초록

포스트모더니즘 미술은 기존 미술적 규범을 해체하며 독창성, 탈중심화, 차용과 같은 특성을 중심으로 사회적·문화적 맥락에서 새로운 미적 가능성을 탐구한다. 그러나 이러한 작품은 창작적 표현보다는 아이디어에 초점을 맞추는 경향이 있어, 저작권법의 적용에 있어 도전을 제기한다.
미술은 인간의 사상과 감정을 시각적으로 표현한 예술로 정의되나 포스트모더니즘 미술은 이 범주를 확장하면서도 기존의 미술저작물과 본질적 차이를 보인다. 저작권법은 복제 기술의 발달에 따라 미술 작품의 보호 필요성을 인식하고, ‘문학과 미술의 등가치성’ 및 ‘예술의 일체성 원칙’에 의해 시각적 창작물을 일반적으로 보호하고 있다. 그러나 포스트모더니즘 미술은 표현보다는 아이디어의 중요성을 강조되며, 그 창작성을 시각적 미감(美感)에서 찾기 어려운 경우가 많다. 따라서 포스트모더니즘 미술은 일괄적으로 미술저작물에 포함시키기 어려우며, 어떠한 면에 창작성이 있는지에 따라 그 보호 가능성을 타진해 볼 수 있을 뿐이다.
포스트모더니즘 미술을 추상표현주의, 팝아트, 극사실주의, 차용미술, 개념미술로 구분하여 각 유형별로 저작권법 적용 가능성을 검토할 때, 공통적으로 소재의 선택, 배열에 관한 ‘편집적 창작’을 전제할 수 있다. 추상표현주의 미술에서는 미니멀리즘 작품이나 우연적인 결과가 포함된 작품에 대해서도 독창성을 인정하고, 그 침해 여부에 대해서는 일반적인 미술저작물과 같이 전체적인 컨셉과 느낌에 의해 판단하는 외관이론을 적용하는 한편 공중의 영역과 표현 기법을 배제하는 방법을 적용할 수있다. 팝아트는 대체적으로 미술저작물로서의 창작성을 인정하되, 실용품에 적용된 팝아트 작품은 응용미술저작물 성립 요건인 분리가능성이 요구된다. 극사실주의 미술은 피사체가 그대로 재현되는 사진과 유사하므로, 그 창작성은 사진저작물에 관한 판례를 원용하여 오브제의 선택, 구도 설정, 빛 반사와 그림자의 각도, 오브제를 바라 보는 시점, 색채 및 명암 등의 요소로 분석할 수 있다. 차용미술 중 상업적 차용미술은 그 상업성에 의해 공정이용에 해당하지 않을 수 있음과 별개로 ‘변형’의 독창성과 창조적 개성에 의해 미술저작물로서의 창작성이 인정될 수 있다. 비평적 차용미술은 언어적 맥락에서 창작성을 찾을 수 있는 패러디의 한 유형으로 볼 수 있다. 개념미술은 동일한 기법을 다양한 오브제에 반복 적용하는 유형과 오브제를 선택하여 의미를 부여하는 유형 모두 일정한 표현도(表現度)를 넘는 편집적 창작성이 인정될 때 보호 받을 수 있으며 건축공간을 활용한 설치미술은 건축적 요소가 중요하게 작용하므로 경우에 따라 공간요소의 선택, 배열 및 조합에서 표현의 창작성을 찾을 수 있다.
이러한 포스트모더니즘 미술의 저작물성 논의는 단순히 법적 보호의 여부를 넘어 현대 예술의 변화와 법적 대응의 발전 방향을 탐구하는 중요한 지점에 있다. 향후 디지털 기술 및 인공지능과 결합된 새로운 창작물이 등장함에 따라, 포스트모더니즘 미술에서 시작된 법적 논의는 더 깊이 있는 연구와 구체적 사례를 통해 지속적으로 확장될 필요가 있다.

Postmodern art deconstructs traditional artistic norms and explores new aesthetic possibilities within social and cultural contexts, focusing on characteristics such as originality, decentralization, and appropriation. However, these works often emphasize ideas over creative expression, posing challenges to the application of copyright law.
Art is generally defined as the visual expression of human thought and emotion. However, postmodern art expands this category while showing fundamental differences from traditional artistic works. Copyright law, recognizing the need to protect art as reproduction technologies advanced, generally safeguards visual creations under the principles of the "equivalence of literature and art" and the "unity of art." Nevertheless, postmodern art places greater importance on ideas rather than expression, making it difficult to find originality in visual aesthetics in many cases. As a result, postmodern artworks cannot uniformly be included as artistic works under copyright law but can be evaluated for protection depending on their originality.
When postmodern art is categorized into abstract expressionism, pop art, hyper realism, appropriation art, and conceptual art, the applicability of copyright law to each type can be examined. A common premise across these categories is the "creativity of compilations" related to the selection and arrangement of materials. For abstract expressionism, even works that include minimalist or accidental elements can be recognized for their originality. In determining infringement, the “overall concept and feel” theory applied to general artistic works can be used. Additionally, public domain elements and techniques may be excluded. Pop art generally qualifies as artistic work under copyright law; however, pop art applied to utilitarian objects must meet the separability requirement for applied art. Hyper realism, resembling photography in its reproduction of objects, derives its originality from elements such as the selection of objects, composition, angles of light reflection and shadow, perspective, color, and tone. These factors can be analyzed using precedents for photographic works. Appropriation art, particularly commercial appropriation art, may not qualify as fair use due to its commercial nature. Nonetheless, its originality and creative individuality through "transformation" may allow it to qualify as artistic work. Critical appropriation art, as a form of parody, can be seen as finding its originality in its linguistic and contextual expression. Conceptual art, including the repeated application of the same technique to various objects or the selection of objects to create meaning, can be protected when it demonstrates a sufficient level of creativity of compilations. Installation art that utilizes architectural spaces emphasizes architectural elements and may derive its originality from the selection, arrangement, and combination of spatial elements.
The discussion of the originality of postmodern artworks extends beyond the question of legal protection to explore the evolution of contemporary art and the development of legal responses. As new creations combining digital technology and artificial intelligence emerge, the legal discussions initiated by postmodern art will need to be deepened and expanded through further research and practical examples.
