동아시아해양환경관리기구(PEMSEA)의 설립과 활동에 관한 연구 (A Study on the establishment of Partnerships in Environmental Management for the Seas of East Asia(PEMSEA) and its Activities)

초록

1993년에 시작된 ‘동아시아해양의 해양오염의 방지와 관리’라는 프로젝트가 1999년 성공적으로 완료되고 나서, 동아시아해양지역에서 국가간에 신뢰가 구축되고 환경문제에 관하여 이해당사자들의 파트너쉽을 발전시킬 필요성이 인식되고 이에 따라 PEMSEA(Partnerships in Environmental Management for the Seas of East Asia)라는 파트너쉽이 구축되었다. 이러한 파트너쉽은 이에 참여하는 국가들이 2003년 '동아시아해양의 지속가능한 개발을 위한 지역협력에 관한 Putrajaya선언'의 채택, 2006년 SDA-SEA의 이행에 관한 Haikou 파트너쉽 협정의 채택, 2009년 PEMSEA의 국제적 법인격 승인협정의 채택을 통하여 PEMSEA를 동아시아해양의 지역적 국제기구로 발전시켜 왔다.
본고에서는 PEMSEA의 설립과 그 활동을 분석하기 위하여, PEMSEA의 설립배경과 목적을 우선적으로 설명하고, 다음으로는 PEMSEA의 법적 성격 및 국제기구로서의 성립요건을 갖추었는가를 분석하였다. 이러한 분석에 의하면 현재의 PEMSEA는 국제기구의 성립요건에 해당하는 특성들을 완벽하게 갖추었다고 볼 수는 없다. 2009년 11월 PEMSEA의 국제적 법인격 승인협정이 한국을 포함한 8개국에 의하여 체결되어 있지만, 이 협정에서는 아쉽게도 PEMSEA가 갖는 국제적 법인격의 내용으로서 특권과 면제에 대한 규정을 두지 못하였다. 그래서 PEMSEA는 그 임무의 수행과정에서 이에 대한 보완조치가 필요할 것으로 보인다. 마지막으로 PEMSESA의 주요한 활동내용으로서 동아시아해양의 해양오염방지와 관리를 위한 활동을 지속가능한 개발전략의 관점에서 서술하였으며, 또한 항만의 지속가능한 운영프로젝트를 중심으로 살펴보았다.

영어초록

The Project, known as the prevention and management of marine pollution in the East Asian Seas, was launched in December 1993 and was completed in september 1999. The successful completion of the pilot project led to the building of confidence and recognition of the need to develop stakeholder partnerships in addressing the increasing environmental challenges in the seas of East Asia. A second phase project(1999-2007) focusing on building intergovernmental, interagency and multisectoral partnerships in environmental management was supported by GEF(Global Environment Facility). The thrust of the new project was build partnerships, hence the acronym PEMSEA (Partnerships in Environmental Management for the Seas of East Asia), to represent the new project initiatives. The participating countries at the PEMSEA adopted Putrajaya Declaration of Regional Cooperation for the Sustainable Development of the Seas of East Asia in 2003, Haikou Partnership Agreement on the Implementation of Sustainable Development Strategy for the Seas of East Asia in 2006 and successively Agreement recognizing the international legal personality of the partnerships in environmental management for the seas of East Asia in 2009. In accordance to the successive adoption of these arrangements, PEMSEA is developed to the regional organization of the seas of East Asia.
In this article, first of all, I explain the background and object of PEMSEA, after that, I analysed whether PEMSEA fulfills the conditions being established into international organization. According to this analysis, it is not considered that PEMSEA has possessed perfectly the conditions establishing international organization. Though 2009 Agreement recognizing the international legal personality of PEMSEA was signed by the eight countries including Republic of Korea, this Agreement did not stipulate the privileges and immunities of PEMSEA. Thus it is recommanded to supplement 2009 Agreement in implementing its task. Finally, I analysed the activities of PEMSEA according to the Sustainable Development Strategy for the Seas of East Asia and the project on the sustainable operation of ports through the development and implementation of port safety, health and environmental management(PSHEM) Code.
