoting Constitutional and Democratic-Civic Education and Supporting the Establishment of Center for Constitution and Democracy” aiding such efforts in all-encompassing way.
