초록

이 연구는 18세기 이후 목민서의 민소처리지침과 민장 기록의 실태를 살펴본 것이다. 목민서에서는 청송의 환경을 지방관이 조성해야 한다는 입장으로, 재판의 공정성은 물론, 민장의 접수, 처리, 기록 등 민사소송에 지방관의 주도적 역할을 주문하였다.
18∼19세기 목민서에서 나타나는 민소처리의 지침은 첫째, 민장제출의 자율성이다. 누구나 민장을 제출할 수 있지만 대리제출은 허용하지 않았다. 둘째, 민장 접수 및 처리의 효율성이다. 민장은 접수부터 판결까지 당일 처리를 원칙으로, 거주지 원근에 따른 처리 방식을 제시해 민사 행정의 효율성과 신속성을 강조했다. 셋째, 지방관의 직접 처리 및 신속성이다. 종래 이서층에게 일임한 민장처리 업무를 지방관이 직접 관여해 중간에서 발생하는 이들의 폐단을 제거하는 한편, 증가하는 사송 업무를 효율적으로 수행하기 위해 접수된 민장의 즉각 수령과 판결의 간소화, 신속화를 꾀하였다. 넷째, 민장 기록의 상시화이다. 민장의 기록은 관의 처결결과를 확인하는 참고자료로 이용되었으며, 이를 통해 소송감소의 효과를 보려고 하였다.
이러한 민소처리 방침의 최종 목표는 ‘詞訟簡’을 향한 것이었지만 실상은 증가하는 민간의 분쟁을 신속하게 심의, 판결하는 것이었다. 특히 조선후기 사송에서 약식의 쟁송을 의미하는 ‘短訟’ 처결의 방식이 일반화되는 양상 속에서 목민서의 민소지침은 이를 위한 실무 지침의 성격을 갖는다고 말할 수 있다.

영어초록

This study examines the status of the guidelines for the treatment of civil suits treatment and petition records found in Mokminseo(牧民書) after the 18th century. With the position that the environment of Chungsong(聽訟) should be formed by local governor, Mokminseo demanded not only justice from a trial but local governor in civil suits for receiving, treating, and recording petitions or such.
Regarding the guidelines on the treatment of civil suits found in Mokminseo during the 18th to 19th century, first, we can find an emphasis on autonomy in submitting a petition. Anyone could present a petition, but deputy submission was not allowed. Second, efficiency was sought in the receiving and treating of petitions. In handling petitions, the process from reception to judgment had to be treated on the same day by principle, and there was a method of treating petitions according to the distance from the house, which indicates a stress on the efficiency and promptness of civil administration. Third, local governor were desired to handle tasks directly and promptly. Local governor came to be directly involved in the tasks of treating petitions which had been assigned to iseo(吏胥) previously, which not only eliminated their corruptions that occurred in the middle but delivered civil complaints within the jurisdiction properly. Furthermore, to carry out increasing civil suits tasks efficiently, they received petitions and made judgments immediately to ensure simplicity and promptness. Fourth, recording petitions was performed constantly. The records of petitions were used as references to check the officials’ results of judgments, and it was intended to enhance the effect of reducing lawsuits.
The ultimate goal of these principles for civil suits treatment was to deliberate on civil disputes and render judgments promptly as a way to pursue sasonggan(詞訟簡) to reduce lawsuits. In particular, it can be said that the civil suits guidelines of Mokminseo have the characteristics of a practical guideline for this purpose in the aspect that the method of execution of dansong(短訟, short trial) is generalized in the later Joseon Dynasty.
