초록

東滿區域局은 1926년 10월 28일 龍井에서 朝鮮共産黨 滿洲總局 하부조직으로 만들어졌다. 구역국에는 책임비서 아래 조직부ㆍ선전부ㆍ표면부ㆍ입당검열부를 두었고 지역별로 야체이카를 설치했다. 조직정비에 노력한 결과 당원은 100명 안팎에 이르렀는데 이들은 주로 함북 출신 20ㆍ30대 지식인층이었다. 구역국에서는 이를 토대로 민족당 건립 운동, 항일무장부대 조직을 위한 기초조사, 민립중학건립운동, 일제가 전개한 관세부가세반대운동 저지투쟁, 在滿朝鮮人 생존권투쟁 등 여러 활동을 전개하였다.
동만구역국에서는 내부적으로 화요파ㆍ상해파ㆍ공청 세력이 서로 대립ㆍ갈등 관계에 있었다. 이들은 동만구역국이라는 통일된 조직에 합류하였지만 이들 사이의 대립ㆍ갈등은 한순간에 해결될 수 있는 것은 아니었다. 이러한 대립ㆍ갈등은 충분한 소통을 통해 해소될 수 있는 것이었고 구역국에서는 그러한 의지도 가지고 있었다. 그러나 제1차 간도공산당사건 발생으로 인해 갈등을 해소할 기회를 갖지 못했다.
동만구역국은 제1차 간도공산당사건으로 조직이 붕괴되었다. 일제는 구역국 설립 초창기부터 밀정을 고용하고 지속적인 감시를 벌이고 있었다. 그러던 중 조선공산당사건재판을 공개하라고 요구하는 시위가 벌어지자 1927년 10월 3일부터 間島日本總領事館警察署에서 구역국 구성원들을 체포했다. 일제는 이 사건을 間島에서 재판하지 않고 재판관할을 경성지방법원으로 옮겨 재판을 진행하고자 했다. 이는 “피의자”를 사건발생지역에서 분리하여 그들의 의도대로 처리하려는 편의성에 기인한 조치였다.
제1차 간도공산당사건에 대한 재판절차가 시작되자 무료변론에 나선 변호인단은 일제사법당국에 대한 투쟁을 적극적으로 전개하였다. 변호인단은 재판부가 결정한 재판 비공개에 대해 강력하게 항의하였다. 비록 공판과정이 공개되지는 않았지만 변호인단은 특별방청금지라는 성과를 이끌어냈다. 또한 검사가 1928년 개정된 치안유지법을 적용하여 구형하자 변호인단은 검사 구형이 법리에 맞지 않는다며 크게 반발하였다. 결국 변호인단 주장이 판결에 반영되어 구형보다 낮은 刑期가 결정되었다. 검사 측에서는 무리한 구형을 인정하고 공소를 포기함으로써 제1차 간도공산당사건에 대한 재판은 종결되었다.

영어초록

Dongmanguyeokguk was established in Longjing on October 28, 1926 as a lower organization of the Joseon Communist Party Manju Chongguk. Guyeokguk had the organization division, the propaganda division, the front division, and the political party joining and censorship division under the responsible secretary, and Yacheika was established by each region. Efforts for organization alignment resulted in 100 or so party members, who were largely intellectuals in their 20s or 30s from Hamgyeongbuk-do. Based on them, Guyeokguk performed different activities such as movement to establish the national party, basic investigation to organize anti-Japanese armed forces, movement to establish privately funded middle schools, struggles for opposing tariff and surtax the Japanese imperialists attempted to levy, and struggles for survival rights of Joseon people living in Manchuria. Within Dongmanguyeokguk, Whayo Group, Shanghai Group, and the Government Office Group were in confrontation and conflicts. They had joined a unified organization Dongmanguyeokguk but confrontation and conflicts among them were not able to be resolved in a moment. Such confrontation and conflicts were able to be resolved through sufficient communications and Guyeokguk had such intention. Nonetheless, opportunities to resolve such conflicts were lost due to the first round of Gando Communist Party Incident.
Dongmanguyeokguk collapsed after the first round of Gando Communist Party Incident. The Japanese Imperialists hired secret agents from the initial stage of Guyeokguk and continuously monitored it. Amid such circumstances, a demonstration to demand making trials on Joseon Communist Party Incident public was waged and the Japanese consulate-general police station in Gando arrested members of Guyeokguk from October 3, 1927. The Japanese imperialists attempted to proceed with trials on this incident not in Gando but move the trial jurisdiction to Gyeongseong district court. This was a measure based on convenience separating the "suspects" from the area where the incident had occurred and attempting to treat it according to their intention. As the trial proceedings for the first round of Gando Communist Party incident were initiated, the defense counsel who engaged in pro bono work actively struggled against the Japanese judicial authorities. The defense counsel strongly protested against the Justice Department that made the trials closed. The process of the trial was not open but the defense counsel produced achievements of the trials being conducted under the special closed door. In addition, as the prosecutor demanded a penalty by applying the Maintenance of the Public Order Act revised in 1928, the defense counsel severely resisted arguing that the demand by the prosecutor did not fit the legal principles. Finally, the defense counsel's argument was reflected in the ruling and a shorter prison term was determined than the original demand. The prosecution recognized excessive demand and gave up indictment and the first round of Gando Communist Party incident ended.
