한국비교공법학회 40년 학술성과의 회고와 전망 (Retrospective and outlook on 40 years of academic achievements of the Korean Comparative Public Law Association)

초록

한국비교공법학회는 그 전신인 1984년 공법연구회를 기준으로 40주년을 맞이하였다.
그동안 113차례의 정기학술대회를 통하여 521건의 주제 발표를 진행하였으며, 1207개의 연구논문이 수록된 84권의 공법학연구를 발간하는 등 학술성과를 축적해오고 있다. 이글은 한국비교공법학회 창립 40주년을 기념하여 지금까지의 학술성과를 ‘학술대회 대주제’와 ‘공법학연구의 논문’들을 살펴보는 것으로 현재의 좌표를 확인하고 미래를 향한 이정표로도 참고할 수 있으면 하는 바람에서 작성되었다.
먼저, 법학을 궁극적으로 현실과 규범 간의 조화로운 해석을 찾아가는 학문이라는 견지에서 보면, 사회문제나 현안에 대한 법학적 검토는 일반적인 모습이라고도 할 수 있다. 한국비교공법학회에서 40년간 개최한 학술대회의 대주제는 대체로 그 시기 대두된 쟁점을 검토하면서도, 지방자치와 같이 학회가 특히 관심을 두고 있는 어젠다를 설정하거나 나아가 보다 거시적인 문제의식으로 한 해 전체의 주제를 ‘환경·안전·거버넌스’ 등으로 설정하는 모습도 보여주고 있다. 반대로 규범 자체의 순수이론적 차원의 쟁점은 상대적으로 부족한 경향이 있었다. 다음으로 공법학연구의 학술성과와 관련하여 살펴볼 때 그동안 방대한 논문과 다양한 주제를 통해 현안에 대한 의미 있는 법적 검토가 게재되었다. 그러나 민주주의에 대한 본질적 연구 혹은 사회적 이슈였던 코로나19 상황과 이를 거치면서 인공지능을 중심으로 하는 제4차 산업혁명, 이와 관련하여 재촉발된 자율규제 등의 논제에 대한 지원과 유도에도 관심을 기울일 필요가 있다. 이들 쟁점에 대한 논의를 지원하고 학회지에 게재되도록 유도할 수 있을 것이다. 마지막으로 이 글은 한국비교공법학회의 현재의 발전된 모습을 확인하면서, 과거와는 다른 법학 교육 시스템 및 변화된 환경 아래 대응할 필요성을 제기한다. 즉, 학회는 고유의 정체성과 자율성을 유지하고 이를 바탕으로 보다 양질의 학술성과를 지원하기 위한 노력을 경주해 나가야 할 것이다.

영어초록

The Korean Comparative Public Law Association celebrated its 40th anniversary since 1984. So far, we have made 521 topic presentations through 113 regular academic conferences and have accumulated academic achievements, including publishing 84 volumes of Public Law Journal containing 1,207 research papers. In commemoration of the 40th anniversary of the founding of the Korean Comparative Public Law Association, this article examines the academic achievements to date through the ‘Conference Topics’ and ‘Public Law Journal’ to confirm the current coordinates and also refer to it as a milestone toward the future. It was written with that in mind.
First, from the perspective of law as a study that ultimately seeks a harmonious interpretation between reality and norms, legal review of social problems or current issues can be said to be a general aspect. The major themes of the academic conferences held by the Korean Comparative Public Law Association for 40 years generally examine issues that emerged at that time, while setting agendas that the society is particularly interested in, such as local autonomy, or furthermore, with a more macroscopic awareness of issues, the overall theme of the year is reviewed. It also shows that the topic is set to ‘environment, safety, governance’, etc. Conversely, issues at the purely theoretical level of the norms themselves tended to be relatively lacking. Next, when looking at the academic achievements of Public Law Journal, meaningful legal reviews of current issues have been published through extensive papers and various topics.
However, we are also interested in supporting and guiding topics such as research on essential research on democracy. And it also necessary to pay attention to the COVID-19 situation, which was a social issue, and to support and guide topics such as the 4th industrial revolution centered on artificial intelligence and self-regulation that have been renewed in relation to this. It will be possible to support discussions on these issues and encourage their publication in academic journals. Lastly, this article confirms the current development of the Korean Comparative Public Law Association and raises the need to respond under a different legal education system and changed environment from the past. In other words, the academic society must maintain its unique identity and autonomy and, based on this, make efforts to support higher quality academic results.
