倡義團의 의열투쟁과 일제의 사법처리 (Patriotic Struggle of Changuidan and Judicial Process by the Japanese Empire)

초록

1919년 7월 間島에서 조직된 창의단은 간도참변 이후 南滿洲 奉天에서 조직을 정비하고 한반도 내에서 일제 기관을 공격한다는 의열투쟁을 계획하였다. 창의단에서는 1925년 무렵부터 구체적인 계획을 수립하여 독립 의지를 고취하고 독립운동자금을 모집하기 위한 목적으로 조선총독부 신청사, 朝鮮神宮, 경성부청 신청사, 조선은행, 종로경찰서에 동시다발적으로 폭탄을 투척하고 포고문을 배포하기로 하였다. 의거 주동 인물인 金應先·桂義山·全佐漢·黃二根 등은 의거에 사용할 폭탄을 한반도 내에서 제조하기로 하였고 폭탄을 제조하여 성능시험까지 마쳤다. 이들은 1926년 1월 31일 의거를 실행하기로 하였다.
창의단의거 계획을 탐지한 일제는 의거 실행 직전에 참여 인물 일부를 체포하였고 이로써 의거는 실행되지 못했다. 이후 서울·봉천·北京에서 의거 관련 인물들이 일제 경찰에 체포되어 재판에 넘겨졌다. 이들은 재판 과정에서 의거 참여와 폭탄 제조에 관해 대부분 부인하였다. 재판장이 의거 핵심 인물인 전좌한을 신문하는 과정에서는 전좌한이 경기도경찰부의 밀정으로 활동했다는 내용이 밝혀지면서 창의단의거가 실행되지 못한 원인은 ‘밀정 활동’ 때문인 것으로 드러났다.
재판 시작과 동시에 당시 언론에는 ‘전좌한 밀정설’이 보도되었고 재판이 마무리 될 무렵 언론 뿐만 아니라 재판부와 담당 검사 모두 전좌한을 밀정으로 지목하였다. 이는 재판 과정에서 전좌한이 밀정임을 시인하였기 때문이었다. 그런데 그는 사망 직전 언론인터뷰에서 자신이 밀정이 아니었다고 주장하였다. 창의단의거에서 전좌한의 밀정 행위는 명백히 드러났지만 밀정 행위만으로 그가 밀정이었다고 규정할 수 없다. 왜냐하면 일반적으로 밀정은 개인의 영달과 이익 추구를 목적으로 하지만 밀정 활동을 독립운동에 활용한 독립운동가들도 존재하기 때문이다. 전좌한을 밀정으로 규정하기 위해서는 밀정 행위 뿐만 아니라 일제에 밀정으로 고용된 전후 시기의 활동과 동향, 인적 관계 등을 모두 고려해야 한다. 또한 전좌한이 밀정이 아님을 확정하기 위해서는 밀정 활동의 목적, 독립운동 단체 참여 정황, 출옥 이후의 행적 등이 명확히 밝혀져야 할 것이다.
창의단의거는 ‘밀정 활동’으로 실행되지 못한 의열투쟁이다. 의거가 실행되지 못하여 일제 기관에 타격을 주지는 못했으나 의거 준비 과정과 내용이 언론 보도로 세간에 알려지게 되면서 반제항일 투지와 독립 의지를 고취하는데는 기여한 측면이 적지 않다고 할 수 있다. 이러한 의열투쟁에 주목하고 의거에 참여한 인물들에 대한 연구가 진행된다면 의열투쟁의 전체상을 규명하는데 많은 도움이 될 것이다.

영어초록

Changuidan that was organized in Jiandao of July 1919, aligned its organization in Shenyang, South Manchuria after the Jiandao Massacre, and then planned a heroic struggle of attacking Japanese institutions in the Korean Peninsula. Changuidan that established its concrete plan from around 1925, decided to simultaneously throw bombs at the new building of the Japanese Government General of Korea, Joseon Shinto Shrine, the new building of Gyeongseong-bu Office, Joseon Bank, and Jongno Police Station, and then to distribute a declaration for the purpose of inspiring the will for independence and raising funds for independence movement. The leaders of the movement such as Eungseon Kim, Uisan Gye, Jwahan Jeon, and Eigeun Hwang decided to make bombs for the movement within the Korean Peninsula, and even completed the performance test after producing the bombs. They planned to carry out the movement on January 31, 1926.
The Japanese Empire that detected the movement plan of Changuidan arrested some of the participants right before the movement, so the movement was not put into practice. After that, the people related to the movement were arrested by the Japanese police in Seoul, Shenyang, and Beijing, and then handed over to the trial. In the trial process, they mostly denied the participation in the movement and production of bombs. When the chief justice questioned Jwahan Jeon as the key person, it was revealed that Jwahan Jeon worked as a spy under the Gyeonggi Provincial Police Department, so the cause for not being able to carry out the movement of Changuidan was revealed as ‘spy activities’.
As soon as the trial began, the media of the time reported the ‘rumor of Jwahan Jeon as a spy’. When the trial was about to end, everyone including the media, court, and prosecutor in charge pointed out Jwahan Jeon as a spy because jwahan Jeon admitted himself as a spy in the trial process. However, Jwahan Jeon argued that he was not a spy in a media interview right before his death. Even though Jwahan Jeon’s spying action in the movement of Changuidan was clearly revealed, the spying action was not good enough to define him as a spy because spies generally aimed for their own distinction and pursuit of profit, but there were also independence activists who used their spying activities for independence movement. In order to define Jwahan Jeon as a spy, we should consider not only spying action, but also all the activities, movement, and personal relationship around the time when he was hired as a spy by the Japanese Empire. Also, to determine that Jwahan Jeon was not a spy, the purpose of spying activities, circumstance of participating in the independence movement group, and the trail after released from prison should be clearly revealed.
The movement of Changuidan was a patriotic struggle that was not carried out because of ‘spying activities’. Because the movement was not carried out, it could not give a blow to the Japanese institutions. As the content about the process of preparing for the movement was known to the public by the media report, it largely contributed to inspiring the fighting spirit against Japan and a will for independence. If there is a further study on the figures who participated in the movement by paying attention to this patriotic struggle, it would be greatly helpful for understanding the whole image of patriotic struggle.
