건물의 개념과 미완성건물의 법적 지위에 대한 검토 (A Legal Review on the Concept of Building and the Legal Status of Unfinished Building)

초록

일반적으로 건물이라고 할 때 사회통념상 건물의 개념이 있지만 이는 법에서 말하는 건물과 그 의미를 달리하는 경우가 많다. 또한 건물과 관련한 규정을 두고 있는 법률이라고 하더라도 법률마다 그 개념을 달리하고 있다. 이들 각 법률상 건물의 개념은 건물에 대한 강제집행이 실시되는 경우에 개념의 차이로 인하여 법리의 충돌이 발생하게 된다. 이에 민법상 건물의 개념과 부동산등기법상 건물의 개념, 건축법상 건축물의 개념에 대해서 살펴보고 건물의 개념에 대한 정의를 통일할 여지는 없는지 검토해보았으나 각 법률의 입법목적 그리고 보호하고자 하는 법익이 다르기 때문에 통일된 개념을 도출하기는 어렵다는 것을 확인할 수 있을 뿐이었다. 다만, 건축법상 건축물과 부동산등기법상 건물은 양자가 공통점을 가지는 경우가 많으므로 건축법상 건축물에 해당한다면 부동산등기법상으로도 건물로 인정하여 줌으로써 등기관이 가지고 있는 형식적 심사권의 한계를 어느 정도 해소할 수 있는 실익을 거둘 수 있을 것이다.
건물은 토지와 달리 등기되었을 때 독립성을 취득하는 것이 아니라 미완성의 건물이라도 최소한의 기둥과 지붕 그리고 주벽을 갖추었다면 독립한 부동산으로 인정하고 있는 것이 우리 판례의 일관된 입장이다. 하지만 미완성건물이 소유권의 객체가 된다고 하더라도 등기를 할 수 없기 때문에 권리를 보호하는데 있어서 여러 가지 제약이 따름에도 불구하고 소유권의 객체로 인정하고 있다는 것은 미완성건물에 대하여 일정한 법적 지위를 보장할 필요성이 있기 때문이라고 할 수 있다. 이에 미완성건물의 각 종 법률상 법적 지위를 검토한 결과 민법에서는 일정한 지위를 보장하여 주고 있지만 건축법이나 부동산등기법에서는 일정한 지위를 가지고 있지 못하다는 것을 확인할 수 있었다.
미완성건물에 대한 법적 지위의 차이는 미완성건물에 대한 강제집행을 실시하는 경우에 강제집행을 신청하는데 있어서 반드시 제출되어야 할 첨부 서류를 마련하기 어렵다는 문제, 건축물대장이 없어서 소유권보존등기를 할 수 없는 등의 현실적인 문제가 발생하게 된다는 것을 확인할 수 있었다. 그럼에도 불구하고 민법이 미완성건물에 대하여 소유권을 인정하여 주고 있다 보니 우리 판례가 민법상 미완성건물과 건축법상 미완성건축물 그리고 부동산등기법상 미완성건물 간의 개념의 차이를 좁혀서 미완성건물의 법적 지위를 강화하여 주는 방향으로 변경되고 있다는 것을 확인할 수 있었다.
미완성건물의 법적 지위를 강화하는 방향으로 입법을 하는 것에는 동의한다고 하더라도 무허가건축물이나 건축허가를 위반한 미완성건물에 대한 법익까지 보호할 필요는 없으므로 미완성건물에 대한 법적 지위를 전체적으로 강화하기 보다는 미완성건물 중에서도 미등기건물에 대해서만 부동산등기법이나 건축법과 조화를 이룰 수 있는 한도에서 제한적으로 법적 지위를 강화하는 방향으로 개정은 이루어져야 할 것이다.

영어초록

Generally, when we call a 'Building', there is a concept of a building by a socially accepted idea, but in many cases, this often differs from what the law says. In addition, the concept differs depending on the different laws, even if there is a law having building-related regulations. Each of these legal concepts of the building would result in a conflict of legal principles due to differences in concepts in the event of a compulsory execution against the building. Thus, we looked through the possibility of unifying the definition of the concept of building after reviewing the concepts of building under the civil law, the real estate registration act, and the building law. However, we could only see that it was difficult to deduce a unified concept because each law had different legislative purposes and the benefit and protection of the law to protect. However, under the building law and the real estate registration act, buildings often share commonalities between the two, so it will reap a harvest of actual profits releasing the limitations of formal reviewing authority held by the registration officer by recognizing as a building under the real estate registration act in case of a building under the building law.
Unlike land, it is the consistent position of our judicial precedents that the building does not acquire independence when registered and that even an unfinished building is recognized as an independent property if it is equipped with a minimum of columns, roofs, and main walls. However, even if an unfinished building becomes an object of ownership, it cannot be registered, so it can be thought that the recognition of unfinished building as an object of ownership despite various restrictions in protecting rights is due to the need to ensure a certain legal status for the unfinished building. Thus, after reviewing the legal status of each unfinished building, it was confirmed that the unfinished building did not have a certain status under the building law or the real estate registration act, while civil law guarantees a certain status.
The difference in the legal status of an unfinished building could be found to be realistic problems, such as the difficulty of preparing attachments that must be submitted in applying for compulsory execution of unfinished buildings, and the impossibility for registration of ownership preservation due to lack of a building register. Nevertheless, as the civil law recognizes ownership of unfinished buildings, we could see that our precedents were being changed to strengthen the legal status of unfinished buildings by closing a gap in concepts among unfinished buildings under civil law, the building law, and the real estate registration act.
Even if the legislation to strengthen the legal status of unfinished buildings is agreed upon, there is no need to protect the benefit and protection of the law for the unlicensed buildings or the unfinished buildings that violate building permits. Thus, rather than strengthening the overall legal status of unfinished buildings, the revision should be made to restrictively strengthen legal status only for unregistered buildings of the unfinished buildings to the extent that it can be harmonized with the real estate registration act or the building law.
