조선후기 성리학에 근거한 문중의식 심화, 山林의 경제적 가치 증대 등 다양한 이유로 촉발된 山訟은 19세기 말까지 이어져 사회적 폐단으로 고착화되었다. 19세기 말 함양박씨가에서도 시조 朴善의 선산을 둘러싼 산송이 일어났는데, 이 과정은 임실군수 朴始淳의 『雲紱日記』와 고문서 등을 통해 자세히 알 수 있다.
조선 전기 함양박씨는 서울·경기 지역을 중심으로 활동한 대표적인 사족층 중 하나였다. 함양박씨의 묘역은 주로 경상도와 경기도에 분포했는데, 함양박씨의 貫鄕인 함양 賜琴洞에는 유일하게 시조 박선의 묘소가 조성되었다. 그러나 대부분의 후손들이 함양을 떠나 흩어져 사는 바람에 선산은 충분히 관리되지 못했고, 함양박씨는 해당 지역 재지사족으로서 영향력을 발휘하지 못하고 있었다. 이때 같은 함양박씨인 박시순이 인근 지역인 임실에 군수로 부임하게 되었다.
1895년 임실군수로 부임한 박시순은 임실에 거주하는 동종들과 만남을 가진 후 時享을 위해 함양 사금동을 방문했다가 偸塚이 선산을 점유하고 있는 상황을 목격하게 되었다. 그는 임실군수로 재직한 1895년 7월부터 1897년 5월까지 약 2년의 기간 동안 大宗會를 개최하여 宗論을 모으고 함양 선산을 정상화하기 위한 작업에 심혈을 기울였다.
투장자인 함양 아전 金正完, 장교 韓圭贊 등과의 산송이 불리하게 진행되자 함양박씨가는 서울 법부에 정소했고, 박시순은 조정의 고위 관원들에게 간찰을 보내 협조를 요청했다. 이후 법부의 지시로 인해 산청군수가 사관으로서 파견되었으며, 박시순은 산청군수에게 술상을 올리거나 문안 인사를 하는 등 개인적으로 접촉했다. 또한 임실군수인 자신의 이름을 가장 선두에 내세운 단자를 올리며 정소했다. 결국 함양박씨가 측이 승소하여 투총이 파내졌으며, 선산을 재정비하는 한편 지속적인 수호를 위해 인근에 位土를 마련했다.
사금동 산송은 임실군수 박시순과 동종의 협력 덕분에 승소할 수 있었다. 특히 박시순이 자신의 직위를 적극 내세워 산송에 임할 수 있었던 배경으로 서울·경기 지역에서 활동한 先代의 官歷, 婚脈 등이 주요하게 작용했다.

During the late Joseon period, several factors—deepening of the Neo-Confucian ancestral values and the growing economic importance of mountain forests—led to the emergence of tomb lawsuits. These disputes persisted into the late 19th century, becoming a chronic social problem. A notable case involved the tomb-mountain of Park Seon, the founder of the Hamyang Park clan. This lawsuit is extensively documented in the Unbul Diary of Imsil County Governor Park Si-sun, along with other historical records.
During the early Joseon period, the Hamyang Park clan was among the leading noble families, particularly active in Seoul and the Gyeonggi region. The burial sites of the clan’s ancestry were in Gyeongsang and Gyeonggi provinces. The founder Park Seon’s tomb was located in Sageum-dong, Hamyang, the clan’s ancestral homeland. Eventually, many descendants moved away from Hamyang, and the tomb-mountain was abandoned. Hamyang Park was unable to exert influence as a local resident. At this time, Park Si-soon, the same Hamyang Park clan, was appointed as the county governor in Imsil, a nearby area.
In 1895, after being appointed as Imsil County Governor, Park Si-sun met the clan members living in Imsil. During a visit to Sageum-dong for ancestral rites, he discovered that an illegal tomb had been built on the tomb-mountain. Determined to resolve this issue, Park spent the next two years of his tenure (July 1895 to May 1897) conducting grand clan meetings, ascertaining the clan’s collective opinion, and working toward restoring the tomb-mountain to its rightful state.
The lawsuit centered on Kim Jeong-wan, a local official from Hamyang, and Han Gyu-chan, a military officer, both accused of illegal burial. When the case turned against the Hamyang Park clan, they filed a petition with the judicial branch in Seoul. Park Si-sun personally wrote letters to influential officials, seeking their support. The judicial branch assigned Sancheong County Governor to oversee the case, following the dilemma of impartiality. Park forged personal ties with the Sancheong County Governor through formal visits and gift hampers of wine. Further, using his title as Imsil County Governor, he filed petitions. The efforts paid off as the Hamyang Park clan won the lawsuit, resulting in the demolition of the illegal tomb. Subsequently, members of the clan reorganized the tomb-mountain and acquired nearby land to protect it.
The cooperative efforts of Imsil County Governor Park Si-sun and support from the local clan members resolved the Sageum-dong tomb lawsuit successfully. Park’s ability to leverage his official position was influenced by the legacy of his ancestors’ distinguished careers and marriage relationships in the Seoul and Gyeonggi regions.
