초록

우리나라 공무원법은 헌법 제7조 제2항에서 직업공무원제도를 헌법적 제도로 보장하면서, 법률인 국가공무원법 및 기타 하위법령으로 구성된 3단 체계이다. 오늘날 사회복지국가화, 행정의 고도화 현상 및 공무원법 분야에서의 전통적 특별권력관계론 등을 이유로 수많은 행정입법으로 구성되어 있다. 공무원법 체계상 다수의 대통령령 등으로 위임입법된 것은 국정의 효율적 운영을 위해 어느 정도는 필요하겠지만, 그럼에도 불구하고 헌법재판소와 법원은 행정입법의 자의적인 해석의 여지를 없애기 위하여 위임입법의 헌법적 한계를 보다 명확히 제시하고 일관되게 적용하여야 한다. 나아가 공무원법에서 국가 공동체 질서유지와 공무원이 국민으로서의 지위에서 가지는 중요하고 본질적인 사항에 대한 결정은 응당 민주적 정당성을 가진 의회가 직접 제정하는 법률로 정해야 하며, 전통적 특별권력관계 개념에서 출발한 과도한 행정입법 위임 현상은 지양되어야 한다. 이에 더하여 포괄위임금지와 명확성원칙의 철저한 실현을 통해 공무원관계법에서 오히려 쉽게 용인될 수 있는 자의적 법집행과 법률해석을 방지하여야 한다. 결국 공무원관계법령들이 국가의 기능유지를 위하여 헌법이 마련한 제도이고, 공무원들의 기본권도 헌법적 가치질서에 속하고 있는 이상 어느 한쪽을 일방적으로 제한한다거나, 어느 한쪽을 일방적으로 강요하여서는 아니될 것이므로 공무원의 권리와 의무에 관한 주요 사항들 역시 가능한 법률로 규정함이 상당하다. 나아가, 단지 공무원이라는 이유로 지나치게 좁게 해석되어 왔던 공무원들의 기본권도 대폭 확대하여 인정하는 방향으로 규율함이 상당하다.

영어초록

The Civil Service Act of Korea is a three-tier system composed of the National Public Officials Act and other subordinate statutes while guaranteeing the vocational civil service system as a constitutional system in Article 7 (2) of the Constitution. Today, it is composed of numerous administrative legislation for reasons of social welfare stateization, sophistication of administration, and the traditional theory of special power relations in the field of civil service law. Although it is necessary to some extent for the efficient operation of state affairs, the Constitutional Court and the courts, in order to eliminate the possibility of arbitrary interpretation of administrative legislation, It should be presented more clearly and applied consistently. Furthermore, in the Civil Service Act, the maintenance of order in the national community and decisions on important and essential matters that public officials have in their status as citizens should be determined by laws directly enacted by the parliament with democratic legitimacy, and excessive delegation of administrative legislation starting from the traditional concept of special power relations. The phenomenon should be avoided. In addition, it is necessary to prevent arbitrary execution of laws and interpretations of laws, which can be easily tolerated in the Public Official Relations Act, through the thorough realization of the principle of inclusive penalty and the principle of clarity. In the end, as long as public officials-related laws and regulations are a system established by the Constitution to maintain the function of the state, and the basic rights of public officials also belong to the constitutional value order, one should not unilaterally restrict one side or unilaterally force the other. It is considerable to avoid the theory of power relations, and to stipulate important matters concerning the rights and duties of public officials as possible laws. Furthermore, there is considerable regulation in the direction of recognizing the basic rights of civil servants, which have been interpreted too narrowly just because they are civil servants.
