초록

한반도를 중심으로 하는 한민족의 역사는 씨족사회와 부족사회를 거쳐 고대국가인 고구려, 백제, 신라 삼국 정립기를 지나 통일신라, 발해, 고려, 조선으로 연면히 이어진다. 민족의 역사와 함께 법의 역사, 민사소송법의 역사도 연면히 이어져 현재에 이른 것이다.
조선 전후기를 통하여 사회·경제적인 변동과 함께 민의 사유의식 강화 등으로 소송이 증가하면서 이를 규율하기 위한 절차법이 중요시되었다. 그러한 과정에서 사찬(私撰) 민사소송법서들을 통하여 민사소송규범들이 정리되고 근대적인 민사소송의식이 형성되었다. 그러한 민사소송법 의식의 발전은 「속대전」형전에 「청리조(聽理條)」와 「문기조(文記條)」에 소송에 관련된 절차법 규정이 다수 마련됨으로써 입법화되었다.
그러나, 전통적 통치구조와 육전(六典)체제인 법령체계에 변화가 없어 법의 내용과 체계가 일치하지 않는 상태가 일정 기간 지속되다가 일순간, 갑오·을미 개혁기에 법형식이 근대적인 것으로 전도되어 나타났다. 정긍식, 앞의 책, p. 59.
이러한 급격한 법형식의 근대화가 미처 뿌리를 내리지는 못하고 있던 중, 일제의 침략으로 합병이 되면서 일제를 통하여 독일 민사소송법을 비자발적으로 계수하게 되었다.
해방과 미군정기를 거치며 분단된 상황에서 남한에 단독정부가 수립되고 최초로 한국 민사소송법을 제정할 당시는 민사소송법의 학문적 수준이나 실무경험의 수준에 한계가 있어 결과적으로 일본의 민사소송법에 터잡은 의용민사소송법을 개정하는 수준에 그쳤다. 그 후 한국사회가 발전하며 그에 부응하기 위하여 여러 차례의 민사소송법 개정이 이루어졌으며, 차츰 일본 민사소송법의 영향에서 벗어나 고도화되고 세계화된 사회에서 우리의 독자적인 민사소송법을 발전시켜왔다. 정보통신기술의민사소송법을 발전시켜왔다. 정보통신기술의 급격한 발전과 세계화라는 한국의 사회발전 추세에 발맞추어 민사소송법의 발전이 이루어지고 있다. 전자통신기술의 발전은 민사소송법에도 영향을 끼쳐 최근 전자소송 및 인터넷 화상연결을 통한 재판에 관한 규정들이 민사소송법에 새롭게 도입되었으며, 국제화된 사회에서 그러한 화상재판은 국제 민사소송에서도 가능하게 되었다. 화상재판제도, 송달 및 증거조사에서의 국제공조 등에서는 일본을 앞서는 선진 입법을 하였다. 외세에 의한 분단으로 통일된 민족국가를 이루지 못한 현 상황이지만, 우리는 나름대로 우리 자신의 역량으로 일본 제국주의에 의하여 강제로 이식된 일본 민사소송법에서 탈피하여 독자적인 우리의 제도를 만들어 가는 과정에 있다. 민족사적 측면에서 아직 분단 상황이라는 현실을 직시하고, 전통과 뿌리가 같으나 낡은 시대의 이념에 의하여 이질화되어 있는 북한의 민사소송법에 대해서도 관심을 갖고 연구하여 통일 시대를 대비하여야 할 것이다. 외국법의 무비판적인 도입이 아니라 우리의 전통법에 대한 이해 및 우리의 현재 법의식에 대한 실증적인 연구를 통하여 우리에게 잘 어울리는 민사소송제도를 만들어 가는 것이 중요하다. 법은 시대의 산물이며 하부 사회구조의 변화에 따라 함께 변해 나간다는 점은 실체법뿐만 아니라 절차법인 민사소송법에서도 마찬가지다.

영어초록

The history of the Korean people, centered on the Korean Peninsula, goes through clan and tribal societies, through the three ancient states of Goguryeo, Baekje, and Silla, and continues through unified Silla, Balhae, Goryeo, and Joseon. Along with the history of the nation, the history of law and the history of civil procedure law have continued to reach the present.
During the Joseon period, as the number of lawsuits increased due to social and economic changes and the strengthening of people's private consciousness, the procedural law to regulate them became more important. In the process, the rules of civil litigation were organized through the texts of civil procedure laws edited by an individual and a modern civil litigation consciousness was formed. The development of the consciousness of such civil procedure law was enacted by the provision of a number of procedural law related to litigation in the 「Chungnijo (聽理條)」 and 「Mungijo (文記條)」 in the 「Sokdaejeon」 sentence.
However, there was no change in the legal system, which is the traditional governance structure and civil procedure system, so the content and system of the law did not match for a certain period of time. While this rapid modernization of the legal form had not yet taken root, the German Civil Procedure Law was involuntarily counted through the Japanese occupation as a result of the aggression of Japan.
The first enactment of the Korean Civil Procedure Act(KCPA) in the situation of a single government in South Korea, there was a limit to the level of academic and practical experience of the Civil Procedure Act, and as a result, was heavily influenced by the Japanese Civil Procedure Act(JCPA). It was only at the level of amending the JCPA. Ater that, as Korean society developed, the KCPA was revised several times to respond to it. In line with the rapid development of information and communication technology and the trend of social development in Korea such as globalization, the Civil Procedure Act of Korea is being developed. The development of electronic communication technology has also affected the Civil Procedure Act. Recently, regulations regarding electronic litigation and trial through internet video connection were newly introduced into the KCPA, and such video trial in an internationalized society became possible in international civil litigation Article of the KCPA. It has advanced legislation ahead of Japan in video trial system, and international cooperation in service and evidence investigation.
Although we have not achieved a unified nation-state due to the division by foreign powers, we are in the process of creating our own independent system by breaking away from the JCPA, which was forcibly transplanted by Japanese imperialism with our own capabilities. In terms of national history, it is necessary to face the reality that it is still divided, and to prepare for the era of unification by studying the North Korean civil procedure law, which has the same tradition and roots but is heterogeneous by the ideology of the outdated era. It is important to create a civil litigation system that suits us well through an empirical study of our current legal consciousness and understanding of our traditional laws, rather than the uncritical introduction of foreign laws. The fact that law is a product of the times and changes along with transition in the underlying social structure is the same not only in substantive law but also in procedural law, such as a civil procedure law.
