농·축산분야 비전문취업(E-9) 외국인근로자 거주환경 개선을 위한 제도정비방안 : 건축물 입지기준 개선을 중심으로 (A Study on the System Reform Plan for Improving the Residential Environment for the Non-Professional Foreign Workers (E-9) in the Agriculture and Livestock Industry : Focusing on Improving Site Standa)

초록

본 연구는 농·축산분야 비전문취업 외국인근로자(E-9)의 거주환경 개선을 목적으로외국인근로자 숙소 설치 시 발생가능한 공법상 문제점에 대해 분석하였다. 분석결과농촌지역은 「국토의 계획 및 이용에 관한 법률」, 「농지법」, 「산지관리법」 등 다양한 법률을 적용받고 있기 때문에 외국인근로자가 거주할 수 있는 “숙소”의 설치가 법적으로제한을 받고 있어 외국인근로자의 숙소가 “가설건축물”의 형태로 나타나고 있는 것이며, 사업주 역시 「건축법」을 위반하고 있다는 것을 인지하고 있음에도 방법이 없어 “가설건축물”의 형태로 제공하게 된다는 문제점을 살펴보았다. 이를 개선하기 위해 제안한 제도개선방안은 다음과 같다.
첫째, 「국토의 계획 및 이용에 관한 법률」에 따른 생산·보전녹지지역, 생산·보전관리지역, 농림지역, 자연환경보전지역 내에서 건축물 용도제한을 완화하여 “근로자주택”과 “근로자기숙사”의 설치를 허용하는 것을 제안하였다. 다만, 시·군에서 각자의 지역적 특성을 고려하여 자율적으로 적용이 가능하도록 도시·군계획조례로 정하는 경우에만 설치할 수 있도록 하였다.
둘째, 「농지법」에 따른 “농업진흥지역” 내에서 “근로자주택”과 “근로자기숙사”의 설치를 허용하는 것을 제안하였다. 다만, 법상 조례에 위임하는 조항이 없어 같은 법 시행령을 통해 외국인근로자의 근로복지 개선을 위하여 공급되는 사항에 한해 설치가 가능하도록 하였다.

영어초록

This research analysed potential problems of public law to improve the living environment of E-9 workers in the agricultural and fishery sectors when employers install accommodations for the foreign workers. As a result of the analysis, the installation of the E-9 worker’s accommodations in the rural area is legally restricted due to the application of various regulations such as 「The National Land Planning and Utilisation Act」, 「Farmland Act」, and the 「Management of Mountainous Districts Act」; thus E-9 worker’s accommodations are typically provided in the form of temporary buildings. Also, even if the business proprietors acknowledge the violation of the 「Building Act」, they still provide temporary buildings. Therefore, this study proposes a series of suggestions for the system improvement plan as below.
First, this paper proposes legal permission to install a worker’s housing and/or dormitory by easing restrictions on the use of a building within the Production Green Areas and Conservation Green Areas; Production Control Areas and Conservation Control Areas; Agricultural and Forest Areas; Natural Environment Conservation Areas by 「The National Land Planning and Utilisation Act」, which will allow the installation of accommodation for E-9 workers in the rural area. However, it will only be authorised when Si/Gun establish specific ordinances by rigorous consideration of regional characteristics and their autonomous decisions.
Second, this study proposes legal permission to install a worker’s housing and/or dormitory within the Agricultural Development Area under the 「Farmland Act」. However, there is no article to be entrusted into the local ordinance under the Farmland Act yet. The research limits the installation of the worker’s accommodation provided for the improvement of foreign worker’s working welfare by Article 2 of the 「Act on Foreign Workers’ Employment, etc」 through Enforcement Decree of Farmland Act.
