로크의 『통치론』과 이에 대한 헤겔의 비판으로부터 우리는 무엇을 배울 수 있는가? 로크는 ‘자연 상태’라는 착상을 통해 개인과 사회의 문제를 해결하고자 한다. 자연 상태는 사회가 부재하는 곳, 곧 개별자들의 세상이면서도 바로 이로부터 사회가 비로소 등장해야하는 곳이다. 로크가 이 문제를 다루는 방식을, 헤겔은 「자연법 논문」에서 비판한다. 헤겔에 따르면 사회와 국가를 연역해내는 과정은 경험주의 고유의 한계들에 부닥쳐 실패하고 만다.

이글은 「자연법 논문」에서의 경험론적 자연법 비판을 헤겔의 ‘거친rough 비판’과 비교하여 그의 『대논리학』로부터 ‘유려한refined 비판’을 보여줄 것이다. 헤겔의 ‘거친’ 비판은 로크의 『통치론』에 대한 ‘자연-신학적인 해석’을 충분히 비판하지 못한다. 이 해석에 따르면 로크의 정치철학은 성경과 기독교적인 믿음에 일정 부분 근거하기 때문에, 헤겔의 「자연법 논문」이 보여주는 경험주의 비판이 약화된다. 하지만 헤겔의 『대논리학』은 로크의 정치철학과 자연 신학적 믿음들까지도 비판적으로 재구성할 수 있다. 반성 추리를 적절히 해석함으로써, 개별성, 특수성, 보편성이 서로 연결되는 다양한 개념적 조직 구조―범유Allheit, 귀납, 유비―가, 로크의 주장에 대한 해명을 포함하여, 개인과 사회의 정치철학적 관계를 해명하는 체계론적 헤겔 독해가 시도될 것이다.

What are we able to learn from the Locke’s account of politics in Second Treatise and Hegel’s critiques on it? Locke’s attempt to propound a kind of intimacy between individuals and their society takes its shape as ‘the state of nature.’ This place is the locus in which individuals reside without any social norm and political institution which should come into existence by the individuals. Hegel’s critique in On Natural law intends to undermine the way Locke articulates his arguments, due to which, by Hegel, Locke’s deduction of civil or political society fails; indeed, it is in a way that Hegel accuses of the empiricist method.
This paper will put forward Hegel’s ‘refined’ critique on Locke in Science of Logic, comparing it with his rough one in On Natural law. The rough one may well be diluted by the interpretative reading about Locke’s political philosophy, called ‘contextualist reading’ which strives to posit Locke’s political arguments midst his natural-theological system. According to this, Locke’s political philosophy is at least partly based on Scripture and Christian belief, yielding waning effects of Hegel’s rough critique. Still, Hegel’s Science of logic is able to provide resources to subsume Locke’s account of politics as well as his theological idea under systematic constellation of the empirical universality. It is expected that the syllogism of reflection makes it possible to substantiate the orderly matrix, such as allness, induction, and analogy, in which individuality, particularity, universality are in play. The inner relationship of individuals and society in political philosophy would be elucidated by this systematic reading on Hegel.This paper will put forward Hegel’s ‘refined’ critique on Locke in Science of Logic, comparing it with his rough one in On Natural law.
