안중근의거 관련 『노국관헌취조번역문』의 내용과 그 의미 (The compilation and contents of the translated record of the Russian Government officials’ investigation of Martyr Ahn’s Ito assassination)

초록

안중근의거의 목적은 이토 히로부미의 제거에만 있는 것이 아니라 재판투쟁을 통하여 일제의 한국침탈 상황을 국제사회에 알리는데 있었다. 이러한 안중근의 의도를 밝히기 위해는 안중근재판에 대한 연구가 중요하다 여긴 필자는 『노국관헌취조번역문』에 주목하였다. 그리하여 위에서 보듯이 그 구성과 내용 그리고 주목되는 대목과 그 의미에 대해 살펴보았다. 이를 다음과 같이 정리하여 본고를 맺고자 한다.
『노국관헌취조번역문』은 무엇보다 원사료가 러시아에 남아 있지 않다는 점, 안중근의거의 전체상을 밝히는 데 도움이 된다는 점 등에서 안중근이 왜 일제의 재판을 받을 수밖에 었었는지, 그리고 하얼빈 한인과 안근의거의 관계, 러시아 한인의 상황 등을 밝히는데 의미 있는 사료이다.
『노국관헌취조번역문』의 구성은 결정서ㆍ조서ㆍ통지문ㆍ보고서ㆍ진술서 등으로 이루어졌다. 결정서는 안중근ㆍ우덕순ㆍ유동하ㆍ조도선ㆍ하얼빈 한인 등에 대한 입감과 구류 결정서ㆍ신문결정서ㆍ신체수색결정서ㆍ가택수사집행결정서 등이 있다. 특히 안중근을 일제에 넘긴 이유를 밝히는데 예심결정서와 결정서는 결정적으로 중요한 사료이다.
조서는 하얼빈 한인, 러시아 대장대신 까깝쵸프 등 러시아 관헌, 김성백집 러시아인 세입자를 신문한 내용을 기록한 것이다. 통지문은 주로 러시아 사법당국의 조치를 일본에 통지한 내용이다. 특히 이를 통해 러시아가 예심문서의 사본도 남기지 않고 모든 관계자료를 일제에 넘겼는데, 예심서류 원본 1책(46쪽)과 증거물건을 넣은 상자 2개를 하얼빈 주재 일본총영사에게 송부하였음을 확인할 수 있다.
보고서는 3건으로 구성되어 있다. 그 중 2건은 폰큐 겔겐이 밀레르에 보낸 것이고, 1건은 폰큐 겔겐의 전대동공보사 발행인으로 보이는 미하일로프 신문 보고서이다. 특히 하얼빈 한인회, 김성백 약력 등은 의미 있는 기록이다. 진술서는 의거상황, 하얼빈 한인 조사결과 등에 대한 밀레르의 기록이다.
안중근재판과 관련하여 『노국관헌취조번역문』은 다음과 같이 세 가지 점에서 주목된다. 첫째, 이 사료를 통하여 러시아가 의거 12시간 40분만인 오후 10시 10분 안중근을 넘겨주면서 재판 관할권을 포기한 이유에 대해 명확하게 알 수 있다는 것이다. 그것은 안중근이 한국인이었기 때문이었다. 그가 만약 러시아 국적자였다면 적어도 사형을 면할 수 있었음을 이 사료를 통해 확인할 수 있다는 것은 매우 의미 있는 대목이다.
둘째, 러시아 사법당국의 안중근의거에 대한 인식이다. 일제는 “안중근의거는 정치적 사건이 아니라 단순한 살인사건”이라는 논리에 기초하여 안중근에게 사형을 선고했다. 그러나 러시아 사법당국은 의거가 조직적으로 이루어진 정치적 의미를 갖는 사건으로 규정하였다. 이러한 면에서도 일제의 안중근재판 논리의 허구성을 발견할 수 있다.
셋째, 러시아 사법당국은 안중근의거와 러시아인의 관련성을 부인하는 방향에서 조사를 진행한 사실도 엿볼 수 있다. 동청철도 철도경찰, 하얼빈시 경찰서, 하얼빈 형사탐정국이 동원되어 안중근의거를 조사한 사실도 이 사료를 통해 확인할 수 있었다.
끝으로 안중근이 러시아 군인에게 체포될 때의 상황을 정확하게 알 수 있다는 것도 이 사료의 특징이다. 이를 통해 안중근이 순순히 체포된 것이 아니라 러시아 군인과의 격투도 마다하지 않았다는 사실을 알 수 있다.

영어초록

So far I have reviewed the compilation and contents of the translated record of the Russian Government officials’ investigation of Mr. Ahn’s Ito assassination. And I closely looked into its most important parts and significance. I’d like to conclude this essay as follows.
Why is this material so important and meaningful in terms of historical data? The first reason is that this record is no longer in Russia today. The second is that this can help give the entire picture of Ahn’s patriotic act. The compilation of the record is composed of a written decision, proces-verbal, notice, repots, statement and etc. The written decision contains how influential Ahn Joong Geun, Woo Duck Soon and Cho Do Ha were over the Korean residents in Harbin area. And it also contains the written decisions for detention, interrogation, body-search and house-search. In particular, both the written decision for preliminary examination and the written decision to turn Ahn over to the Japanese judicial authorities are very valuable historical materials. The process-verbal is records of questioning koreans in Harbin, Russian Minister of Finance, Kokovtsoffand, Russian government officials and Russian tenants living in Kim Sung Bak’s. And the notice is about Russian judicial authorities informed Japanese government authorities about Russian’s judicial actions. We have to pay attention to that Russia turned all relevant materials over to Japan without saving even a copy of these materials. Now it is verified that one original text(46pp) and 2 boxes of material evidence and voucher were sent to Japanese Consulate General in Harbin.
Especially Korean Association of Harbin and the personal history record of Kim Sung Bak are profound in meaning. The statement is Millere’s report of circumstances of Ahn’s Heroic deed and result of investigation of Koreans in Harbin.
So far as we are concerned with the trial of Ahn Joong Geun, there 3 points to attract our attention in the translation of Russian Government Officials’ investigation of Ahn’s Ito assassination:First, this document reveals that it took only 12 hours and 40 minutes for Russia to turn Ahn Joong Geun over to Japanese Authorities. It ended up as giving up its jurisdiction. The reason for renunciation of jurisdiction over this matter was that Ahn Joong Geun’s nationality was Korean. If his nationality were Russian, death-sentence would not have been handed down to him.
Second, Russian Judicial authorities’ understanding of Ahn’s patriotic deed. Japanese logic was that “Ahn’s patriotic deed is not a political incident, but merely a murder.” That is Japan’s justification for sentencing Ahn to death. But Russia took issue with Japan on Ito assassination. The Russian Judicial Authorities determined this incident as a politically motivated and organized protest. In this context we come to realize how farfetched Japanese insistence or logic is fabricated.
Third, We come to know that Russian Judicial Authorities set their policy positions on this matter in which any Russian was not related to the incident. This material revealed that railroad police of Eastern China Railroad, Harbin police and Chief of Harbin Criminal Division were mobilized for the investigation as well.
And this material clearly shows us how Martyr Ahn was arrested by Russian soldiers. At the same time it vividly describes how Martyr Ahn was not hesitant to fight Russian soldiers. He fought them bravely.
