청소년의 마약류 등 유해약물남용에 대한 범죄실태와 대처방안 (Current Situation of Youth Crimes Related with Substances Abuse and their Countermeasures)

초록

현재 우리나라는 국제화·개방화에 따라 청소년의 해외 유학 경험, 일반인의 해외교류, 국내체류 외국인의 증가, 인터넷과 SNS의 발달에 따른 해외물품의 직접 구입, 운송 등에 의하여 신종 마약류들이 국내로 급격하게 유입되면서 다양한 사회계층으로 퍼지게 되었다. 따라서 마약류 등 유해물질에 대한 단속과 관련된 정책방향 및 수사는 새로운 국면을 맞이하고 있다. 특히, 청소년들은 신체적·정신적으로 성장 중인 시기이며, 국가의 미래를 위한 인적자원으로서 암수범죄율이 높은 마약류 등 유해물질에 대한 노출과 그 해악은 개인뿐만 아니라 사회적으로도 문제가 크므로 청소년들의 마약류 등 유해물질에 대한 노출을 예방·차단하는데 중점을 두고 위와 같은 물질을 경험하고 중독될 경우 재남용 방지를 위한 해결 방안의 모색이 요구된다.
이에 본고에서는 청소년의 마약류 등 유해물질에 대한 예방 및 대처방안으로 현재 학교현장의 교육기관에서 주로 다루어지고 있는 한정된 흡연·음주관련 교육을 환각성 물질에 대한 예방교육까지 확대하여 실행하도록 제안하였다. 또한 청소년이 마약류 등 환각성 물질에 대한 구입 및 제조방법 등을 쉽게 알 수 있는 인터넷 환경에 대하여 사전 단속을 위한 실시간, 자동 모니터링을 통한 삭제·차단 기능을 관계 기관과 협동하여 운영하고, 협조와 공조수사를 통해 관련 정보 발견시 분석 추적 수사를 통해 청소년은 물론 마약및 물질중독범죄자들의 양성을 억제할 필요성에서 단일화된 마약관련 통제 기관의 설립을 제시하였다.

영어초록

Korean society today has been influenced by internationalization and liberalization, leading to more youths studying overseas, more personal exchanges by the general public, an increase in foreigners living in Korea and the direct purchasing of goods from overseas sources due to developments in the Internet and SNS media. These changes have also led to a sharp increase in new forms of illegal drugs spreading throughout the society. In response, policy directions and investigations to crackdown on drugs and other toxic substances are entering a new phase. Within this situation, youths are at particular risk as they are still in the process of physical and mental development. Youth exposure to harmful substances such as drugs, which accompany a high risk of hidden crimes, poses not only a danger for the individuals themselves, but also for the future of the nation, and as such it is important to focus on preventing these youths from being exposed to harmful substances in the first place, and find solutions to prevent recurring offenses when a youth has already experienced and/or become addicted to such substances. In this paper, we propose to extend the currently limited education on smoking and drinking, on which school programs mainly concentrate, to include education to prevent youths from using hallucinogenic substances and help them cope with these dangers. In addition, we propose cooperating with competent agencies to operate a system that works in real time, automatically monitoring and deleting/blocking information that allows youths to purchase and manufacture hallucinogenic substances. We also believe it will be necessary to establish a single drug control agency that can effectively curtail the rise of drug and substance addiction criminals, including but not limited to juvenile offenders, by conducting analytical follow-up investigations of these crimes.
