「다문화가족지원법」의 개선방안 (Measures to Improve the Multicultural Family Support Act)

초록

다문화가족지원법이 제정된 이후 수많은 다문화가족지원 사업이 시행되었음에도 불구하고 다문화가족의 이혼율은 줄어들지 않고 있고 다문화가족 아동과 청소년들의 한국어 능력은 부족하며 학교생활의 어려움은 여전하다. 이런 결과는 그동안 수행되어 온 다문화가족지원 사업이 옳게 계획되지 못하였으며 다문화가족지원센터에서 잘못 실행되었기 때문이다. 다문화가족지원정책 기본계획의 과제명이 명확하지 않고 애매하여 중과제, 실행과제를 통하여 그 내용이 충분히 구현될 수 없었다. 이를 방지하기 위하여 다문화가족지원정책 기본계획과 시행계획의 과제명은명확하게 구성되어야 한다. 인구감소문제가 심각한 현 시점에서 다문화가족지원법의 적용대상인 다문화가족의 범위를 확장하여야 한다. 고려인동포의 경우 한국어능력 없이 가족단위로 입국하여 한국에서 생활함으로 이들은 많은 어려움을 격고있다. 또 이들은 역사적으로 대한민국 건국 과정에 공적이 인정된다. 그리하여 다문화가족지원법의 적용대상에 고려인동포 가족을 포함시킬 것을 제안한다. 이를 위하여 다문화가족지원법 제2조 제1호에 “다. 고려인동포 합법적 체류자격 취득및 정착지원을 위한 특별법 제2조의 고려인동포로 구성된 가족”이라는 문구를 추가하는 다문화가족지원법 개정을 제안한다. 또한 다문화가족지원 사업이 다문화가족센터에서 효과적으로 실행될 수 있도록 다문화가족센터 구성원은 다문화사회 전문가로 구성되어야 한다. 현재 다문화가족센터의 구성원은 다문화사회 전문가 자격을 보유한 사람이 아니기 때문에 좋은 다문화가족정책이 선택되었어도 그 정책대로 실행될 수 없다. 이를 위하여 다문화가족지원센터 구성원을 규율하고 있는 다문화가족법 시행규칙 제3조 본문을 “법 제12조 제1항부터 제3항까지의 규정에 따른 다문화가족지원센터(이하 “지원센터”라 한다)에는 같은 조 제5항에 따른 다문화사회 전문가 2명 이상과 다음 각 호의 어느 하나에 해당하는 전문인력 1명 이상을 두어야 한다.”로 개정할 것을 제안한다. 마지막으로 민간단체의 전문성을 높이기 위하여 민간단체를 규율하고 있는 다문화가족지원법 제16조에 제3항을 신설하여 “국가와 지방자치단체는 다문화가족 지원 사업을 수행하는 단체나 개인이 전문성을 갖추도록 필요한 제도와 시책을 강구하여야 한다.”는 내용을 추가하는 법률개정을 제안한다.

영어초록

Despite the fact that numerous multicultural family support projects have been implemented since the Multicultural Family Support Act was enacted, the divorce rate of multicultural families has not decreased, the Korean language skills of children and teenagers from multicultural families are insufficient, and difficulties in school life remain. This result is because the multicultural family support project that has been carried out so far has not been planned properly and was implemented incorrectly by the multicultural family support center. Because the task title of the multicultural family support policy basic plan was unclear and ambiguous, its contents could not be fully implemented in the next stage. To prevent this, the project names of the multicultural family support policy basic plan and implementation plan must be clearly structured. At a time when the problem of population decline is serious, the scope of multicultural families subject to the Multicultural Family Support Act must be expanded. In the case of Korean ethnic Koreans, they enter Korea as a family and live in Korea without any Korean language skills, so they face many difficulties. Historically, they are recognized for their contributions in the founding process of the Republic of Korea.
Therefore, we propose to include Korean ethnic Korean families in the scope of application of the Multicultural Family Support Act. To this end, I propose a law amendment to add “Da.” to Article 2, Paragraph 1 of the Multicultural Family Support Act, as such “Families composed of Korean ethnic Koreans as defined in Article 2 of the Special Act on Acquisition of Legal Residence Status and Settlement Support for Korean-Korean People.” In addition, so that the multicultural family support project can be effectively implemented at the multicultural family center, the members of the multicultural family center must be composed of experts in the multicultural society. Currently, the members of the Multicultural Family Center do not have qualifications as experts in multicultural society, so even if a good multicultural family policy is selected, it cannot be implemented according to that policy. To this end, the text of Article 3 of the Enforcement Rules of the Multicultural Family Act, which regulates members of the Multicultural Family Support Center, must be revised as follows, “The multicultural family support center must have at least two multicultural society experts and at least one expert who falls under any of the following items.” Lastly, in order to increase the expertise of private organizations, paragraph 3 should be added to Article 16 of the Multicultural Family Support Act as follows, “The state and local governments must devise necessary systems and policies to ensure that organizations and individuals carrying out multicultural family support projects have expertise.”
